Ibn `Umar (May Allah be pleased with them) said: The Messenger of Allah (PBUH) said, "When a person calls his brother (in Islam) a disbeliever, one of them will certainly deserve the title. If the addressee is so as he has asserted, the disbelief of the man is confirmed, but if it is untrue, then it will revert to him.‘’ [Al-Bukhari and Muslim].
Abu Dharr (May Allah be pleased with him) said: I heard the Messenger of Allah (PBUH) saying, "If somebody accuses another of disbelief or calls him the enemy of Allah, such an accusation will revert to him (the accuser) if the accused is innocent.‘’[Al-Bukhari and Muslim].
Bukhari and Muslim agree on the report that once Ali sent some money from Yemen to the Holy Prophet, and the Holy Prophet divided it among four men. At this a man who was there said: “O Messenger of Allah, fear Allah!”
The Holy Prophet said:
“Woe to thee! Who on earth is more obliged to fear God than me!”
Khalid Ibn Walid was present. He said:
“Messenger of Allah, should I not kill him?”
The Holy Prophet said:
“No, perhaps he says his prayers.”
Khalid said:
“Many are they who say their prayers, but do not have in their hearts what they say with their tongues.”
The Holy Prophet said:
“I have not been commanded to open up the hearts of people or to cut open their insides.”

Ya because there is no room for Sects in Islam, it is against the idea of Muslim unity which is core of Islam...
Anyway, one try to read between the lines of this hadees, it is said that, muslim ummah will be divided into 72 sects, and all of them will go to hell.. means none of them will be on the right path, and only those will go to heaven who have followed the Quran and way of Prophet (SAAW).. now can you or any body tell me that which sect, Prophet Mohammad (SAAW) belong to...

I was trying to look for the Hadith where once in one Ghazwa one Sahaabi killed a man who recited kalima. And Sahaabi said he recited kalima becasue of fear of death. But when Rasoolullah SAW heard this, it is reported that sahaabi never saw Rasoolullah (SAW) so angry and said you should have opened his heart and see whether he was reciting the Kalima with heart or not. He also said what will you do when his kalima will grab you on day of judgement. (if anyone has the Hadith with the reference then please do post.)
It is in Hadith that once during a military expedition a man, when he saw the Muslims, said: "Assalamu Alaikum, there is no god but Allah, and Muhammad is the Messenger of Allah." But a Muslim killed him, thinking that the man had proclaimed the Kalima just to save his own life. When the Holy Prophet heard of this, he was very angry, and he reprimanded that Muslim. But he replied:
"O Messenger of Allah, that man read the Kalima merely to protect himself from our sword."
The Holy Prophet said:
"Did you open his heart and look inside it?"
A companion of the Holy Prophet asked:
"If a man (in battle) attacks me and cuts off my hand, but when I attack him he recites the Kalima, can I kill him in these circumstances?"
The Holy Prophet said: "No." The companion said:
"O Messenger of Allah, he cut off my hand."
The Holy Prophet said:
"Despite that, you cannot kill him. If you do kill him then he will have the rank which you had before you killed him, and you will have the rank which he had before he recited the Kalima."
In another hadith it says that the Holy Prophet said:
"If a man (in a battle) is attacking a kafir with a spear, and it has reached his throat, and at that moment he says 'There is no god but Allah', the Muslim must immediately withdraw his spear."
Another hadith records that
"to abuse a Muslim is an act of wrong-doing, and to fight a Muslim is an act of kufr."
Article 298-C of this law states "Any person of the Quadiani group or the Lahori group (who call themselves ‘Ahmadis’ or by any other name), who, directly or indirectly, poses himself as Muslim, or calls, or refers to, his faith as Islam, or preaches or propagates his faith, or invites others to accept his faith, by words, either spoken or written, or by visible representations, or in any manner whatsoever outrages the religious feelings of Muslims, shall be punished with imprisonment of either description for a term which may extend to three years and shall also be liable to fine."

the point of posting these hadiths was to prove that no one has the right to kill anyone on the basis of their believe.... and no one has the right to declare others KAFIR or non muslim.....
despite of what their believes are about Hazrat Ish (as) and Imam Mahdi....

Anyone who calls himself/herself a Muslim and professes faith in the Kalima "There is no God but Allah and Muhammad (SAW) is the messenger of Allah" is a Muslim. No-one else has a right to declare him non-Muslim.
A Muslim's goal should be to preach and invite people into Islam, not kick the fellow-Muslims out of it.

Jazakllah for references....i guess lets hear what others have to say in light of Ahadith whether anyone has right to call anyone Non-Muslim?
I think unless or untill one issue is cleared you cannot reach another. In the end everyone has the choice to choose whatever they want. But I guess enough references are presented from this side regarding Muslim and Non-Muslim issue.

Okay, so according to ahmadis muslim scholars have no right to declare someone kafir who claims to be prophet and his followers when it is an established fact that we as muslims have to believe in "la nabi ba'di" the finality of Prophethood.

I think a non-muslim is better then a kafir(disbeliever) because A kafir actually knows the truth but rejects it or hides it.

well Shia Ulema have called Sunnis Kaafir many times and vice versa..

Ahle Sunnah believe Shia to be muslims because of the correct main Aqeedah and vice versa...those who don't are ignorant.
