The punishment applies only if there are 4 witnesses to the actual penetration or a confession and besides if u've had sex before marriage you're encouraged to keep it to yourself ('conceal ur sins') unless it directly affects other ppl eg. u have an STD or gotten someone pregnant or something..
"A prostitute was forgiven by Allah, because, passing by a panting dog near a well and seeing that the dog was about to die of thirst, she took off her shoe, and tying it with her head-cover she drew out some water for it. *So, Allah forgave her because of that." *

Yes such instances are there... but what is haraam is haraam - our religion has been completed thus we know what is right and what is wrong.
What is the punishment of murder in Shariah law...?I am not even talking about witnesses here... for instance I am just saying... if you murdered someone would you just get on with your life... just because no one saw it expecting Allah to forgive you or will you confess and take the punishment Allah has ordered for such an act in order to get rid of the guilt and make sure Allah forgives you... its common sense really... otherwise you will never be sure that you're forgiven. That's what I meant by unforgivable... that you have to pay the price for it according to the Islamic law. If the punishment for fornication is a 100 stripes or even stoning to death according to some traditions than I will have to take that punishment in order to expect forgiveness for such a major sin:
Allaah says (interpretation of the meaning): “And those who invoke not any other ilaah (god) along with Allaah, nor kill such person as Allaah has forbidden, except for just cause, nor commit illegal sexual intercourse and whoever does this shall receive the punishment.
The torment will be doubled to him on the Day of Resurrection, and he will abide therein in disgrace”[al-Furqaan 25:68-69]
The punishment must be carried out in this world on the one who has committed zina (fornication or adultery), as Allaah says (interpretation of the meaning):
“The fornicatress and the fornicator, flog each of them with a hundred stripes. Let not pity withhold you in their case, in a punishment prescribed by Allaah, if you believe in Allaah and the Last Day. And let a party of the believers witness their punishment”
[al-Noor 24:2]
