I'll search for cases and post the link but you are not allowed to use force unless you think your life in in danger. If guys are breaking in and running with hmm msay music system, you are not allowed to hit them.
DC6 isn't wrong about the legal system making mistakes when they charge someone, but in principle, the law makes sense.
You can use force or deadly force to protect your own or someone else's life, but not to protect property. If you look at it - it's putting greater value on human life than property.

and essentially that means you have to WAIT for intruders to attack you first warna aap apney bed k neechey chupey raheeen and see them getting away with all of your halal kamiee
Personally I think, intruders give away their right once they break into my house ...period! I will not wait and let them make a move first with my kids in the house. I'll not only swing my bat, I'll swing it hard so they can not get up again of the floor.
We all know about popular David Chen case. A store owner who made a citizen arrest was charged by police. Guy stole stuff from his store and came back for shoplifting after 1 hour of first trip. Chen, with the help of another worker, caught him, tied his hand and put him in the back of the VAN waiting for police. What did police do? charged him for confiscating the thief

Exactly.
I am sorry to say but I am glad that I dont live in Canada.

plain stupid
The principle is to use proportional force.
Is it right to kill an unarmed man because he's in your home? Is it right to assault a fleeing robber, who is no longer a threat to you?
It comes back to - what is the value of human life.

Just because intruder is unarmed does not mean that your life and your kids life is not in danger. He could put your house on fire, he could pick up your kitchen knife and stab you, he could grab your baseball bat and swing at you. Its not my property that is more important than a human life, its my privacy & safety, and safety of my family that is more important than the life of someone who broke into my house.
hehhee…took a while for my nephew to figure out the same thing when his father called him “ulloo ka paTha” in jest
he was quick to turn the joke around too.
not at all GK…
and why would you think that there would be a gun pointed at you anyway?

As TLK said, just because he is unarmed does not mean that he can not harm you and your family. I'd rather see him bleeding lying on the floor than one of my loved ones. What if he is running away and he decided to take one of your kid hostage? Why let situation go that far?
I am a firm believer of Finish it if you can as soon as possible.
When unwanted people are around someone's family, they rarely think about the consequences and the law. All they want at that point in time, to get the family out of it by any mean. I hit the guy intentionally with my car when the group was trying to rob us (New Jersy, US) . I am not sure if his bones were broken, I dont know how many stitches he got on the wound but I know one thing and that is I dont regret that at all.
The idea is, is there an imminent risk to you as opposed to an imagined/potential risk? It's all based on what a reasonable person would do in the same circumstances.
And think back to how many times do we go tsk-tsk when we hear the police shot and killed an unarmed man/woman. Our first reaction is - was the lethal force necessary?
I read a case where 72 year old boy friend killed his 70 year old gf thinking she is an intruder because she went to the refrigerator during midnight....whom he was going to marry next day....:(

Both are difference situations. Police is TRAINED for such situations and have more resources to dispatch to make peaceful arrest. Secondly, they are still allowed to shoot-not-to-kill (such as on legs) if they feel that they are in danger.

A cop having an itchy finger is diff than you and me practicing our right to defend our lives and property.
there are many examples of people that have/had guns within reach in their homes yet suffered a terrible fate at the hands of robbers/intruders.
I would prefer not to have any such weapon in the house......
I am not also a promoter of having a weapon in the house but I see rational behind having one. Just like I am not a big fan of going to the dentist but I cant deny the need of it.
so the right to bear arms is so that one may protect themselves from burglars? to me this is the equivalent of laying bear traps in your living room just in case a grizzly showed up. if you make it easy for average joes to get a gun, you are making it twice as easy for those with criminal intentions to get one, and he'll probably shoot your donkey up before you get your key for the gun safe out from your wallet or whever..
The value of human life remains unchanged, regardless of whether it was a cop or a civilian who harmed it.
Don't get me wrong, I'm not saying DON'T defend yourself and your family. Absolutely we should defend ourselves from harm, including using lethal force if necessary. But I do believe in proportional defense. Our actions should match the harm done to us. If justice demands an eye for an eye and nothing more, why should defense of ourselves be any different?

proportional force talk look pretty from outside the rink. once you are in a situation, all u think about saving your family

I dont agree with you at all.
A criminal will never use (almost never use) a registered weapon to shoot at someone. Fired bullets are quite easy to traced back to the gun and then to the owner. In fact that is how law enforcing agencies track and trap the gangs, by infiltering the gangs with marked guns.
Also its proven fact that when you make something hard to achieve legally, it becomes a hot commodity in underground market, which is only accessible to crminals and lawless people anyways.
