I can understand that you are feeling sorry for Army officers finding lucrative jobs with Bahria Town projects ... but I could not understand why you are not feeling sorry for those bureaucrats, judges, journalists, and politicians who get lucrative ‘haddi’ (bribes, rushwats, gifts, bakshishs, bheek, chanda, plots, houses, cars, jobs for close relatives, etc) from Malik Riaz and other civilians who use the system and greed of people in power and position to further their own interests?

InshaAllah ... we can hope for the best. Anyhow, it is hard for me to believe that Iftikhar can really do anything to punish corrupts in Pakistan. Not only because Iftikhar himself is corrupt, bias and dishonest, but because judiciary do not have teeth.

For punishment we need someone determined, honest, and powerful from executives ... either one who may take the power by force like army general or one who may came into power by deception like politician.

Well, if several journalists on oath declare that they saw the evidences themselves then evidences they claim would become established regardless of what Malik Riaz would/could claim regarding non-existence of proofs he shown to journalists. Actually, most cases in world are contested on statements under oath and several statements under oath becomes establish evidence. Actually, people making statements under oath are called witnesses.

That is different matter that Pakistani Supreme Court full of corrupt judges may use Malik Riaz claims to make the case null and void, especially when case is against son of their boss.

Brother, you should know that corruption (I mean corruption in country that affects the country and all living in the country) can be done ONLY by those in government posts. Civilians can only do crime (bribing is crime) and those in power, if they are not corrupt, could punish people guilty of crime.

So, pray that bad times come for all corrupts in power (politicians, bureaucrats, judiciary, law enforcement agencies, lowly government servants, etc). If that would happen, then all civilians taking advantage of corruption in government to further themselves would get sorted out itself.

The thing is that when Musharraf came to power he gave a tough time to Malik Riaz in the beginning but later he became his ally. So being an army general is not a guarantee that they will go after these mafias, as most of them join them after their retirements.

If the journalists say they have seen proofs, and the concerned person (Malik Riaz) says he has not shown any proofs. How can the court establish the details when we know most of those who met him are on his pay roll in any case? They can at the most probe Arsalan Iftikhar's claims, and nothing else.

This case has proven that the politicians (across the board), military and media all are affected by the mafia. Whereas the judiciary how ever weak and corrupt it may be, they have not finished any case against him.

One thing is positive these days The media is get free and they pick any single scam to show the real faces or truth but it's look like that they are for sale too. Ppp is most responsible as well as pmln coz they both played with public for their power hunger game and army used them to keep things get under control so they could collect money. Ppp is wrost but army role in this game is beyond immagination. Now it's our pick chose wrost politicians or est.chose for us. The justice mafia are in favor of both they go where they see personal benefits. Justice is the name of a black mafia in Pakistan.

The chief justice did the courageous thing by taking suo motu notice of the clandestine affair between Malik Riaz and his son Arsalan Iftikhar that had spread like wildfire through a crafty whispering campaign. And after putting the judicial wheels in motion to hold to account his son and Malik Riaz, and throwing his weight behind affixing the liability of the two in a transparent and impartial manner in an open court, he did the right thing by recusing himself from the case. Those who argue that the accusations rooted in gossip should have been shrugged off are wrong. The conduct in question might be that between two private individuals, but one of them being the CJ’s son, the insinuation was that illegal gratification was offered and accepted to influence the outcome of court cases pending before the Supreme Court.

From the disclosures made by journalists so far it is obvious that documents and accounts (and probably even videos?) were meticulously kept to drag the name of the CJ through dirt and consequently bring into disrepute the integrity and credibility of the apex court. The matter therefore didn’t relate to the CJ alone, but would bring under cloud the competence of the highest court of the land to dispense justice not adulterated by considerations of favour. And this in turn would bring into question the very notion of the existence and utility of rule of law in Pakistan by lending credence to the view that (i) law is not a shield for the weak but a weapon in the hands of the powerful to keep in subjugation the lesser mortals in society, and (ii) unimpeachable integrity is a defunct concept as every mortal is up for sale at the right price.

Such jaundiced view of the state and society is not a figment of cynical imagination but is rooted in the reality that the ordinary Joe is confronted with on an everyday basis. By all rational accounts we are living in a kleptocracy: a government of the extortionist, by the extortionist, for the extortionist. The state is in default of its contract with the citizen. You no longer have an entitlement to your rights even if you do your duty as a citizen. And consequently you have to pay for everything, even to protect your most basic rights to life, liberty and dignity. And if you are ready, willing and able to pay, it doesn’t matter if what you seek is right or wrong. State largesse flows through channels of personal patronage. Personal loyalty trumps merit. There is no distinction between honest and dirty money. And there are no principles remaining, only interests.

And consequently instinct demands that one accumulate as much wealth and influence as possible and use it to build social networks of protection to replace the role of the state. And it is people like Malik Riaz, who have mastered the ways of this ‘brave new world’ where money buys influence, influence yields more money, and with the use of money and influence to cajole the powerful and coerce the weak there are no limits to what you can accomplish. But not everyone in this state and society is comfortable with the rules of our evolving kleptocracy. And when someone who has reached the highest echelons of power within the state, like the CJ, refuses to be bought or otherwise inducted within the kleptocracy, the stakes go through the roof.

Within the kleptocracy that we are referring to, the kith and kin of the powerful do exceedingly well. Why should it be surprising that the mediocre son of our CJ grew a sense of entitlement to receive preferential treatment and climb the ropes without paying his dues? Does such lack of discretion and propriety reflect poorly on Iftikhar Muhammad Chaudhry, the father? It probably does. But does it undermine his integrity or credibility as a judge and a public-office holder? Absolutely not. In exposing the dealings between himself and Arsalan Iftikhar, Malik Riaz has used the nuclear option. Why would anyone need to employ means of last resort in the event that quiet persuasion is working? According to media accounts, Malik Riaz leaked details of sponsoring the merry-making of Arsalan Iftikhar because his investment wasn’t paying off.

**So what we have so far is this. By his own account, Malik Riaz paid Arsalan Iftikhar to influence the outcome of judicial proceedings pending before the Supreme Court. Was he forced to do so because the wily Arsalan was blackmailing poor Mr Malik? Improbable, and Mailk Riaz would need to adduce evidence to establish that he was at the receiving end of this clandestine relationship with the imprudent 34-year-old. As Arsalan Iftikhar was not holding court and adjudicating cases implicating Malik Riaz, he would in fact need to establish that the CJ was in fact blackmailing him while using his son as an agent. Without this, and in view of information disclosed by Malik Riaz himself, he could be charged for offering illegal gratification to influence a public servant.

This could make him liable under Section 165-A read with Sections 162 and 163 of the Pakistan Penal Code as well as Section 9 of the NAB Ordinance. If it were established that Arsalan Iftikhar accepted the gratification with a view to influence the discharge of functions by the office of the CJ or other public servants due to the exercise of his personal influence, he could also be liable under Sections 162 and 163 of the PPC. Now that details of this scandal are out in the open, it is essential for the apex court not to take a narrow view of this affair in the event that Malik Riaz backs off and doesn’t adduce any evidence before the court, but instead exercise its inquisitorial powers to collect and decipher facts to ensure that both Malik Riaz and Arsalan Iftikhar are held to account for their actions in accordance with the law.

In this debate, Malik Riaz must not be seen as a solitary individual. He might be a good friend, a loving father and a rich man who believes in charity. But he is also a phenomenon that highlights the growing predatory instincts of our society. This phenomenon has cultivated the myth of infallibility and immortality of the powerful within the society. It has defeated the conventional wisdom that if you are caught with hands in the cookie jar society holds you to account and respectable folk refuse to associate with such delinquents. It has established that irrespective of personal repute, money can buy the best professional assistance. It has proven that if cut a piece of the pie everyone is willing to play ball. This phenomenon has established an ethic of success that labels right and wrong as irrelevant for those who aim for upward professional and social mobility.

The CJ’s commendable action of dragging his son before an open court and laying his ethical failings in plain public view is a defining moment in the fight between continuity of the depraved status quo and the desire for change. As nothing succeeds like success, the strength of the entrenched kleptocracy is rooted not in its popularity but in its efficacy. Our ruling elites – across the political class, the khakis, the bureaucracy, the media and the lawyer fraternity etc – are mostly its beneficiaries.

The few who still have qualms about meddling in grime have turned apathetic having made their peace with the ‘ground reality’ they cannot change. In this environment, the action of the CJ to stand by law and principle, even as he subjects himself and his family to public scrutiny and possible embarrassment, has provided a unique opportunity to stand up and fight the kleptocracy. We must not fitter this opportunity away.

You are right that being an army general is no guarantee that they would really punish corrupts. As you wrote, many may even join them at some time. That is why we can only talk about chances, and there is no guarantee in chances.

Going after mafia is not a problem, as mafia itself is not problem. Mafias are products of corrupt system (or corruption in system). Mafia exists when country has mega corruption (those holding state power are mega corrupts). Mafia gets their power not because they give bribe, but because officials take bribe from them and let them do what they want. Mafias would vanish when there is strong independent accountability in country and no (or little) corruption amongst those holding power and position.

Anyhow, in my opinion, there are more chances in Pakistan that an army general in power may go after corruption then politician.

Court decisions depend on statements under oath. That is the reason, perjury is big crime. If journalists under oath would give statement then it would be considered as truth unless they are proven wrong. If proven wrong then it would be perjury and these journalists could go to prison with heavy fine.

As for who is on Malik Riaz payroll, court cannot speculate that. Anyhow, even if people on Malik Riaz payroll give statement under oath, court cannot ignore that.

You are right. Court once taken sou-moto action, the most they can do is that they can ask any government institution (normally FBI) to probe Arsalan Iftikhar and claims by journalists, nothing else.

Mafia do not affect anyone. It is people in power (politicians, military, media, judges, etc) who get affected by Mafia and bribes or threat of Mafia. Government officials are getting affected by people like Malik Riaz due to bribes whereas same government officials are getting affected by strong militant organisation due to threats. Thus, weakness is in people who are holding Government posts (political or bureaucratic).

As for threat from army officers to government officials on behalf of Malik Riaz, that is ridiculous statement. No honest officer takes threat from anyone. Most work of Malik Riaz involves bureaucrats, judiciary, and politicians in power ... and that is where he must be using most of his money to bribe them.

Actually, if Malik Riaz is not bribing bureaucrats, judiciary and politicians then one can conclude that he became rich legally through his business. If anyone thinks that he used illegal means to get rich, then it is certain that he bribed relevant people in power, and they are people in bureaucracy, judiciary, investigating agencies and politicians in power who controls area he operates and also effects policies related to his business.

In messages sent out Sunday on social media website Twitter, British journalist Christina Lamb has denied having been contacted for a planned ‘expose’ on ‘Familygate’ — the case allegedly implicating the Pakistani chief justice’s son Dr Arsalan Iftikhar and real estate tycoon Malik Riaz of financial wrongdoing.

The Supreme Court has taken up the case earlier last week following media reports alleging Dr Arsalan Iftikhar had sought favours from Malik Riaz, one of Pakistan’s biggest business magnates. Some reports suggested that the Arsalan Iftikhar had been trapped in the financial scandal in a conspiracy to malign the chief justice.

In one of the reports, a senior journalist had alleged that Malik Riaz had approached the Sunday Times’ Washington bureau chief Christina Lamb for a planned disclosure on the scandal while the chief justice was due to receive the international Jurists’ Award earlier this month.

Earlier today, Lamb tweeted from her account:

@christinalamb: “have no idea how this started but can i clarify i am not planning a big expose on Familygate, have spoken to no one abt it”.

In another tweet, Lamb rubished claims that she had been approached for to “break the news”, clarifying that she had neither any knowledge of nor had spoken to anyone about the whole affair.

@christinalamb: “any purported quotes from me on CJ issue are made up, all i know is what i’ve read in the media and have spoken to no one!”

The chief justice’s son has been rumored to have received between Rs 300 to Rs 400 million from Riaz to influence the court in proceedings against the former Bahria Town chairman.

On Saturday, Arsalan Iftikhar recorded his statement in the apex court, denying having any links with the business tycoon. Money, lies, video tapes and real estate. Facts, speculation and incomplete evidence. This drama has it all – actors, a stage, audience and a purpose. The same theatre, over the past couple of years, has seen a prime minister plus his minister and a dozen other nerve-wracking dramas. Stakes, this time around, are higher than the Himalayas – trillions of rupees, the longevity of a ruling coalition or the monopoly over terror of the deep state.

There are at least five facts. One: there are powerful, powerful interests out there dying to malign the Chief Justice of Pakistan. Two: a scripted drama revolving around two central characters – Arsalan Chaudhry and Malik Riaz – is being played out. Three: one of the central characters happens to be the son of the sitting chief justice of Pakistan. Four: there hasn’t been a single allegation – not one – against the person of the CJ. Five: there is no public money involved (at least no so far).

Next; a whole host of ‘messages expressing opinions based on incomplete evidence’ are echoing all around the theatre. There is speculation that those powerful, powerful interests are being successful in their evil designs – at least partially successful. There is speculation that the drama is being played out based on a pre-written script. There is speculation about who the real authors of the script are – civilian, uniformed or a joint venture (the Arsalan-Riaz engagement allegedly began in 2010 while the ‘missing persons case’ is only a year old).

The two things that are missing from this drama are dance and music. The real purpose of the script must have been to bring down the CJ on his knees making forces that are bent upon remaining above the law dance to the beat of their bank accounts. But there is neither dance nor music because real life stagecraft is a social science and in social sciences there exists the ‘theory of unintended consequences’.

Unintended consequences in this drama can be of two types. One: a windfall that wasn’t even expected by the script writer(s). Two: a “perverse effect contrary to what was originally intended” by the author(s). For example, the CJ becoming even more aggressive after this drama.

First sons have always been protected by our presidents and prime ministers. This is a first – history in the making. Shakespeare said, “It is a wise father that knows his own child.” An unwise father? Perhaps. An unwise judge? Not a hint of that – not so far.

There are three players on the stage – political parties, the judiciary and the GHQs. On a stage where political parties stand discredited, a tarnished judiciary will make the GHQs even more powerful – and that may or may not have been the intention of the script writer(s).

The king cobra of our real estate cobras has played his king. Is there someone who has an ace? Remember; the authors of the script are still holding back cards that they haven’t shown.

Who will eventually sing: “I fall and I rise, with the fire still in my eyes; My scars and my stripes, You know I will survive; The strength that I find when I dig down deep inside; Got me still in this fight, and I’ll be the last man standing.”
