ISLAMABAD: The Council of Islamic Ideology (CII) today declared a clause of the Muslim Family Law Ordinance 1961 as un-Islamic.

CII Chairman Maulana Mohammad Sheerani said it is not mandatory under Sharia to seek permission for the second marriage to first wife.

The CII unanimously declared the clause as un-Islamic.

The said clause makes it mandatory for a man to seek permission of his wife for a second marriage.

Maulana Sheerani said that a husband is bound to do justice to all his wives as per the Sharia. – SAMAA

lol...seeking permission from the first wife was ever a problem? men use 'other' means to get it...by hooks or by crooks, they have it!

sometimes, it's so subtle...by emotional blackmailing!!!

Long as they don’t mind wife 1 and their kids possibly hating them for the rest of their lives or wanting to divorce them..

Easy to just take another wife.. not so easy dealing with the consequences..

(I’ve never believed it’s mandatory in Islam for the husband to take his first wife’s permission but do know he has to announce he’s done it.. he’s not allowed to hide it or lie)

and, that's the reason why we have Walima...it's the announcement to the society that they have legally married and they are husband and wife.

^Yeah, but not everyone does walima, do they.. or they delay it a long time..

Think it's sunnah rather than fardh..

yap..i always knew..we don't need "permission" from our wife to marry again. However...just a reminder to myself and ppl here that.. although we are not suppose to take permission..but i think in this day and age hardly anyone does marry again. Unless ya're a rich shaikh or something. I know i can't afford to keep two wives for sure.

I think its a correct decision, if a man has not learned a lesson after first marriage then let him have it.

it really doesn't make much of a difference. if the first wife is not giving you the permission, you can threaten her with a divorce and she will agree.

What a pathetic group of people these "Council of Islamic Ideology" must be. They could not find any other "non islamic" thing in our constitution and society besides debating this issue. These people should grow a pair and issue a fatwa or two against barbaric killing of innocent and suicide bombers. But alas, their "pursuit of happiness" is all about getting 4 wives in the easiest way possible.

Ummm I think whether it was in the law or not men were still taking second wives without the wife's permission or community knowledge so what difference did this law even make? The qazi could still do the nikah and it would still be valid. It was a lame law to add in the first place... Especially since it wasn't a requirement (in shariah) and it was never going to be enforced. The article is useless.

The one thing that I was always proud about regarding Pakistan, that we actually uphold the rights and humanity of a first wife in polygamy, and give her the dignity to be PART of the decision to which she's being subjected to...

they decide to take away and leave me more and more disappointed in Pakistanis.

PS: On serious note, it would have been WONDERFUL that while giving this ruling they would also have ruled about the pre and post conditions for a man to marry 2nd (,3rd or 4th wife) and how Islam want equal rights and treatment (literally) for all wives which is next to impossible for man to do.
