I think there was selective prosecution of Rajaratnam and Gupta. In the case of Gupta they were going out of their way to get him. By that standard half the financial industry and Congress shouldbe behind bars.
Ironically the prosecutor was Indian origin - probably over enthusiastic to land a prized vconviction.
