my dilemma is that in 1981 my grandfather bought 83 kanal of land in our family home town where he was born . he bought that land from army officer who needed money for his daughters wedding. my grandfather worked in railway for 37 years and he bought that land with his retirement’s money.
after he bought the land someone told him that you have to have a permission from the head quarter of army in order to buy their land. in 1982 he applied that(N.O.C) and they gave him permission. But in 1985 he received a letter which stated that its a rule that an army office cant sell his land to a commoner therefore we are taking your land back .
now the guy who sold the land to my grandfather has passed away . we have applied our case in hight court , high commission and i don’t know where. but no hope.

my question is that why army headquarter at first place gave us permission to buy that land and then after 3 years canceled it .is that fair.?
if they want to punish , they should punish the officer who sold the land to us because he knew that its against the rules. my grandfather is 90 years old now and utterly sad because he says that money was my 37 years hard work.
any suggestions about what we should do?

go to the courts and stay there for a few decades. No, this would be quicker because our dear army is involved.

is it fair that an army officer was awarded 83 kanals of land where your grandfather who served the country equally well was not?

Aww that's so sad to hear! Inshallah it will all work out and your grandpa can have some sukoon! I really don't have any advice...other than make dua for the best outcome!

thats what we cant do ..........when my grandfather was young he got accepted in air force but the air force doctor said that give me 15 pounds of bribe and i ll pass you in the medical test (even though nothing was wrong with him) and my grandfather said i rather work as a clerk then giving any bribe .
and thats why this case has been dragged because we are not giving bribe.

these bribe takers when they get old they think growing a beard, going to masjid and reciting Qur'aan aloud after fajr will wipe their sins out...how wrong and mistaken they are. repenting is possible in islam but most people forget that the most important aspect of repenting is restitution. i haven't seen a single soul who reverses and compensates to the people he robbed except my uncle who was a dialogue and story writer in Bollywood and who had some Golden Jubilee movies under his hat repented and gave away all the proceeds that he received from those movies to the poor..thats the character.

The Point is, your grand father is not innocent, he went for the land which was not in market ( in terms of money and offer) and he might have been offered less price then the land which has no problem.

My Uncle and Father use to be in Land development business and this is an established fact that the more the strings/problems/NOCs attached to particular piece of land the lower the price is, so what happened to him is normally happens to anyone who tries to act smart and later get booked by even smarter person.

83 kanals is roughly 7 acres ( if i am not wrong) and if the land is in the subrubs of the city and that is on ferouzpur road on the Lahore side , then it is one expensive piece of land, if the land is for agriculture purposes and is irrigated through the canal, then again it is expensive piece.

Now your grand father have told you another story as well

1st of all no one ask this much low bribe, it is against their standards, specially if nothing was wrong with yoru Grand Pa... 2ndly he could have gone to the higher authorities rightaway and presented his case, the doctor might have faced court martial as the corruption on this level in army is well handled but i guess your grand pa simply decided to give up and join Railways which is BTW one of the most corrupt institution in Pakistan and requires a huge bribes to even get a job of Peon...

Anyway, ask your grand pa one more thing, is the land 83 of kanals, is registered to his name and has the transfer of the ownership has done or not?
Most importantly, in case of military land, the land can be purchased from the person to whom the land is allocated, who gets a land allocation paper... can your grand pa comeup with such paper, ( this paper is initially required to file a applicatin for NOC from GHQ) if you have got hold of those papers then you have a strong case

While he was working for railways, his life was not under threat was it???

Hope you are being sarcastic. It is not in good taste though. How can you make an Insinuation that the land was not in market and that he would have been offered less. True the army officer was in need of money to marry off his daughter and might have settled for less.

Being in the business i am just laying donw some facts, yes there are some piece of lands which is and/or not offered in open market place... such lands normally have different issues with them, the land developers normally like this kind of plots/land, as these lands are lot more cheaper ( owner want to get out of the trouble and would love to get cash) compare to other lands in the same area which are in the market for sale.

The land developers normally knew the right people and procedures to solve the issues.. now my observation is, if anyone is offering you something well below the market price then it is red flag by itself!!!! a thorough due deligence should be conducted on this, the best practice is hire a lawyer as they normally knew what documentation is required.. but some people in order to save money and conclude the deal ASAP and later look for the solution...

Yes it does work sometime, but doesn't matter it works or not, one should perform what he have to.. and in this particular case, the guy was not ready to pay 15 pounds to Medical officer, but joined Raliways, which is 100% corrupt institution in Pakistan.. certainly there is something not right in the whole story

By that measure, the Jawans in Army should get 166 kanals of land each.

And Army Jawans normally get some piece of land at the end of their service based on their performance, but this land is normally for agriculture purposes (as most of them are from villages) and is on the border areas...

having said that, Railways have huge land allocations as well, It is said in Lahore that half of the city is owned by Railways and other half by the Army.. and what is left is being traded and occupied by the Land Mafias ( mainly backed by politicians)

the best and only short term way to attack this sort of problem is to shine the light of truth on the crime and teh culprits. Get the press and some famous statesmen (eg Coswaji types) involved. Do your homework, prepare a complete file, make copies and send it out to all these people.

May be even video shoot these documents and put them up in youtube.

Don't blame anyone by name - this is important. Just refer to them by position or some generic title.

  1. i appreciate your comments but we are not belong to corrupted or greedy family. the land was on sale legally , my grandfather 's cousin bought the land who happened to be his best friend so he told him that after you retired you can buy land by my land and we will do some business on it .so when my grandfather got retired,he bought the land from army office who was given 205 kanal of land in our town in 1969. he was a legal owner and we payed him right amount of money to buy his 83 kanal.
  2. yes the registry is on my grandfathers name and yes we do have N.O.C from headquarters of army that we can buy this land . it was issued in 1982 from Rawalpindi . 3 . the thing is army has canceled that 83 kanal of land from the name of the officer we bought the land from. now they say that we are criminal and did something wrong and got that land somehow.so the N.O.C is cancel too. under the law of 1973 , protecting property rights of the petitioner , can not be taken away by a condition of sanction/No Objection Certificate which was granted by General Headquarters in this case. i mean honestly how low they can fall for a piece of land . and they close the case in hight court without us knowing it .we just got letter that we don't own this land now.

and to your first objection 15 pound was a big money in 1948 and 1949 .and no he didn't pay any bribe in railway, but they told him that you are very educated you should go to somewhere better place . he got first position in materic (year 10) in whole Punjab. and the reason he didn't complain about that doctor because he had four younger sister and he needed job to marry them off ,in other words he doesn't wanted to waste money on courts and to make enemy because he was the only son in family at that time.

and other thing is that in 1947 my grandfather was working part time at a clothes shop which was owned by a hindu ,so when he was migrating to India he said you can have this shop but my grandfather said no its for people who gona come from India they deser it not me. but the other worker took it and now he has bangla with imran khan 's house ,its famous as Kalma wali khoti.
i mean i f my grandfather was a criminal or greedy type of person he would have taken benefit from many situations but he didn't . he says my Imaan is my everything.
and i think the lest he deserve is his land back.

no i don't think so , his fellow men still come and tell how great time they had with my grandfather.

i think you haven't meet any "imaandaar " person yet .........their first priority is Allah not money , states or fame .
we know that its a test from Allah and we will get justice and we are not doing anything wrong.
and i cant tell you how much money we have spend on lawyers.
