- i appreciate your comments but we are not belong to corrupted or greedy family. the land was on sale legally , my grandfather 's cousin bought the land who happened to be his best friend so he told him that after you retired you can buy land by my land and we will do some business on it .so when my grandfather got retired,he bought the land from army office who was given 205 kanal of land in our town in 1969. he was a legal owner and we payed him right amount of money to buy his 83 kanal.
- yes the registry is on my grandfathers name and yes we do have N.O.C from headquarters of army that we can buy this land . it was issued in 1982 from Rawalpindi . 3 . the thing is army has canceled that 83 kanal of land from the name of the officer we bought the land from. now they say that we are criminal and did something wrong and got that land somehow.so the N.O.C is cancel too. under the law of 1973 , protecting property rights of the petitioner , can not be taken away by a condition of sanction/No Objection Certificate which was granted by General Headquarters in this case. i mean honestly how low they can fall for a piece of land . and they close the case in hight court without us knowing it .we just got letter that we don't own this land now.
Like i said, there is Land Registry, NOC ( in case of govt alloted land) and transfer no, which is normally called Inteqaal Number, this number is the ID, which details the transfer of the land from Party A to Party B, do you have this and if yes, is it original and can be verified by the local PaTwari.. if yes, then there is no way military or even Zardari ( with all his powers) can take the land back from you or anyone for that matter ( not legally ofcourse).. so make sure your grand Pa followed the right procedures then and did all the legal requirements...
Plus please try to get the land allocation paper, this paper is from the Military/State ( in your case) to the soldeir in return of his services for the country and as you have suggested the case, might be in return of his services in the war of 1965( i am talking about the military officer)
Now here are the things you do need to have to for a stronger case
1) Land Registry on your name ( inyour case grand pa's name) ( which you say you have got)
2) N.O.C issued by GHQ, see if the N.O.C have any strings attached, means if it is conditional or not
3) Letter of Land Allocation to the original owner ( this letter is issued from the Militaty/State to the Army officer, who have sold you the land ( actually it is prove of ownership, mean that the army officer is true owner of the land. This allocation letter also suggests the terms and conditions under which the land has been given to this person. Mainly it will state that if the Army officer can sell the land or piece of if or not...
4) once the land is purchased and is registered under your grand Pa's name, the next step is to transfer the land owner ship in the records, for which you get the Transfer number ( called intayqaal number)...
Once you have all these, get it verified from the your local distict court and you can do it by paying 1000 rs to any MUNSHI of any lawyer, and he will get you the right information, then goto the local paTwari and ask him the same, and do have your mobile camera ( or any other camera switched on) and record whatever he says ( it will be handy)...
with all these documents, go to high court can file a case of fraud against the person and the army...
BUT the key is you need have all above informaiton and if you don't have then it will be a problem for you.. there are cases and conditions to which GHQ issues NOC for limited time period...
