This is an editorial which talks about the sincerity of leadership on tackling terrorism. Growing number of people in Pakistan realise this threat of terrorism not only to their neighbours but to their own country too !!!

The release of Hafiz Saeed raises many questions about the sincerity and efficacy of the state in quashing jihadi networks that operate on its soil. It may have been a full bench of the Lahore High Court that ordered Saeed’s release, but the fact is the court was left with little option given the prosecution’s reliance on weak grounds for the extension of the preventive detention of Saeed while he possibly awaits trial on charges related to the Mumbai attacks last November.
At the heart of the issue here is really the question of whether Pakistan’s legal framework is adequate for dealing with men such as Saeed who are the ideological leaders and figureheads of groups which may be engaged in terrorist activities either abroad or on Pakistani soil. Do we have the laws that can put such people out of business while acknowledging the difficulty of tracing any particular crime to a group’s top leadership? It appears not. Clearly, this is a matter for parliament to debate and to draw up a set of a laws as Pakistan presses ahead in its counter-insurgency activities in the northwest and Fata.
The issue is bigger than just Hafiz Saeed and the Mumbai attacks — it extends to militant leaders like Maulana Fazlullah and Baitullah Mehsud, too. Imagine a scenario in which Fazlullah or Mehsud are captured by the state and are held for trial: is it beyond the realm of possibility that they too may be set free on technicalities because the laws of the land are inadequate to deal with such leaders?
Pakistan has tried in the past to put in place special anti-terrorism laws, but because they were too draconian or ran afoul of constitutional safeguards, the superior courts have largely defanged them. No doubt every care must be taken to protect civil liberties and the government must work within the framework of the constitution, but there is clearly a need to acknowledge that militant networks pose a unique threat and therefore sensible, careful and well-drafted legislation must be introduced to tackle the threat. Parliament can be aided in the task by legal experts, retired judges with the relevant experience, and international experts familiar with anti-terrorism laws and their practice around the world.
Finally, a word about India-Pakistan relations and the Mumbai attacks. India is unhappy that Saeed and some of the others arrested in the aftermath of the attacks have been released. At the very least, their release sends a bad sign that the government here is perhaps not up to the task of prosecuting them even if evidence is adduced. The Pakistan government must urgently explain what it plans to do next, or else risk losing another opportunity for peace now that the elections have concluded in India.

^ Luckily Pak government has decided to appeal the release of Saeed. Looks like not everyone in the establishment is willing to cut their nose to spite their face :p

A tough ask for Pakistani Govt. and good luck for them. But where the hell are these concerns and sincerity issues when Zardari were put into the office, and a bunch of other corrupt and murderers in the parliament? None of the media have raised the issue of putting a well known corrupt in to presidency, a 5yr old child knows about their crimes and a so called sincerity to their country.

rest assured he would be released again, you cant put him/his kinds in jail for long with third rated proofs and with this judiciary just because state wants it , it doesnt happen here anymore.

we may have to do something like US did for alcapone, put them behind bars on other offences they might have done and i am sure there would be many minor offences the had done, go through their accounts, business/establishments records etc.

actually problem is not with the laws but system both countries run on rotten system and police still learning scientific ways of collection and correlating the evidence, untill we learn to do that properly these monsters would be out.

it happens every day in courts these killers, theives getting out because there was no witness or evidence even people affected dont come to courts to be witness for the fear to their lives...

because state couldnt prove it and finally thanks to musharraf's NRO they are free now, thanks GOD NRO is still pending in court and im sure it would be reversed untill then bear with the zardari...

You can be as smug as you like, but the issue was never one of trying to spite India. It was a legal issue from the very begining. You cant hold people in prison if there is no evidence to convict them. This should be seen as another milestone for the Pak Judiciary. Despite govt pressure, the courts made the right decsion according to the law.

Regardless, persoanlly I do want to spite India, and so I can almost guarantee you that this guy will remain free.

^^ So you want us to spite India by taking "punga" with the whole world and the UN Security Council. Remember that groups like LT/JD are banned by UNSC under their chapter 7, which is enforceable by force.

Hafiz Saeed is seen by the world as a terrorist leader and the UNSC including China have voted him on the terror list.

So if not today, then some day we are exposing ourselves to sanctions. No one is going to buy the claim that there is no proof because our agencies should know exactly what this guy is up to. By not prosecuting him, we are encouraging the view that somehow our agencies are still in bed with these guys.

All this to "spite" India? Makes no sense to me.

These Indians are incapable of providing any kind of proof from last six months and now they are blaming Pakistani govt for the release, there pathetic leadership is only good enough to fool these indians, can any of these indains dares to ask its govt that why they are showing such non-seriousness in the mumbai case investigation.. Pakistan asked for the proof and after 6 months all they come up with was in marathi and hindi.. didn;t anyone told them that these languages are not spoken in Pakistan... this is all they can do... this really shows how much they really want to reach the master-mind of these attacks..

but indians will never understand this, their leader exactly knows how to fool them.. and they are doing it... some time in the name of riots against minorities, some time against the low caste and some blaming neighbours for their short-comings...

To begin with you are not aware of why he was arrested … please find out the reasons why he was arrested and on what charges he was held before pointing fingers … As the Attorney General of Pakistan says (am sure you dont know more then him in this case) …

“Since Hafiz Saeed had links with Lashkar-e-Taiba, we believe it’s better his activities should be restricted and that’s why we’re going to file the appeal,” Khosa said. Talking to reporters at the Supreme Court, he said there was no need of asking India for evidence on Hafiz Saeed.

If Pakistan was really serious about fighting terror, they would not need India to provide proof. With the Jihad factory running full scale in your country, your security agencies are truly incompetent if they cannot get the proof themselves from within your country.

But then again, the “war on terror” is just an excuse for Pak to run to the US and other countris and ask for some “khairaat” :hoonh:

If Pakistan wasn't serious, it would not have lost 100's of its law enforcement agents. So quit harping on silly things.

Unfortunately Hafiz Saeed, just like India's Modi are all sacred cows. Even when the government and the judicial system wants to lock them up, the masses keep on supporting and electing them.

Being an Indian hopefully you understand the comprehensive meanings of "sacred cow".

Being a sacred cow is not a justification for the release of Mullahs. It is unfortunately a reality.

A relative of mine a Pak army officer explained that to me by asking a simple question "If a balding man with chekered beard and prayer roomal on his shoulder, walks up to you. Then what is your first impression of this guy? A pious mosque going "uncle". Then off course the uncle turns out to be a terrorists but it is too late.

For you Indian fellas, conservative Hindu terrorists evoke the same emotions of being pious temple going lads. However if and when they turn out to be a danger to the society, you won't be able to defend against them. Instead you will elect them over and over.

Thus the term "sacred cow".

One day I hope Pakistanis will shed their in-built respect for their Brahmins or Mullahs. That day if it ever comes, Islamists terror will die out.

^ Pakistan has lost 100s of its law enforcement agents trying protect its own backyard from terrorists that were homegrown. Its done absoultely nothing when it comes to fighting global terror emanating from within its borders.

Quit harping on that "we are victims of terror too" tune, and get serious about fighting terror, otherwise very soon Pakistan's own existence will be held hostage by these terrorists.

Rehman mailk has gone on record about the involvement of Paksitani's in attack on Mumbai ..... has he or anyone in Pakistani government named anyone in India who has been involved in terror activites in Pakistan ??????

FYI. Most of the Qaida members in Gitmo were caught by Pak law enforcement agents.

Oh well some emotional hazrat are not used to reading the history that doesn't fit in their narrow hateful agenda.

FYI - most AQ members (including Khalid Sheikh Mohammed) were caught in Pak by Pak agents in a joint operation with American agents. It was Americans driving the mission.

Compare that to the number of international terrorists who have **disappeared **within Pakistan. Obviously, Uncle Sam cannot be watching the Pakistani law enforcement agents all the time ;) nor paying them off :p

FYI … Pakistan was paid “millions” of dollars for handing over “innocent” people along with some terrorists … history for you !!!

You know so little its hilarious.
The people Pakistan is fighting ARE part and parcel of international terrorism. We certainly are fighting to protect not only ourselves, but our allies, which include America. In fact, Pakistan is doing far more to resolve this issue then all other involved parties, despite the fact that these people are there creation.

India ofcourse no one give rats rear end about. Notice how no one remembers Mumbai or the attack on the Indian parliament, and yet 911, and other attacks in the West we all remember.

That is why you will never be "in charge" ... people in general in Pakistan don't spite Bhindi eating Indians .....

The Americans can do nothing in Pakistan without the support of PAKISTANI security establishment.
