Unmarried guys

As you all know, there is a provision that can be added to the nikkah-nama that gives women the legal right to divorce (without filing for khulla). How would you feel if your wife to be asked you for this? Do you think it is inappropriate to bestow this power on your wife? Considering the inevitable social suicide a woman would face if she asked for it, is it even worth it? Surely she should know the kind of man she’s marrying and mulling divorce before the marriage is just a bit strange.

any marriage that's based on legality issues is not gonna last long. marriage must be solemnized with the firm conviction to make it to last for ever and the inclusions of such clauses negate that conviction.

women should have that right....

instead of asking for khula women will be able divorce her husband.....

husband and wife can have issue when it will be impossible to live under same roof.....

in islam marriage is a contract marriage so why not this clause to empower women

The nikkah-nama is a legal binding contract. If you look at it closely it doesn't have anything "religious" in it. Furthermore, it is a woman's right to ask for that clause, whether you like it or not. It's fully legal. Asking for such a clause isn't starting the marriage without trust, instead it is just something that protects her, along with the other points (eg haq mehr) which are obligatory. If a bride to be asks for such a thing it doesn't mean that it's necessary that she will in the future act on that.

Well..we write our nikkahnama according to islamic sharia eh. So according to sharia she has a right to file for khula etc. But legal divorce?..not sure about that. I mean legal divorce happens when two parties agree to let each other go eh. So why give that right to wife only?..give it to both of them.

i always thought kkf used the green color for islam not for pakistan since i figured kkf was indian all this time :konfused: and so was ninja, I might be totally wrong on this one

and why does a man consider a woman to commit social suicide if she were to give herself the right to divorce rather than the khulla that all muslim women are granted, just in case things dont work out?

You never know someone until you live with them.

The Nikah Namah as is has some very unclear language and to be quite honest...its not in a woman's favor. In court, unless its explicit and the attorney you have is someone who can put up a real fight...its useless for the woman. And let's face it...how much weight do you think your local Imam has in these situations?

Mine would be detailed but simple.

One more thing...when you're in a bad marriage...it doesn't matter if its Khula or Talaq.

you were right…i’m an Indian and i use green color font because i like it PLUS it’s ‘considered’ Islamic color as well. :slight_smile:

There is no such thing as an Islamic color =) just like there is no symbol for Islam (crescent and moon don't count)

I dont know about other countries but in Pakistan,even if she doesnt have the right for khula, she is granted one if she demands through court within 90 days, no matter the husband is willing or not.

( please refer to Dissolution of Muslim Marriages Act, 1939 )

if marriage gets f'ed up.........it doesn't really matter whether its divorce by man, by woman, khula or court order or whatever........
