undocumented Pakistani family

we talked about this case a while back and it is coming back up. since I was sent this email unsolicited I thought I would share it here, so people who want to do what the organization is asking can do that, and for those who think the organization needs to focus on rights of ppl here legally, they can send ms meherdad their thoughts.

For years, ICIRR has supported the case of the Mujahid family, an undocumented Pakistani family living in Chicago (please see the attached picture). We thank SAPAC for your past support of this family, and we ask for it again this Tuesday, October 9, at 10:30 AM, at the immigration court downtown: 55 E. Monroe, 19th floor. We hope that SAPAC members will come to support the family during their immigration hearing. Ask for the courtroom of Judge Jennie L. Giambastiani.

You have likely read about this family’s story a few years ago, either on the front page of the Chicago Tribune, Chicago Reader or Chicago Sun-Times. The Mujahids were caught up in the federal government’s disastrous Special Registration program, and simply wanted to stay here to give quality medical attention to their daughter Tooba, who suffered from cerebral palsy. After quick organizing from the South Asian community, the federal government allowed the family to stay. However, last year Tooba passed away and the family is left with little recourse. This family has been through so much and showed guts, love and determination by speaking out. Separating the father from his wife, his daughter and infant son (a US-born citizen) and the resting place of Tooba would be immoral, especially for a family that has been through so much.

My thoughts...

I feel bad for teh familym, very bad, loss of a child is a tough thing. and the struggle that they faced must have been heart wrenching.

but, they came to this country to get her treatment, she is no more. If she was getting treatment and they were being forced out, i would be in the front of that line screaming for allowing them to stay in US for her treatment.

but she is no more. the reason they came to US does not exist anymore.

they are not undocumented, its not like they forgot to get some documents, or lost some documents, or arrived in a way that there is no offical documentation of their arrival. They came here as documented temporary visitors. those documents have expired, their stay is now illegal...against the law, against the rules thatthey agreed to when they came here.

My issue with these things is that groups are picking up high profile cases and appealing that certain people be excluded from laws. it only hurts when they have to deal with cases where real immigrants and refugees are having their given rights violated.

the reasons given dont make sense.

1) they have been through so much

I agree, I feel for the family. They have seen a very tough challenge

2) their daughter is buried here

they had a choice to ahve her buried in the country they are residents of, i.e. pakistan. the community would have helped transport the body. but they wanted teh burial here, they made the choice. Why does that mean they get their illegal stay become legal?

3) their son is born here and is a US citizen

so take him with you, I mean he had US citizenship because he was born here while the family was here on a 'temporary' stay for the treatment of his sister. He has a right to stay in US, his parents do not.
btw US needs to follow the Uk example and only kids born to parents who are legal residents should be getting citizenship.

whats the Uk law now, only citizens kids get citizenship?
what teh one must be a birth citizen.
dpes bthat mean if lets say two ppl who are citizen but not by birth, they have a kid then their kid wont be a citizen?
explain, i dont follow Uk citizenship laws much.

British Citizenship can be acquired in the following ways:

lex soli which is By birth in the United Kingdom to a parent who is a British citizen at the time of the birth, or to a parent who is settled in the United Kingdom

lex sanguinis is By descent if one of the parents is a British citizen otherwise than by descent (for example by birth, adoption, registration or naturalisation in the United Kingdom). Thus, for example some one born in in France to British parents is entitled for British citizenship.

i just get annoyed when ppl use teh argument of oh but the kid is a US citizen and u should nto seperate the family.

teh govt is in no way shape or form forcing teh kid to stay here and the parents to leave. they are asking the parents who are illegal to leave. teh child can stay in US if the parents want to leave him in someone's care, or they can take their kid with them, and he can come to US anytime and stay as long as he wants or just live here.

Under the law in effect from 1 January 1983, a child born in the UK to a parent who is a British citizen or 'settled' in the UK is automatically a British citizen by birth

only one parent needs to meet this requirement, either the father or the mother.

"settled" status usually means the parent is resident in the United Kingdom and holds Indefinite Leave to Remain (ILR) or Right of Abode. Irish citizens are automatically deemed to hold ILR.

They can indeed bahi , for example British actress Emma Watson, she was born in France to British parents but has British citizenship.

Let see what Irish laws says about it :

If I m not mistaken there are no specific laws about the rights of residence of foreign parents of an Irish-born child. The non-national parents of such a child do not have a legal right to Irish citizenship. In such cases Non-EU parents of a child born in the Republic of Ireland or Northern Ireland must have to apply to the Minister for Justice if they wish to get residence in Ireland . Its totally in hands of minister, where is obliged to consider the principles in the Fajujonu judgement in making his decision. ( reference Supreme Court in the Fajujonu case 1990, incase if ya wana look up) If permission is granted then the parents must register with the Garda Siochana (police).

The law further says , the minister can review his decision if the applicant is not living with the child as part of a family unit and ceases to play a significant role in the upbringing of the child. So apnay Pakistan bahi shadiyan karkay bhaag nahe saktay :p

Then that common EU law kay , the minister might also review the permission to remain if he decides that the common good and the protection of the State and society justify interference with the parent's Constitutional family rights.

Lets call them what they really are - a bunch of self absorbed good for nothing illegals using the emotional tug of children to mask their disregard of American law.

Yes their daughter died. Boohoo. But celebrate the occasion by having a kid as per mr.paralegal's advice? Wrong! It does not matter if they conceived their son in a hospital with an American flag dangling outside. His crooked parents just aint Americans.

Seize whatever possessions these oppurtunists have and put them on a raft back to Pakistan. Their us-citizen-baby-boy can stay in America and sponsor them legally.

I am an orthodox Muslim who is currently living on welfare...Apart from that I am provided food stamps, a three bedroom apartment by the state and free education for my 7 children as well as everything that Allah has provided me with...

Why are you so judgemental about a poor man whose daughter died...Do you know the heart break of losing a child?

I hope the government has as much regard for this man as it had for me and may Allah replace his loss with 10 more like the one he lost and may they all grow up to be good, orthodox Muslims...

And he shouldn't worry about food and necessities...Look at me...I haven't worked in 3 years and Allah has given me everything...

Please brother hskhan, don;t be jealous and judgemental...

hyper, but you are living in some legal status, the gentleman in the question does not have a legal status.

Its not a matter of faith bro. Its a question of law.

These people are acting like their rights are being violated, the group in questiion is supposed to be working for immigrant and refugee rights, these people are niether immigrants or refugees, they are people living in the country illegally after overstaying their visa.

When their daughter was undergoing treatment and they were asked to leave, many of us in teh chicago community wrote to congressmen, appealed to different agencies etc etc. It was the right thing to do, it was the humane thing to do, and the govt listened and allowed them to stay for the duration of her treatment.

Now they are abusing the system, and you know who it screws over, others who need to being their loved ones for treatment in US.

The discussion should not be about whether they can stay or go. There was a report on FOX about a sailor who is deployed in Middle East and his wife is here in the U.S illegally. They are planning to deport her and his son.

We should be focused on comprehensive immigration reform rather who can stay and go. There are at least 12 million illegals in the country, the max is 35 million. By not focusing on improving the law, America is encouraging another class of low income, poor, illiterate and neglected generation.
