Actually, Indefinite Leave to Remain (application made after minimum 2 years actually living in the UK) is in the Pakistani Passport. Some people leave it as this so you keep your Pak passport but can come and go freely.
If you want a British passport, you need to wait another year (so total minimum 3 years in UK) then you can apply for it.
Obviously, you do need to apply for ILR at the end of the 2 yr spouse visa to continue to stay here. And yes, for this you need to pass the life in the UK test.

Does it make a difference if your identity card & your passport are still by your father's name and not husband's name? Does it leave a negative effect on your application?

Hey All
Hubby submitted his app on the 23rd Dec 11 and we are still waiting..
Because I knew it would take a month atleast.. I went to see Hubby and now he won't want to come to the UK until late Feb..Can anyone confirm that inhALLAH when the Visa is given, how long do we have until he has to enter the UK..
He is studying and won't be free properly til July 12 so he will probably come for 10 days and then come back.. Are there any issues

They say 28 days to validate the visa. I know there are cases where people don't travel and it's validated when they finally do.. but it may be risky. When he gets it, he needs to ask if it can be delayed.
But if he is coming within those 28 days, it will be validated. If he doesn't spend 24 continuous months in the UK (with no more than 3 months abroad) he will need to apply for FLR at the end of his spouse visa. It's the same issue we had- hubby came for a month after he was granted it (so that's when his spouse visa started) but went back as he was still finishing his degree. His spouse visa ran out before he had been here for enough time, so we had to apply for FLR (to complete the time) instead of ILR.

Ah, I am doing a search to check. It is a bit different.
I just came across this:
"Indeed so ...... and replaced by a 3 months 28 day window! Arrive any later than that after the start date printed on the visa and the visa holder will encounter problems getting ILR at the end of their visa."
So basically I think he can come any time but they recommend you travel soon because the start date will be the date already in the visa. So as not to waste the time you have been given and then have to apply for FLR instead of ILR. But since he's not going to be staying anyway, it does not make a difference.
So it shouldn't be a problem if he comes a bit later. But it may have been better to wait to apply for the spouse visa until he was actually ready to come here and stay.

I understand that but I was a bit concerned of the new rules coming into place of having to be here for 5 years before ILR can be applied for so I thought rather than take the risk with new laws coming into place is apply asap..
