U.S Visa

Re: U.S Visa

just an FYI. I had applied for K-1 for my then fiancé but it was denied since its a requirement for you to meet your fiancé in person within 2 years of your application and provide them with proof. I had to apply for I-130 for my wife and she was in US 9 months after. There have been some changes on the way interviews are scheduled these days which are usually out of NVC (National Visa Center) where I-130 is processed after it has been approved by USCIS.

Re: U.S Visa

^Can I ask you a naughty (or even a weird)question?

If a person comes in contact with a man or a lady -US CITIZEN (that and he or she) agrees to sign the marriage documents for money or for any other reward , can a Visa be gained? What will be the scrutiny mode from the authorities ,in that case? How long it can take for the Visa in such a cse?

Sorry for the above question..But just want to know… :k:

Re: U.S Visa

The whole reason behind all the processing that USCIS and NVC and embassy does it to make sure your relationship with the US citizen is legitimate and not for the purpose to immigrate to the US. That is why a couple who have been married for less than 2 years only gets a conditional green card valid for 2 years. The beneficiary will have to apply again before the green card expires to proof their bonafide relationship to USCIS before they can get a 10 year green card. Hope this helps.....Believe me...its not even worth it to try to fool the govt for immigration purposes cause the punishment of the offence is not a small one....I think its lifetime ban from visiting US....

Re: U.S Visa

^Ohhh I was just asking this questionJust to satisfy my query mind.I will not try that option.

And that was a strong one:-

(Believe me…its not even worth it to try to fool the govt for immigration purposes cause the punishment of the offence is not a small one).

**US **:salute:

it was almost unbelievable for everyone when a guy who had a small general store at the corner of my street in Karachi won the lottery in 2000/2001. Whole street was celebrating as if whole street will get sponsorship papers. :)

He and his family (wife and kids) moved to US 3 months later

lucky eh?

wow thats great …thats called LUCK …well i just came to know im eligible for the lottery too …so this time im gona try my luck too

Yes truely...... :)

In case of the so called Lottery, what are the aspects taken in to consideration?

As you said above ,his financial background did not matter?

How? How di you check it Bhai?

Personally I have never filled a US lottery form so I am not sure but financial background was definitely not the deciding factor. As far as I know such schemes exists to diversify the population.

Re: U.S Visa

^Ohhh o.k :)

Re: U.S Visa

I know couple of people who came to US after winning the DV Lottery. I think now a days they have restrictions on certain countries, the people of which cannot apply for DV like india and pakistan.

I myself came on H1 and it was a straight forward process. I had sent all my documents to the hiring company they filed the H1 petition which was approved then I had to go for an interview in Islamabad embassy where they just asked me one question and I got my visa stamped. And in 15 days I was in US. The whole process took around 5 months but that was like 4 years ago.
Now a days getting an H1-B is a little tougher, you can go to trackitt.com to hv a better understanding

Re: U.S Visa

^Ohhh DV is not available for Indians and Pakistanis?

Re: U.S Visa

From travel.state.gov
For DV-2011, natives of the following countries are *not **eligible to apply because the countries sent a total of more than 50,000 immigrants to the United States in the previous five years: **BRAZIL, CANADA, CHINA (mainland-born), COLOMBIA, DOMINICAN REPUBLIC, ECUADOR, EL SALVADOR, GUATEMALA, HAITI, INDIA, JAMAICA, MEXICO, PAKISTAN, PERU, PHILIPPINES, POLAND, SOUTH KOREA, UNITED KINGDOM (except Northern Ireland) and its dependent territories, and VIETNAM *

Re: U.S Visa

US 1415:

I have been told by all the lawyers I have spoken with that the visa for a fiance takes less time to get them here, but then you have to apply for a change of status of your visa. Next I have been told that the husband visa makes them ok to be in the US for 2 years automatically once they get to the US.

The timeline I am talking about for fiance visa ...... 5-10months

The timeline I am talking about for husband Visa......... 6-11 months

Currently I was told that for the marriage visa (husband or wife), it is taking Pakistan about 8 months to clear the individual. Also, the approval for the Visa is only about 2 months in the US but it is the interview appointment that takes so long. So, is this incorrect information?

I may havbe gotten the name of the Visa wrong, and yes I am aware of the I-130 form that gets filled out. THank you, but please respond and tell me where you get your information from. THank again!

Re: U.S Visa

Ahhh...I spoke too soon, I see you got your information from your own experience with your wife. But, please answer the other questions I have about if you think my information that is suppose to be current info is wrong or right. Lawyers are hard to read you know?

That is true about the time that it takes for the visa to process. I was pointing out that you cannot apply a fiancé visa for your husband once you have had your Nikah since according to Islam you are now married, rukhsati or not. I m not sure which one is the husband visa. I think you might be talking about CR-1 for which an I-130 form gets filled with USCIS. I have looked online and from the USCIS Texas Service Center its taking them 5 months just to process the I-130 which will then move on to NVC (National Visa Center) and you will get some more documents to fill out and some fees to pay. The forms or fees that you get from NVC determines which document will sent to you next. For example one the case has been moved to NVC you will get for DS-3032 which basically tells NVC where to communicate with you. Meaning would it be a US address or a Pakistani address. After that you will get the fee voucher for I-864 (Affidavit of support). Once you send the DS-3032 back you will get the fee voucher for DS-230. Sending back the payment for I-864 will get you the I-864 form. Sending the payment for DS-230 will get you the DS-230 form. After sending both I-864 and DS-230 your case will be reviewed, completed and then you will get the interview date from NVC. (this processes has changed recently where after completion of the case at NVC it would send it to Islamabad embassy and they will send you packet 3.5 for the documents before they send you a packet 4 for the interview date). That is just the time that the application will spend in US. Then its moved to Islamabad embassy for interviewing.

My information comes from applying the fiancé visa for my wife (she was my fiancé when I applied for her) and applying for I-130 and the whole immigration process....

You will be paying them about 2000+. Why would they tell you the real process? :-)

I didnt had to hire a lawyer and was able to do the whole process by myself and with the help of online message boards. Send me a PM and I will send your the name of the site that I worked with.

Re: U.S Visa

my hubby is usa citizen he applyed fiance visa , but it stook 1 and half year ,i cam here and we got married , than applyed for green card, they send me green card only for 2 years after 2 years i applyed again for 10 years green card, too much work i think, better to apply spouse visa. its faster than finace theses days

Re: U.S Visa

Do they look at your fiance's financial status too? like what if the fiance in US is not making good money or jobless for example? Can he still apply for his fiance or wife?

Re: U.S Visa

^As fas as my knowledge is considered, they will just look in to the sponsor's (U.S National) financial backgrounds.
