U.S Visa

Many of my relatives and cousins are in the U.S and they show off their G.C/P.R Card or their Multiple Entry Visa on their Passport often with great pride and utmost satisfaction :smiley:

I still have not applied for a Visa ,very due to th reason that I do not want to get in there depending my relatives.I have a couple of close friends there who are ready to assist me.What are the pre-requisites for applying a U.S Visa ,in such a case?I think employment is not an issue.Also I have got a very good experience in my field.

  There is one more thing that keeps me away from applying.I have heard that a rejection of Visa means a second try will be almost impossible.

I assume you are talking about H1B

for that a qualified employer would have lodge an application for you at USCIS when they start accepting every year, i believe there are still places available for this year you can check at their site. its a lottery system so depends on your luck whether your number comes up or not, i don't think there is any limit on number of tries.

Basically your employer would have to show that you are highly qualified (Masters/PHD/experience) and they cannot find an equivalent person to fill the place in USA. By right they should have a job lined up for you to join when you arrive.

Usually there are loop holes through this depends on how experienced your friends are in doing this sort of thing

I have been working on my fiance's (soon to be husband's) K-1 visa for about a year now. Preparing all the finformation so that we do not get a rejection, or a delay. Doone all kinds of checking and reading and talking with lawyers.......WHEW!!!! It has been a lot of info believe me! But, the type you are talking about, there are two ways I believe to go about that kind of visa.
1) you have to be a qualified professional that is in need in the US. (born an raised in the US, I would think this is like a professor, instructor, scientist, medical doctor, research analysis, electrical engineer, basically an engineer of any field, I.T., and all of it's components are in great need! (that means anything to do with computers and their programming), you get the idea right?) SO, and profession where you have gone to college and possess a degree to make you a specialist in the field.

2) Second you have to have a business who wants to hire you. If you kind find that you are in and fine. They will do all the work for you. (the company who wants to hire you)

3) Then there is the lottery. Anyone can apply for the lottery visa. No limit on the number of lotteries you enter. Those are chosen at random.

The US will check all verification and double check them! So, be sure you have all your information together.

Can I ask why you would not want someone to just sponsor you to come here? THere is no disgrace in this. Family visa's are a lot easy to understand and find someone to assist you in. Why not go that route? Unless you are a highly qualified individual like I said.......any other questions I am happy to answer since I wandered around blindly with NO ONE to help for a year! I know how it feels to have questions and have no one to ask about visa's!!!!! LOL.........hope this helps!

Well thats what you (or your employer) pay lawyer for. Lawyers draft the requirements so tailor made that only thing remaining is to have your name on the requirements. So unless someone is making false claims (about degree, experience etc), it goes through without any problem.

I have been through H1 hell many times in late 90s and early 2000s !

Arleitter, just visit www.immigrationportal.com and get latest info on this forum....tons of info is there updated by members daily....like Adjustment of Status (AOS), B1/B2 Visa, H1B, etc.

I am haypy to answer your questions. I know when I began trying to get my fiances visa there was no one to help and no one was there to answer any of my questions. This can make for a very scarey experience where you don't know who to believe or which lawyer is just taking your money and won't do a thing in reality.

The business aspects of this sound like you already know someone who wants to hire you. The only problem with that is that in orer to be able to qualify for a visa like that, you have to be going for a job that they can not ghire a person locally for. And, from what you said it sounds like your friend, (cousin?) sorry i dont remember who you said had the company, it sounds like the postition you would be hired for is a position they can hire anyone in the area for. So, that isn't really going to help you.

I know our own pride can get in the way sometimes of our goals in life, but if this is something you really believe in then there is nothing I can tell you that will help you.

If you do want to change your mind and think about lowering that ego and pride.....(sorry)....then I would suggest you get the help of your family. It is not like you will be getting this help from strangers...they are family and should want to help you.

And, God sometimes brings us to a point in our lives where we need the people we are fighting with because it is our time to make up and get along again! (just a thought )

I wish you the best in your search for a visa and in making these decisions about how to go about getting this visa. If I were to give you one word of advice better than any other, I would say to trun to Allah, before anyone else.........then an only then can a person be absolutely sure that the things they are doing are right in HIS eyes. He has been first in my search through this whole process......and so far He has never let me down...:) Which I am sure if anyone does, it would be me letting HIM down.....not the other way around.

EB2 visa is really fast but your friends have to show that you r gonna manage quite a few ppl and the company's tax should also be a gud amount.

Ok now, I got a few private messages from people asking some questions about my post so I said I would come back to the forum and post what I know now.....So here goes...

First, our engagement took place with me in the US yes......but our wedding...Insha'Allah... is this October in Pakistan.

Next, no it did not take one year to process his visa. It only took 1 year for me to find out all the information I wanted to know. I knew nothing about visa's! I did not want to go out and hire a lawyer for this right away because if I do not know what is suppose to happen then how can I know whether the lawyer is doing his job or not? If I do not understand the whole process then I can only go by what the lawyer tells me is suppose to happen and I will not know whether I have hired a good lawyer or not. SO, I took a long time but I finally learned as much as I could about visa's and their processes.

So, now we are getting married in OCtober, and then after our wedding we will send the marriage licesnse, along with all the other paper work that we have gottten together, to the lawyer and they will apply for us. This should only take about 2 months to get your approval back from the US. However, next you have to get a physical exam, (and make sure it is from the correct doctors approved by the Embassy) and then the longest wait is for getting in for your interview with the EMbassy in Pakistan. Because the nearest US ENbassy in Pakistan to us is the one in Pashawar, and they do not do interviews in Pashawar, he will have to travel to the EMbassy in Islamabad for his interview. (and yes I found out about the interview during my research and learning as well!) So, when you finally get the date for your interview it has been about 4 to 8 months from the time you got your original approval. The shortest time I have heard of all this happening is 5 months from the very beginning application to arriving in the US. But it can take up to 10 months. They (the lawyers) say that for Pakistan the average time is around 8 months, so there you have it! You are finished when you are done with the interview. Some places, (countries)give you your visa right after they are done talking to you in your interview, if you pass the interview, and other countries mail it to you and it can take up to 2 weeks to get it. But, I have not found anyone who can tell me yet which way they do it in Islamabad.

I hope this helps any questions anyone was asking. Sorry I gave you the impression tha it took 1 year so far just to process the visa......

Yes I have a US citizenship. I do not know if the time is less because of that or not??? Good question.....that's something I never would have asked about since I have it......but for you the answer would be interesting. Let me know if you find out. THanks!

You know that is a good question too! I often wonder about lotteris an winning things! WHen was the last time you heard of someone who won something like a visa? I'm sure it's real, just because of how the laws are here in the US, but I don't know about anything other than that it is real and no I have never heard of who has won it.

I do know that statistically, the last year there was about 15,000 Pakistani people who received their visas to the US alone, but I would imagine that includes all the different types of Visa's combined.

As a side note, I am learning URdu and Pashto right now an originally came on this site looking for somewhere to practice my Pashto...Does anyone know of a thread here that would be best for that? THank you!

Nope....that doesn't matter much....seems like you will be applying for your fiancé after the marriage which will be a I-130 application. K-1 is only for fiancé before you get married. You should be able to apply for K-3 after you apply for I-130. You might want to re-check the time lines....it usually takes 9 months to a year before the beneficiary can make it into the US. For Pakistani men it usually takes longer because they have to go though an Admin review which is basically a background check that happens thru FBI.
