toyota main dealer lied to us. Can we sue?

We bought a car from a main dealer from Toyota. It’s not brand new but is from.the ex demo so the Main owner is the dealer no one else. They never told us that the car had previously been involved in an accident. Should they have disclosed this.

Re: toyota main dealer lied to us. xan we sue

Did your ask before buying? If dealer said no, and you later found out, then I guess you have a case against the dealer

Re: toyota main dealer lied to us. xan we sue

No didn't ask. But isn't this false representation anyway. Shouldn't this be disclosed.

Re: toyota main dealer lied to us. xan we sue

in UK, at least in this county, holding info, that could otherwise be helping the consumer making a different decision, is illegal. So yes you may have a case. CHeck this document, section 4 pg 8 “Giving insufficient information to consumers”

Re: toyota main dealer lied to us. xan we sue

I thought you had a law degree?

Re: toyota main dealer lied to us. xan we sue

^ OMG!!! This!!!

Nadz, every time you ask for legal advice on this forum (which is a Pakistani cultural forum and not one specializing in legal matters), mera dil chahta hai ke tumhare law degree ko aag lagadooN!!! And yes, I hunted up your old thread where you told us you have a MASTERS in law (LLM).

Re: toyota main dealer lied to us. xan we sue

What’s more shocking…that Nadz has a LLM OR she bought a used car without bothering to directly ask if it has ever been in an accident? :hmmm:

Re: toyota main dealer lied to us. xan we sue

Were you given too good of a deal?

Re: toyota main dealer lied to us. xan we sue

why is there always something happening to u?

Re: toyota main dealer lied to us. xan we sue

Just because she has a degree in law does not mean that she is an expert in consumer law.

toyota main dealer lied to us. xan we sue

Was this from toyota directly? Or a local garage selling. We just recently bought a demo car from main dealer and my hubby did a HPI check on it which shows any accidents etc finance... However we got that confirmed at the dealers also. I would be going back and telling them. If the car wasnt registered as a cat c/d then it makes no difference really if it had an accident?

Re: toyota main dealer lied to us. xan we sue

You’re right…it doesn’t. And we shouldn’t be so harsh…but doesn’t it go that anyone who has a Masters level degree in pretty much anything would have the skill set required to reason and use logic to figure out where to find such information?

And just as I hit “SAVE” on that message I realized how many ill-equipped Masters and PhD level people I know… :smack:

Re: toyota main dealer lied to us. xan we sue

Hey hey hey no making fun of Dr. Ben Carson !

Re: toyota main dealer lied to us. xan we sue

Fair enough, except if you were able to google and find some information on a non-Gupshup website, why couldn’t she? Having legal training doesn’t make a person an expert in all things legal (I’m proof of that!!!), but it should enable a person to know HOW to find the responses from the correct resources. Coming to GS on this question is what I can’t understand.

A degree doesn’t make a person all-knowing about everything, but a degree in a certain specialty should give a person the skillset for how to find a response in their own area of expertise. Why not go to a consumer rights forum for such an answer?

I bought Technology stocks in 1999 to 2000 and fianciall stocks in 2007. I also thought Krishna Swamy should have been given the openers slot.

Re: toyota main dealer lied to us. xan we sue

Nadz, It was your fault. You should ask dealer before finalizing deal. You might probably get discount if you order accident history report.
What was your logic of buying second hand car? You want to save money because you can not afford new car. When making big decision we usually research . We ask many question related to deal and more importantly the object. Having car with accident is not an end of world. You learned a lesson. Please do research before buying expensive item. Google important and key concern before making final decision.

You are always welcome to create thread in General.

Re: toyota main dealer lied to us. xan we sue

You did not ask. Dealer did not said about accident. Is there a contract document which says car never involved in accident?

Re: toyota main dealer lied to us. xan we sue

Typically in Canada all used car contracts stipulate that you are purchasing the vehicle in an "as is" condition. Heck even the private sellers know enough to put this line on receipts and bills of sale.

I don't know that it would be any different in the UK.
