The important thing to remember that as long as the Supreme Court does not touch the 17th Amendment, the CJ and his fellow judges are safe in their positions. It’s kind of like Musharraf and the CJ are in a constitutional bear hug, and if separated there would be a jungle-like anarchy everywhere. That much has been stated by the Supreme Court and the CJ. :jhanda: :slight_smile:

One more reason why the CJ is unlikely to create hurdles for Musharraf being re-elected as President for another 5 years. Otherwise a deal with BB will cut short the CJ’s term quite drastically, and from Jan 2008 he will just be another “senior most judge”. :slight_smile:

30-month term for CJs proposed?

The government is considering a constitutional amendment to limit the tenure of chief justices of the Supreme Court and High Courts to two-and-a-half years, Geo news reported. The channel quoted government sources as saying that the amendment would be included in the package of amendments that the government would push through parliament in case it reaches a deal with Benazir Bhutto. The amendment would limit the tenure of chief justices to two-and-a-half years, after which they could retire, or if they have not reached the age of retirement, remain as “senior most judges” of the Supreme Court or High Courts. Law Ministry officials denied any such amendment was under consideration.

Aalsi, the interesting thing is that elections are scheduled to be held in mid-January 2008 if the present assemblies are allowed to complete their term in mid-November. After the elections a government must be sworn in with 2 weeks i.e. by end of January 2008.

If the 30 month term for CJ's in included in the upcoming 18th Amendment being discussed between the govt and the PPP then the present CJ will be retired around 19/20 January 2008. That means Iftikhar will not be CJ by the time a new govt is sworn in - just perfect for BB! I bet she specifically asked for this 30 month stipulation to get Ifti out of his chair.

Lets be clear in a simple way regarding the Parliament, the Judiciary and the Government...

-The Parliament (voters) makes the legislation by a simple or complex majority...and the parliament's job is also to have a check on the government (the executive)...

-The Government's job is to enforce the law and order in its territory...

  • The Judiciary's job is to study and interpret the laws made by the Parliament or Allah (Jurisprudence) and give its verdict on proof...

PS: If there is corruption in the Judiciary...the government must check it...because the govt. is the enforcer of the law...

PS1: There is nothing free...or total freedom...everything is interdependent...I guess...I have rounded off the loop...

PS2: In reality...interests go above morals, laws and opinions...howzaaaaat... :D

Guess what Munir Malik said on Talat Hussains show on Aaj TV on the evening of 10 September after mian saab had landed at Jeddah;

When asked what would the SC do, what action will be taken, couldnt the SC have stopped this etc. He begins his animated reply with something to the effect "...SC per itna wazan/bojh na daalein ke wo gir parre aur apna kaam na kar sake. Kuch kaam hukoomat ka hai, kuch police, kuch fauj ka, aur kuch adliya aur adaalat ka..."

Of course everyone before Sept. 10 was going on the assumption that the govt. would not so blatantly violate SC orders. Now that it has, what stops it from rigging the elections on a mass scale to keep the general in power, I don't know.

But hey if u fancy a "strong" executive, with no regard for the judiciary or civil society, sure. Exactly the sort of arrangement that's ensured rule of law and provision of basic rights to the citizens.

Indeed. If they do, then all SC judges including CJ should resign immediately in protest, if they believe the judiciary is not free.

You should laugh once a petition is filed and then rejected by CJ, just telling PML-N to follow process is not good enough to be considered as against NS or approval of NS deportation.
