Re: supreme court of pakistan

CJ is busy working on important Issues like this, unlike the Mushrraf who waits untill Uncle Sam say somthing b4 doing it. Someone has to use danda to get those in power to do something thats important for the country and CJ is just doing that. Can you disagree with this?

Btw, good news is that CJ will be around untill 2013. And if Mushrraf is around untill then… hopefully he will make his life miserable…

CJ warns govt of judicial order

ASSAD HAMEED
ISLAMABAD - Chief Justice Iftikhar Muhammad Chaudhry Wednesday observed that the government takes only an hour for promulgating an ordinance of its own preference but took over a year to promulgate an ordinance in public interest for checking illegal trade of human organs despite the court orders.
“Pakistan has become a paradise of organ trade,” Chief Justice Iftikhar Muhammad Chaudhry regretted while chairing a three-member bench of the apex court that was hearing complaints against the booming illegal trade of human organs in country on a suo motu notice.
Justice Rana BhagwanDas and Justice Ghulam Rabbani were the other two-judges at the bench, which was assisted by Deputy Attorney General (DAG) Raja Irshad during the proceedings. Two officials of Cabinet Secretariat were also present before the court.
The bench expressed its annoyance over the fact that the government was delaying promulgation of Transplantation of Human Organs and Tissues Ordinance, 2007 despite repeated instructions by the Supreme Court.
“We are not helpless people, we will make the proposed draft of Transplantation of Human Organs and Tissues Ordinance, 2007 a part of the court order and issue a judicial order for its immediate implementation,” Chief Justice made it clear.
Conceding the non-seriousness of government in finalising the proposed draft and subsequently promulgate an ordinance for its implementation, Deputy Attorney General (DAG) Raja Irshad said the government was not serious in the legislation due to the influence of kidney trade mafia.
DAG further stated that he had been in personal contact with Secretary Cabinet Division and conveyed him the court orders passed after it was told that the Law Ministry has sent a draft ordinance in line with directions after wetting it properly. However, the DAG said his efforts bore no fruit.
“They have got staff, cars and resources but no one is interested in doing its duty,” Chief Justice further observed while expressing sheer annoyance over the inordinate delaying in promulgation of Transplantation of Human Organs and Tissues Ordinance, 2007. He directed the Federal Secretaries, Health and Cabinet Division to appear in person today (Thursday) and explain the reasons for delay in the approval of Transplantation of Human Organs and Tissues Ordinance, 2007 from federal cabinet.
CJP also referred to media reports that the poor are selling their organs in a bid to survive as poverty is one of the reasons for boom in illegal trade of body organs.
Earlier, when DAG Raja Irshad congratulated CJP on resuming charge and tried to offer his good wishes, Chief Justice Iftikhar Muhammad Chaudhry reminded him that ‘it was precious time that belongs to public.’ The DAG was further directed to restrict himself to assisting court in case when he was unfolding his good wishes for CJP.
Earlier, during the hearing of a service matter from Tank, (NWFP), when Afnan Kundi Advocate, the counsel for appellant, sought suspension of a respondent in his case, Chief Justice Iftikhar Muhammad Chaudhry only issued notices to parties.
When the counsel insisted for suspension, the CJP reminded him of the four month long debate and asked Advocate Kundi whether he has forgotten that no one could be suspended without being heard.
