Of course Pakistan haters will either ignore this or will find something wrong in this as well.

Senate passes 2 bills on women protection

ISLAMABAD: The Upper House of the Parliament on Monday unanimously passed two landmark pro-women bills aimed at protecting women from the negative customs and traditions and seeking severe punishments for the violators.

The bills already passed by the National Assembly were moved one by one by Senator Nilofar Bakhtiar. Both the bills seek to amend the Pakistan Penal Code, 1860 and the Code of Criminal Procedures, 1898.

An Anti-Women Practices bill consisting of five clauses seeks to penalise evils such as the so-called marriage with the holy Quran, forced wedlock and depriving women from inheritance.

The statement of objects and reasons of the bill said that were several practices and customs in vogue in the country which were not only against human dignity but also volatile human rights. Such customary norms, which are contrary to Islamic injunctions, should be done away forthwith and the persons continuing such practices be dealt with severely by providing penal and financial liabilities.

The bill recommends punishment for giving female in marriage or otherwise in badla-e-sulh', wani or swara. It says, "Whoever gives a female in marriage or otherwise compels her to enter into marriage, as badla-e-sulh’, wanni, or swara or any other custom or practice under any name, in consideration of settling a civil dispute or criminal liability, shall be punished with imprisonment of either description for a term which may extend to seven years but shall not be less than three years and shall also be liable to fine of five hundred thousand rupees."

Besides the bill proposed prohibition of depriving woman from inheriting property, prohibition of forced marriage and prohibition of marriage with the Holy Quran. The violators will be handed over either imprisonment or a fine of five hundred thousand rupees for each crime.

The other bill which is aimed at preventing incidents of throwing acid at women recommended that whoever hurt by corrosive substance shall be punished with imprisonment for life or imprisonment of either description which shall not be less than 14 years and a minimum fine of Rs one million. (APP)

So the legislature is doing it's job. Good.

Is the executive going to enforce these laws? Will they be prosecuted in Pakistani courts. Color me skeptical, but I'll keep my fingers crossed.

You are absolutely right.

Unfortunately laws are made and selectively implemented around the world, especially when it comes to rich and powerful. Pakistan is no exception.

Few examples are:

  • Very strict anti terrorism laws in the US, but the main presidential candidates openely and very clearly promoting terrorism in foreign countries. They will never be prosecuated.
  • War criminals from around the world are being brought before ICJ in The Hague, but no American is EVER punished there.

And so on.

Good question and the answer lies in the continuity of democratic process. Meaning we need at least 2 to 3 on time elections. People should never support the 22 grade generals to take over the country and rape the constitution no matter how bad the situation becomes. our problems can only be solved by politicians.

Is there any war or issue resolve by force in the history on mankind, nope sir everything end up at the table to talk it out.

^ i personally think that the government would be in a better position to judge if they need to talk to anyone including the taleban...

but one thing really confuses me is that the Americans want to get out of Afghanistan and for that they are dying to negotiate with Afghan Taleban (to end the war there). But they are dead against Pakistan talking to TTP. That itself smacks of hypocrisy.

Well I think that everyone has his own personal view of things, we should engage with them even if they don’t subscribe to our point of view.

As far as this bill is concerned its a good effort, but bills themselves don’t mean anything its their implementation.

It is still better than not having a law at all. Then you have basis to prosecute people if they violate it. See the glass half full, :)

For example, the law about accountability and corruption must be brought as well, even if it is "just" a law. But you and me know why it is never gonna happen.

The legal definition of terrorism is murky. I'm sure the Americans don't consider the actions of their military to be terrorism, although there is a case to be made that their actions are substantially similar. The de facto understanding is that terrorism are acts of violence carried out by non-uniformed individuals against civilian targets for political reasons. The US military actions fall outside this definition.

I'm not an expert in this area, but I've read about how the US rejects international courts supremacy over the United States Supreme Court. I don't think they are wrong in this regard. No country should be expected to subject it's sovereignty to an international body. For what it's worth, Bush cancelled a trip to Switzerland because he was threatened with arrest on charges of crimes against humanity. This was obviously after he left office.
