SC takes suo motu notice of Swat incident

ISLAMABAD: Chief Justice of Pakistan (CJP) Justice Iftikhar Muhammad Chaudhry taking a suo motu notice of Geo News’ footage of whipping of a 17 year old girl, ordered the Interior Secretary to bring the girl along with him to the court.
Taking suo motu notice of the Geo News’s footage in the interest of the people, Justice Iftikhar Muhammad Chaudhry formed an eight-member larger bench which will initiate hearing of the matter in question on April 6. The bench will be headed by CJP himself.
According to a press release issued by the SC, the CJP ordered for the matter to be taken by the larger bench under Article 184 of the Constitution.
Notices have been issued to Secretary Interior, Chief Secretary NWFP and IG NWFP to ensure their physical presence before the court on April 6.
The Chief Justice has ordered the Secretary Interior to bring the girl along with him on April 6.
Notices have also been issued to Attorney General of Pakistan, Advocate General NWFP, President High Court Bar Association NWFP for the assistance of the court.
The larger bench comprises Justice Javed Iqbal, Justice Sardar Muhammad Khan, Justice Khalil-ur-Rehman Ramday, Justice Faqeer Muhammad Khokhar, Justice Mian Shakirullah Jan, Justice Raja Fayaz Ahmed and Justice Chaudhry Aijaz besides Chief Justice Iftikhar Muhammad Chaudhry.

بینچ کی سربراہی چیف جسٹس افتخار محمد چوہدری خود کریں گے جبکہ اس بینچ کے دیگر ارکان میں جسٹس جاوید اقبال، جسٹس سردار رضا خان، جسٹس خلیل الرحمن رمدے، جسٹس فقیر محمد کھوکھر، جسٹس میاں شاکراللہ جان، جسٹس راجہ فیاض اور جسٹس چوہدری محمد اعجاز شامل ہیں۔
سپریم کورٹ نے حکم دیا ہے کہ تشدد کا شکار ہونے والی خاتون کو چھ اپریل کو عدالت میں پیش کیا جائے۔ اس کے علاوہ سیکرٹری داخلہ سید کمال شاہ، صوبہ سرحد کے چیف سیکرٹری اور صوبہ سرحد کی پولیس کے سربراہ کو بھی عدالت میں طلب کیا ہے۔
سپریم کورٹ کی طرف سے جاری ہونے والے ایک بیان کے مطابق چیف جسٹس افتخار محمد چوہدری نے مختلف ذرائع ابلاغ پر چلنے والے ویڈیو کلپ پر نوٹس لیا ہے جس میں ایک شخص ایک خاتون کو کوڑے مارتا ہوا دکھایا گیا ہے۔
سپریم کورٹ کی جانب سے جاری ہونے والی پریس ریلیز کے مطابق وڈیو میں جگہ اور حالات کا تعین نہیں کیا گیا تاہم اس میں دکھایا گیا واقعہ بنیادی انسانی حقوق کی شدید خلاف ورزی ہے۔ عدالت نے آئین کی شق ایک سو چوراسی کی دفعہ تین کے تحت نوٹس لیا ہے۔

But now everyone should leave it to S.C. because although it is cery cruel and shamefull for all of us but I am afraid of timing of this media compain.
Presedent Zardari is supposed to sign an ordinance about Nizam-e-Adal in Swat and this may be a compain to stop him from this act.

This is interesting. Few days back govt asked Swat judiciary to not attend courts over security issue, Taliban summoned politicians (?) to show up in their court, so called Taliban-court lashing video popsup, SC CJ summons NWFP govt officials for this issue.
An other news also printed today in daily **‘Jang’ **that after this compain the west shall pressure Presesdent not to sign the regulation about Swat. I have already pointed out this.
Dont forget condition of innocent people of Swat living under cruel rule of Taliban. Atleast this regulation can give temporary breath.
I don't think Zardar should sign this law & Swat is not part of tribal areas. That is why SC has jurisdiction over what happens in Swat. Next I hope the SC out laws Taliban Sharia in Swat.
BTW, this is slippery slope. If today we're willing to hand over to Swat to Taliban because of terrorism tomorrow they will be asking for Peshawar & soon whole country. How many people are willing to hand Pakistan over Taliban?

A lot of people are willing to hand over pakistan to taliban to complete their islami nizaam ka nazria. Among these people, nawaz sharif, qazi hussain (or whoever the new jamaat guy is), imran, khan, hamid gul and like minded people.
I can tell you one thing, we in sindh will rather break away then ever surrender to taliban. Our way of life is incompatible with talibs.

LOL, Swat is no longer under the jurisdiction of the SC. Someone should break the news to the CJ.
swat is still unde jurisdiction of CJ , and even after the so caled nizam-e-adl, these would be lower courts which would be turned into qazi courts and supreme court would have a registry office there based on my knowledge.

What makes you think Qazi would support a Taliban takeover? Qazi has never been a real supporter of the Taliban and their Islamic ideology differs a lot from the way the taliban live. Jamat islami are very progressive when you out them next to the Taliban - they believe in education and for both men and women. The women in Jamat Islami may wear Head cover and Burqas but they have a very active role in the party. These are just some of the issues that they differ on. Im not sure if Jamat islami members all have beards or even would force others to keep beards - I have seen plent yof Ji supporters keep beards.
Hamid Gul does not support the Taliban ideologically and would never live under their draconian life - he is educated, progressive and I would guess would want his womenfolk to be too. People like him may want the Taliban in power in Afghanistan but would never accept their ideology in Pakistan.
I doubt IK or NS even want the Taliban in power. What exactly is an Islami Nizaam ka Nazria? These people believe in education, a lot more rights for women, and minorities, progression, being part of the international world.
Its sad to see them not saying anything negative about the Taliban. IF they can criticise AH or Mush then surely you could find fault within the Taliban. People like IK who a lot of young Pakistanis are pinning their hopes on need to be fair and unbiased in their opinions. IK should come forward and state that was an appalling act. He seems to be an expert on Pashtunwali (the way of life of Pashtuns) then he should know that it is a gross violation of Pashtun values to whip a woman on the b**t in public whilst non-related men are holding her feet.

Sorry, not buying this jamaat propaganda. Of all the jamaat people I have across, 99% of them could well be spokesmen for baitullah mehsud himself in how they attempt to excuse and obfuscate taliban acts. All these leaders I have mentioned and the jamaat supporters are the biggest threat since they are the enablers of taliban by their constant propaganda in taliban's favour. They have misled the public to believe that taliban are best muslims and the best thing for pakistan and everything against taliban is a conspiracy of jews and hindus. This is why any real debate on taliban is shut down by them by using these populist slogans and we are left without knowing the real truth about the evil of taliban and like minded jihadi laskahrs.
Everyone of them when pointed to a evil and barbaric taliban act, will say 1) that it is all a conspiracy against the islam and pakistan by RAW/CIA/MOSSAD and 2) taliban have the right intent but only need guidance to properly implement sharia and look the west is sooo bad also. Unfortunately J.I. could not succeed in 70 years of its political life so they looks to everyone for some success and it is long history but I don't think they can support Taliban.
