ISLAMABAD: The Supreme Court on Tuesday dismissed all petitions seeking the disqualification of Prime Minister Nawaz Sharif.

Three identical petitions had been filed by Pakistan Muslim League - Quaid (PML-Q) chief Chaudhry Shujaat Hussain, Advocate Gauhar Nawaz and Pakistan Tehreek-i-Insaf (PTI) leader Ishaq Khakwani which stated that PM Nawaz had lied on the floor of the National Assembly on the issue of arbitration by the army.

Nawaz had told the parliament that it was Pakistan Awami Tehreek (PAT) chief Dr Tahirul Qadri and Pakistan Tehreek-i-Insaf (PTI) chairman Imran Khan who had requested a meeting with Army Chief General Raheel Sharif in order to broker a settlement with the government over the political crisis in the country.

Nawaz had said he gave permission for the army chief to engage the two leaders and play the role of a mediator.

However, Imran and Qadri had categorically rejected the premier’s statement that they had invoked the army’s help, and had slammed the premier for ‘lying to the nation’.

The military had later issued a short statement saying that it was playing the role of facilitator in the ongoing political crisis at the behest of the government.

A seven-member larger bench of the apex court, headed by Chief Justice Nasirul Mulk, was hearing the case today.

During the hearing, counsel for Chaudhry Shujaat and Ishaq Khakwani Irfan Qadir contended that PM Nawaz’s statement in the Parliament had been denied by the Chief of Army Staff (COAS).

The premier’s speech in Parliament was also read out in the court.

The bench observed that the premier had not made a direct reference to the army and had only endorsed the opinion of Interior Minister Chaudhry Nisar Ali Khan.

The bench noted that Director General Inter Services Public Relations (ISPR) Major Asim Bajwa had not explicitly mentioned the premier’s name in his tweet and had referred to the government asking the army to play a facilitative role for resolution of the political crisis in the country.

The bench said ‘government’ could suggest any member of the federal cabinet.

The court asked Attorney General Salman Butt whether DG ISPR had held a press conference later where he had mentioned the premier’s name. Responding to this, Butt said that the matter had only been confined to Twitter.

The court said it could not order the trial of PM Nawaz under Articles 62 and 63 of the Constitution as there was a Parliament in place, adding that it could only do so if elections were in process.

In the existing situation, it said, the matter had to be forwarded to NA Speaker Ayaz Sadiq and then to the Election Commission of Pakistan (ECP), adding that the court was not the right body to be approached on this.

The bench was not satisfied with the petitioners’ claims that the PM had lied in the National Assembly. It also said that the petitioners could not seek the premier’s disqualification as the matter did not concern them.

The court subsequently ordered the dismissal of all petitions seeking the premier’s disqualification.

by the way when is qadri being sentenced? Will we ever get decisions against zardari's corruption and ttp's terrorism? If the answer is no then this decision is normal. After all shahbaz completed his previous five years as cm on one stay order.

In Pakistan law is only for the poor and weak, the elite is there to enjoy while the majority suffers.

The court has never been neutral, it's biased in favour of the elites (across the board). Take a cursory glance and you'll see for yourself.

The courts are only for the rich and waderas and looteras, not for the poor people.

When Liars against the constitution are allowed to contest election, then Liars form government on the result of rigged election, then Liars lies in parliament, use state police to persecute and kill people, run the government as King, take nepotism to highest level where every position is given to family member, close relatives, friends or people of same area (Lahore and surrounding), do all sort of corruption to loot and destroy the country, cover up corruption of opponents so that they cover theirs corruption … and on top of that:

Even courts show obvious biases, do not give justice, act absurdly and illogically, rather corrupt liars in government use judiciary as their paid servants, getting verdict whatever they want … and most state employees from any government department behave as personal servant of PM, than:

One should not complain if bloodshed starts on street of that country … or military takes over the country and throw thugs in government and many in parliament to gallows.

It may take time, but as situation in Pakistan is turning into, ‘bloodshed on streets’ or ‘military takeover’ is bound to happen … and I know, corrupts and partners of corrupts would not like what I mentioned, but one cannot turn one face from reality that is as clear as writing on the wall.

My only request to all is that, whenever that would happen, please do not cry or accuse anyone.

Personally, between them, I would prefer military takeover, but if army is not left with any guts, than we have to content with bloodshed on streets, that would engulf all (innocent as well as guilty), would weaken the country, and could even break the country.

Courts out there sure do use stupid logic. "Government could mean anyone in the parliament"?

The courts clearly work for the one in power.

Imran has already announced that PTI was not prepared to face Gullu Butts in Faisalabad, but now they would be prepared for Gullu Butts in Lahore, and that means, bloodshed, that could easily spread all over Pakistan.

LOL @ any federal cabinet. Kisi cabinet minister main itna dum hai k army ko kahey go talk to protesters?

Irrespective of this decision, what I dont understand is that in some cases they give benefit of doubt to accused and in some they dont. In other cases they will say "badi-e-nazer main lagta hai k mulzim nai yee kia ho ga" but when it comes to cases like this tu badi-e-nazer main kuch nazer nahi aata :)

Article 66: Privileges of Members

1. Subject to the Constitution and to the rules of procedure of Majlis-e-Shoora (Parliament), there shall be freedom of speech in Majlis-e-Shoora (Parliament) and no member shall be liable to any proceedings in any court in respect of anything said or any vote given by him in Majlis-e-Shoora (Parliament), and no person shall be so liable in respect of the publication by or under the authority of Majlis-e-Shoora (Parliament) of any report, paper, votes or proceedings.

and thats why I said that my comments are not related to this specific case. I totally agree with the decision. Although the basis was right but court needs more than “basis” to give verdicts.
