The outfit which proudly took responsibility for massacre of more than a 100 people, is none other than Lashkar e Jhangvi. LJ is an offshoot of Sipahe Sahaba (SSP) or Ahle Sunnat Wal Jamaat (ASWJ).
This is not the only incident for which they have accepted responsibility. We all know that LJ and SSP are involved in countless other such incidents of violence in the name of religion.
And we also remember that a few years back the apple of everyone’s eye**, Iftikhar Chaudhry, let the leader of this satanic outfit go scot-free**. Malik Ishaq was in jail for about 14 years, facing charges of killing hundreds of people. The evidences against him disappeared gradually, and finally Iftikhar Ch let him go due to “lack of evidence”.
Again, this is not the only incident where courts under Iftikhar Ch turned a blind to killings of thousands of people on sectarian grounds, and instead sided with the killers. While I can recall tens of incidents of innocent people killed in the name of religion, I can’t think of a single incident where courts punished anyone arrested for committing these crimes.** The excuse of “insufficient evidence” can not be used in every case.** This points out clearly to the malafide intentions Iftikhar Ch and co.
It makes sense when we see that Iftikhar is the cousin of Rana Sanaullah, the architect of alliance between PMLN and SSP in Punjab.
**This fight against sectarian massacres can not be won until their supporter in supreme court is removed from office. **
A Most Dangerous Man release of Malik Ishaq, a highly-connected terrorist, speaks well for no one.
By Khaled Ahmed | From the July 29‚ 2011‚ issue
The Supreme Court of Pakistan on July 15 released on bail Malik Ishaq, leader and founder of Al Qaeda-linked Lashkar-e-Jhangvi, on grounds of “lack of evidence.”
On his release, he was received outside Kot Lakhpat prison by leaders of Sipah-e-Sahaba Pakistan, banned in 2001 as a terrorist organization…
Their newspaper, Daily Ummat Karachi, in its July 16 edition said Ishaq had been freed without any “secret deal” and that **he had rededicated himself to war **against the proliferation of “insulters” of the Companions of the Prophet (peace be upon him) on the Internet …

Government had the audacity to allow this killer Malik Ishaq and his pals address a public rally in Karachi. And this is what he spewed there, #ShiaGenocide: After massacre of 85 Shias in Quetta, PPP-MQM govt allows Malik Ishaq Deobandi to speak to Kill-Shia rally in Karachi | LUBP](http://criticalppp.com/archives/238303)
Re: S Court's role in increasing sectarian massacres
CJ takes suo moto actions when a woman slaps another one, but seems to idly watch the show when hundreds of people are massacred every month.
Even in case of Balochistan, he ruled against the provincial government only due to its failure to stop killings of Baloch separatists. He STILL couldn't see the government's failure in stopping many more incidents of sectarian massacres.
All Iftikhar can do is to take suo moto action against killings of terrorist-infested Lal Masjid.
Re: S Court's role in increasing sectarian massacres
CJ can only take notice, and bring an issue to court. He cannot bring in proofs and evidence. He relies on the prosecution and police to do a good job in doing that. Unfortunately, our politically pointed police force has no interest in doing any of that, because all of these parties are criminal syndicates, taking turns.
I dont know why you cannot see the limitations of CJs reach in different issues. He can take suo moto on Waheeda Shah's slap, because she was caught on video. CJ didnt need police to provide evidence. But when it comes to terrorism, he needs proof. Thats what courts are made for. Otherwise, if we were to impart justice based on what we 'know' is true, then why have courts to begin with? Lets go for vigilante justice all the way.
Re: S Court's role in increasing sectarian massacres
^^^ The guy was in jail for murder and the CJ let him out, and now he is out calling for killing of Shias. The CJ has soft spot for terrorists & he is responsible for death of 100s of soldiers and civilians.

Malik Ishaq is not the only person propagating violence in public speeches. There are all sort of Jihadis with different agendas spewing hate and violence. These speeches should be enough to declare such people as threat to the society and kept behind the bars. I hope there is a rally against CJ also to make him answerable for failing to take notice of these open public threats against communities of different religious orientations..

proofs? what proofs CJ is looking for? whole of Pakistan knows, he is a terrorist, the guy himself has openly admitted to shia killings, he openly threatens them. his speeches are filled with hatred, and CJ scots him free, on what basis?he was wanted in over 43 cases. he knew it well, once this guy is released, he will start his killing campaign again. its a known fact that there are few parties (in Punjab especially) are in sympathy with these extremists. SSP had reached an agreement with Shahbaz Sharif/Rana Sanaullah. all this was done so that they can maintain peace in their regions. it just goes to show how independent and fair our judiciary system is...

He was in jail as an accused murderer....not as a **convicted **murderer. He had been in jail for 12 years, without the prosecution having come up with any proof or evidence. If anything, it was a gross miscarriage of prosecution, because it is a reflection of how awful our prosecution and police are. Imagine a family member of ours being put into jail for a supposed murder, and then is left in jail for 12 years, without the case going to court?
The CJ has a soft spot for justice. Though I disagree with a lot of things he does, I dont think this criticism is fair. If a person is languishing in jail indefinitely, he deserves his day in court. And in court, it is the prosecution's responsibility to come up with witnesses and evidence. The judge cannot pass judgments based on popular public opinion.

Dont you think that the laws need amendment too, so that forensic evidence can be used for prosecuting people? No one can stand up to these terrorists, if say I see Malik Ishaq killing some one infront of my eyes. Do you think that I'll be able to say that in the courts? Never, as I know the state wont protect me or my family. I'll close my eyes.
There are flaws in our judicial system which no one has bothered to solve, and we are in a middle of a bloody battle.

Italy in last 7/8 years has prosecuted a vast majority of Mafia leaders and the crime syndicate problem has become almost non-existant there. Previously no witness would come forward against mafia.. and no judge would dare give a judgment against them. We don't need to reinvent anything.. just learn from examples like these and implement them here because we have a similar situation vis-a-vis witness-judges acting against these religious mafia crime syndicates in this country.
1) They made new legislation where new innovative ways of prosecution were put in force.
2) They made some virtual courts inside the prisons. The identity of real judges and witnesses is kept a secret. In reality they are sitting in some far off place able to witness the court proceeding through video links.
3) In place of real witnesses and judges.. some actors are playing their roles in these virtual court rooms. They ask the questions and issue statements which are dictated to them by the real judges and witnesses sitting in some unknown places with hidden identities. The authenticity of the proof is verified by neutral unknown sources and confirmed to defense team.. they can question the authenticity of the proof by cross questioning..
4) Witness protection program has to be very strong even after the trial to encourage people to come forward to testify against these mafias..
We need to learn from such experiences of other nations and put these practices in place in our country. Present judicial system is not capable of prosecuting these dangerous criminals who are backed by strong crime syndicates who are working behind the facade of religious organizations.
Re: S Court's role in increasing sectarian massacres
^ if something like that is put into place then we can move forward. Forensic evidence like hate speeches and material should also be considered worthy enough to punish a culprit. Similarly the courts should be able to arrest terrorists preemptively if they have evidence that they are up to no good.
The procedures we have been using for the past 65 years have become redundant now. No one can provide evidence against the kind of terrorists we are against.

Our army is demanding something like US army powers. They want to create some war prisons like Guantanamo Bay.. where war trials can be carried out with minimum defense opportunity to these hard core criminals. All the trial proceedings are kept totally secret from general public. Special summary military courts carry out the task of prosecuting these criminals.
We can do the same... create a homeland security department. Make some out of bound detention centers in some far off places. But this is only possible if all the media and political leadership is on board and there is no major hue and cry for missing persons. We have to realize that we are in a state of war... and we must have a consensus to safe guard our innocent population from possible terrorist threat. Conventional judicial system can not work here.. US realized it.. every nation of the world realizes the same problem. Sooner we realize it.. better it will be for us..

Problem with our Army gaining the same powers as US army is that our army is yet to clean its house first. Musharraf tried that but didnt succeed. Neither did Kiyani.
Our homeland security department is a must. We should take a leaf out of saudi arabian security forces and intelligence who once were in deeper trouble than we were but they tackled the issue emphatically. And guess what, many of their security forces comprise of men from pakistani origin.
Re: S Court's role in increasing sectarian massacres
First and foremost we need strong centralized intelligence mechanisms which can preempt attacks and arrest the terrorists before their activities. Then utilizing modern prosecution methods to punish the culprits. A comprehensive counter terrorism policy is needed, and like other things this government has failed to come up with one during their tenure.

If the present army leadership is not capable of doing this.. the civilian political leadership with consensus change the present leadership and put in place a leadership which is capable of doing this job. All this is possible if there is a political consensus between all the major parties.. and a sincere will to tackle this problem.
The people of Pakistan have to put pressure on political leadership to come to this consensus point. It is possible.. we saw the protestors getting rid of Baluchistan government.. we saw a change in the stance of Imran Khan today.
We are in a state of war.. we need out of box thinking.. and we need practical solutions to secure our people.. I am afraid just talking sweetly to these terrorist this is never going to happen..

Exactly! because current strategy is NOT working.
Do you agree with IK when he says that we need to find out the root cause of different factions fighting in the tribal areas and in the cities? K kon kiss liye lar raha hai?
Problem is that we are fighting a mindset and not just a bunch of loonies and murderers.
Re: S Court's role in increasing sectarian massacres
Blame the CJ. Malik Ishaq is out b/c of CJ. What does govt suppose to do to stop him for speaking?
Government can ban his public appearances, house arrest, provide protection to witnesses against him so cases can actually proceed etc.
