MY sisters nikah is NOT crossed at the section where right of divorce etc is written.usually ive seen them crossed out. but its been left blank. so what does this mean for my sister whose getting a khula.

ok, then what is written in rule 18. and what are the conditions of divorce. but if that rule left blank then its mean she does not have right to divorce.

I don't think that this affects Khulla. Khulla and Divorce are different in Islamic law. Under DIvorce the wife receives financial compensation, under Khulla the husband receives compensation through return of haq mehr.

Rule 18, if checked, allows the wife the right to terminate the marriage in a way in which she receives compensation.

SO its not expressly struck out? her lawyer could argue tha for her right....i mean its better than it being struck off?

Every woman in Islam has the right to Khula or Divorce even if there is a rule 18 or not. Islamically she has every right to separete from her husband.

if it is blank/struck out, its mean no condition was given her to divorce.

she can get khulla through court.

if its crossed out means she has to go for khula andgive up her mehr....if rule 18 not crossed out then she can get it by way if talaaq and keep her mehr.....

in my sis case,, its not struck out just left blank. which is unusual. its usually struck off.

yes STA, but surely she can argue that it wasnt expressly struck off. so maybe she can get it in favour of her?
