Honestly Nadz, what's more important to your sister - her freedom or 1 lakh rupees?
Unless she is expected to pay tens of thousands of dollars to get out of this marriage, this is a small price for her to end this relationship. Do you have any idea how much getting a contested divorce costs in the USA/UK or Canada? A small fortune! To avoid unnecessary hassle, have her forgive the haq mehr (it's not as if she has to pay out of pocket) and tell her to get on with her life.

Every woman in Islam has the right to Khula or Divorce even if there is a rule 18 or not. Islamically she has every right to separete from her husband.

I don't think you should go for it.
Yeah on one hand you want to make his side suffer and pay for what they did.
But the only person who pays at the end is you...your sister needs to end this chapter of her life as quietly and maturely as possible. If these people are truly worth divorcing...then do it and be done with it so they realize what they're worth: not even a fight.
Don't let her go to court for such a paltry sum...her sanity is worth more.
