As far as I know, Islam has not made any distinction between criteria for a first marriage vs. a 2nd, 3rd, or 4th.
#2 is as valid as #1. If it’s his right, it’s his right.
Personally, I also don’t think that a man is Islamically obligated (what’s ethical is another story) to ask his first wife for permission.
