Is it true that in Saudi Arabia if a woman reports being raped but is unable to provide 3 witnesses she can be charged for fornication or adultery? Wasn’t this also the case in Pakistan not too long ago where any woman who claimed to be raped had to provide 3 Muslim male witnesses or else she could face the death penalty for fornication or adultery?
What is your opinion of such laws?
Knowing how jahil Saudis are, it is quite possible that they have such law

But we had this law in Pakistan as well. Musharraf was the one who removed it and widely criticized for it too. Correct me if I’m wrong but, I believe Pakistani courts still don’t accept scientific evidence for rape cases.

Islamic Ideological council recently announced that they are ready to admit DNA as evidence.
These Jahil molvi make me so mad that I feel that we need someone like Ataa Turk who invited 500 of the top ones to a ship for dinner, and then ordered his forces to drown the ship (don’t know how true that is, but we need mass elimination of molvi culture from Pakistan)
So a rape is only a rape when there are three witnesses which men or 6 women since the ratio is 1:2 (I could be wrong) Sick molvi. Sicker mentality.

i think it’s somalia but a woman who claims to have been raped can also end up being punished, for supposedly taking part? and again, i think it’s jordon, not sure but rape charges can be dropped if the rapist marries the victim. quite ironic for all the talk about honouring women in islam.

A good start.
Although we can’t just blame the movlis, they’re in it for some personal agenda, we need to blame our people who fall for the movlis and don’t verify any information given to them, they take what the movlis spoon feed them as the gospel truth, or in this case, the Quranic truth. No verification, truly summun bhukmun and umyun. Deaf dumb and blind. Then when God brings retribution upon retribution on these misled people, they do rona peetna “Hum ne kya kiya?”. Ludicrous.

The physical action of rape are kinda close to adultery. Adultery some thing which scared all the religions.

According to my understanding its important that there are 4 witness or a confession for adultery.
(and judge is supposed to ask accused to withdraw claim of adultery
as bottom line adultery is very unique thing in islam)
On woman’s part reporting rape and not being able to prove should be considered as false claim.
For adultery I think man should confess too.

I don’t exactly know what’s the proper Islamic ruling on the subject but one question always arises in my mind that how come a rape victim can provide 4 witnesses? because no woman get raped in front of others.

Jordan is secular, but such rape laws exist in Saudia and the UAE. Recently there was a case in Dubai where a Norwegian woman was arrested when she reported being raped.

Under the Hudood Ordinances, 4 Muslim adult males needed to eye-witness the act of penetration in order for a rapist to be convicted.!

^^ Well if it is true and for any rape 4 witnesses are required then I think they should be hanged WITH the rapist…because they stood there watching and did nothing to stop it.

Unfortunately no one has been able to build a ship big enough to put in all Pakistani molvis. We have too many of them.

This is for the application of ‘Hud’. I am not very fond of molvies or what they have been up to during last 1,400 years but we also have misconceptions about Islamic laws.
A muslim country can have any law regarding rape as long as it does not ‘conflict’ with the Hudood. My understanding is that ‘Hud’ laws are those which demand extreme punishment. So, in case there are 4 dependable witnesses to a rape, the extreme punishment shall be applied.
In cases there the requirements of hudood are not met (e.g. no witnesses) and other means of evidence prove rape, then state laws can provide for punishment which can vary with the severity of the crime.

^ I don’t know. Except for the pleasure of the royal family, I am not sure if there is any other law in that country.

and it says that in order to prove zina atleast 4 male witness give evidence that they have eye witnessed the penetration. Now this law provide rules to prove/confirm a zina and not a rape. In reality even if someone has had zina (consented intercourse) why would they do it in presence of 4 males.
I think the law has been so badly twisted and is just being used against the rape victims.
