ISLAMABAD, Pakistan — At a dramatic session marked by heated arguments, Pakistan’s Supreme Court on Thursday gave a brief respite to Prime Minister Yousaf Raza Gilani, who appeared before the justices to defend himself against possible contempt of court

The Supreme Court has been infuriated over the ruling Pakistan Peoples Party’s refusal to write to Swiss authorities to reopen graft cases against Mr. Zardari. Since December 2009, when the Supreme Court struck down an amnesty that nullified corruption charges against thousands of politicians, the court has insisted that the government reopen corruption cases against him.

But the government has resisted the court pressure, maintaining that Mr. Zardari, as president, enjoys immunity in local and international courts. On Monday, the court initiated contempt proceedings against Mr. Gilani and asked him to appear in court to defend himself.

At Thursday’s hearing, Mr. Gilani’s lawyer, Aitzaz Ahsan, argued that the issue was not whether the Mr. Zardari enjoyed immunity, but whether Mr. Gilani believed in good faith that the president enjoyed immunity. The justices pressed him to explain why Mr. Gilani would not write a letter to Swiss authorities.

“As of today I have not the capacity to write the letter,” Mr. Ahsan said on behalf of his client. “I have every intention of implementing the order as and when the Constitution permits me.”

“No Pakistani authority that upholds the Constitution can push the president into a foreign fire,” Mr. Ahsan added.

Putting aside security protocols, a confident-looking Mr. Gilani drove a Land Cruiser to the hearing. At least 30 politicians from the ruling party and its allies also came in a show of support for Mr. Gilani. Stringent security measures were taken by the capital’s police; a helicopter hovered over the court building.

Prime ministers are rarely ordered to appear before the Supreme Court. Former Prime Minister Nawaz Sharif appeared before the court in 1997.

“Today is an important day in Pakistan’s legal and constitutional history as the prime minister himself appeared before the court,” Mr. Ahsan said, speaking to lawyers outside of the court and surrounded by government ministers and supporters of Mr. Gilani. “He has accepted the majesty of the law and the majesty of the Supreme Court.”

Mr. Ahsan said he would give detailed arguments on the issue of the president’s immunity at the next hearing.

After Mr. Ahsan addressed the cameras, competing groups of lawyers chanted slogans on the court steps, offering a graphic illustration of the divisions inside the once united lawyers’ movement that helped remove Pervez Musharraf from the presidency in 2008. “Whoever is the friend of Gilani is a traitor,” shouted one side.

If convicted of contempt, Mr. Gilani could serve up to six months in prison and be disqualified from holding office.

The court hearings have compounded the problems for the beleaguered government, which is also fending off pressure from the powerful military over a controversial memo that sought American support in thwarting a feared military coup.

Lets see how the case proceeds, but the way PM behaved today he has improved his standing. People are comparing his entry with NS one!

How can he be ‘chooha’ when he flatly refused CAOS to take back what he said about two top generals. No one made an issue. Gilani, after receiving contempt notice, he immediately said he would attend the court. Which general or PM in Pakistan attended on the summon of SC. On the other hand during dictatorship cjs, used to lick the boots of generals.

Siri paaia brain wala NS attended SC with his goondas and smashed the furniture of SC, Chief Justice Sajjad Hussain Shah hid in the bathroom to save his skin. This is how generals and PMs treated CJs in past.

Gillani didn't "immediately" say that, he was advised by certain quarters to do so, I am sure you can find related articles here on GS :). If I am not mistaken NS did attend court. Many people licked general's boots, including people who benefited from NRO ;)


I believe he was also issued contempt of court notice, besides he is not someone I hold 'respectable' anyways, neither do I care for armymen when it comes to courts. BTW, did govt really listen to what courts have been saying all along or is it selective listening?

The really worrisome part is that lawyers have turned into common goons. What with sloganeering and rose petal welcomes for murderers. No one in Pakistan can stay in their clothes as soon as they get any type of power.

According to Condoliza Rice, Mush the great requested that he wanted compromise with BB. It was not BB who wanted NRO. It was the corrupt Musharraf who wanted this to continue his 10-years rule. Blame the great Mushy not BB.

And why Musharraf would have done that, negotiate with irrelevant person, a woman who was scared to even come to Pakistan due to corruption cases against her, especially when Musharraf was already ruling as president and army chief ... with whole of Pakistan under his grip? What BeNazir could have given him in that situation when Musharraf was much stronger at the time then what he was even at time of coup?

Musharraf was openly supporting mqm, 3775 murderers, killers, bhattakhors criminals were acquitted due to his NRO. A few PPP and other party leaders were used as camouflage to give full pardon to hard core criminals of mqm. Musharraf was even involved in May 12, 2007carnage, when current CJ was visiting Karachi, he was not allowed to come out of Karachi airport and returned back to Islamabad.

**(current CJ has become shameless due to power play and politics and he forgot that a number of innocent people were killed in Karachi who only came to greet him. His first suo moto should have been killing of innocent people by mqm purely on his accuount, and should have given justice and compensation to the grieved families.)

**MQM benefited the most from NRO

SLAMABAD, Nov 18 The government did not present in the National Assembly a list of beneficiaries of the National Reconciliation Ordinance (NRO) despite a promise made by the prime minister to that effect.

The list has names of about 5,800 people who were facing financial irregularities and criminal cases. The list obtained by Dawn shows that 3,775 cases (mostly criminal) were against leaders and workers of the Muttahida Qaumi Movement (MQM). Leaders of the Pakistan People`s Party, Pakistan Muslim League-N, Jamiat Ulema-i-Islam (Fazl) and Awami National Party are also among the beneficiaries.

Prominent leaders and bureaucrats who enjoyed immunity under the NRO include President Asif Ali Zardari, Interior Minister Rehman Malik, Nusrat Bhutto, former minister Yousuf Talpur, PPP secretary general Jehangir Badr, Pakistan`s Ambassador to the US Hussain Haqqani, secretary general to the president Salman Farooqi, former chairman of Pakistan Steel Mills Usman Farooqi, Sindh Governor Ishratul Ibad, former interior minister Aftab Sherpao, former minister Anwar Saifullah, former MNA of N-League Haji Kabir, Agha Siraj Durrani, former provincial minister Ghaniur Rehman, Habibullah Kundi, Sardar Mansoor Leghari, Mir Baz Khetran, Aslam Hayyat Qureshi, Saeed Mehdi, Javed Qureshi, Siraj Shamsuddin and former secretary to the president Rasool Baksh Raho.

Officials of the law ministry and the National Accountability Bureau (NAB) were not sure whether cases against Mian Nawaz Sharif, Punjab Chief Minister Shahbaz Sharif and PML-N leader Ishaq Dar, including the Hudaibya Paper Mills case, had been settled under the NRO or were still pending in courts.The NRO introduced by former president Gen (retd) Pervez Musharraf provided immunity to leaders and officials from cases registered during 1985-99.

The fate of the NRO is hanging in the balance and there is a possibility that corruption cases dumped under the ordinance might be reopened.

Sources in the government said that pressure exerted by coalition partners had forced the government not to present the list of the beneficiaries in the National Assembly.

They said there was pressure from the MQM and the JUI-F because hundreds of their workers allegedly involved in corruption and criminal cases had availed themselves of immunity under the NRO.

The PPP decided to take the NRO to parliament, but reversed the decision when the coalition partners refused to vote for it. However, a government spokesman said the list would be presented in 15 days as promised by the prime minister.

“The law minister was to present the list of NRO beneficiaries in the last NA session but he could not do so because the record was not consolidated,” the spokesman said.

The next session of the National Assembly is likely to be held after Eidul Azha.

Meanwhile, NAB has started consultations with its legal experts to decide the stance it would take after the deadline for parliamentary approval of the NRO ends on Nov 28.

According to the sources, the bureau is considering suggestions to vigorously pursue corruption cases if they are reopened by courts.

Would you care to explain how the present CJ has become shameless. Whose responsibility it is to investigate the killing of innocent people in Karachi. FYI JIT Reports giving conclusive evidence against murders by MQM terrorist have been made public by present government's ex Sindh interior minister Zulfiqar Mirza.. which were never presented before the courts to prosecute these criminals.. and were used as a negotiating tool to win political support by the present PPP govt. from MQM..

It's disappointing to note that people see only one sided wrong and are not ready to condemn criminal behavior because of their political affiliation. Your views will be much more credible if you start stating wrong is a wrong irrespective of who commits it..!!!

NRO was an ordinance and for it to become effective government needed simple majority in National Assembly. PPP wanted to get NRO passed from NA. PPP had votes of ANP and JUI with them, but still failed in getting NRO passed from NA because MQM declined to support and vote for NRO. If MQM had supported and voted NRO, today all cases written off due to NRO would have been lawful.

Because MQM declining to support and vote for NRO, NRO ordinance expired and later SC struck this ordinance out.

Today: All cases that were withdrawn due to NRO are active again. So why MQM opposed NRO knowing that their opposition would harm them most and support would benefit them most?

Now, if article is truthful in saying that biggest beneficiary of NRO was MQM then is it not right for article to also tell us ‘less intelligent people’ that even when MQM would have benefitted most by endorsing NRO in National Assembly, why MQM opposed NRO in assembly and thus stopped NA from endorsing NRO?

Well, since article says nothing, how about you try to clarify this mystery?

mqm has always played estabilishment b-team. CJ instead taking these cases more seriously, has become prejudice against PPP government. The article is the truth, no one can deny that mqm was the most beneficial party due NRO of Musharraf.

Had NRO not issued by stupid corrupt Musharraf, BB would have still being alive. NRO was a trap to kill BB on one hand and on the other benefitted mqm the most.
