ISLAMABAD: Pakistan headed into fresh crisis Sunday with President Asif Ali Zardari locked into a humiliating confrontation with the country’s top judicial authority over the appointment of a senior judge.

The crisis arose when the president appeared to ignore a candidate nominated by Chief Justice Iftikhar Mohammad Chaudhry for a vacancy on the Supreme Court, instead selecting another senior judge.

The Supreme Court suspended the president’s decree appointing Khawaja Sharif, the top judge in Pakistan’s second biggest city Lahore, and a judge to fill Sharif’s shoes, and summoned the attorney general to appear in court.

“This is the climax of the crisis that was brewing for almost one year,” Pakistani political analyst Hasan Askari told AFP.

“If the president doesn’t accept this ruling from the Supreme Court then Pakistan has a very serious constitutional crisis,” he added.

The chief justice, independent-minded and extremely popular in Pakistan, was sacked in October 2007 by then military ruler Pervez Musharraf.

Zardari reinstated him last March, but the move was seen as an embarrassing climbdown on the eve of a protest march on the capital Islamabad whipped by the political opposition and under Western pressure to avert a political crisis.

On December 16, the Supreme Court abolished a decree protecting Zardari and other government figures from prosecution, exposing the president to the possibility of having his immunity and eligibility for office challenged.

But analysts suggested the Supreme Court was stepping back from pursuing Zardari and the popular opposition party, the Pakistan Muslim League-N (PML-N), failed to jump on the bandwagon.

But Zardari’s controversial appointment of Sharif late Saturday put him back on open collision with Chaudhry, who had instead proposed Justice Saqib Nisar for the seat.

“The president is pleased to appoint Mr Justice Khawaja Muhammad Sharif, chief justice of Lahore High Court as judge of Supreme Court of Pakistan with immediate effect,” Zardari office had announced.

It took barely four hours for the Supreme Court to clip his wings.

“The appointment of Mr Justice Khawaja Muhammad Sharif as a judge of the Supreme Court, prima facie, appears to have been issued in violation of the provisions of the Constitution… hence the same is suspended,” it said.

The Supreme Court summoned Pakistan’s attorney general to appear at a hearing adjourned until February 18, senior lawyer Hamid Khan told AFP.

Information Minister Qamar Zaman Kaira released a curt statement through state media saying that Zardari made the appointments “as per constitutional provisions” and “after thorough consultations”.

Analysts said the Supreme Court and Zardari could each argue they were in the right, but warned the crisis could bring down the entire government if allowed to escalate.

Media reports that Zardari could hit back by declaring a state of emergency, as Musharraf did in 2007, were reportedly denied by his office and most analysts believe the only recourse could be to execute an embarrassing U-turn.

“The final interpretation of the constitution is done by the Supreme Court,” said Askari, warning that Saturday’s suspension order had already pushed the president into “an extremely difficult and humiliating situation”.**

“If the Supreme Court goes ahead and tries to pull him down, then perhaps the system will collapse… and perhaps there will not be constitutional government in Pakistan,” Askari warned.

Senior lawyers agreed, but rubbished any prospect of military intervention with Pakistan having only emerged from military rule two years ago.

“He (the president) has no option but step back,” Qazi Anwar, a senior Pakistani lawyer told AFP.

“He is already besieged and if he does not step back it will be a very serious situation for him,” he added.

Present judiary is playing a very dangerous game.. all actions are against one party and are laened towards another.. it has politicized itself and PPP today finds that CJ is only for PML(N)... all decisions of PML(N) which the same judiciary gave as against have been turned the other way..

Govt is right in sending CJ lahore highcourt as he is the senior most judge.. Is this a crime.. they consulted CJ supreme court and he differed.. appointment authority is federal govt not supreme court as per constitution..it has always been a bone of contension that governments in the past had superceded seniority and send junior judges to supreme court.. it has been established that only seniority can be a criteria to clear any crises.. sadly, present CJ Khawaja sb. has acted as a core worker of PML(N) from his spaeaches and remarks against federal govt.. doesnt want to leave his masters in Punjab.. his list sent to governer is also a tinted one as most are far below merit list and all are from two chambers his own and Hamid Khan's

someone educate me

consult to me means to discuss or to get opinion or get advice, it does not mean to seek permission, agreement or blessing. so the President does not need the permission of CJ to appoint someone, he may discuss pros and cons but then still do what he wants and appoint who he wants in accordance with the accepted practices.

also, it seems like there is precedence that the senior most judge will be appointed, which apparently zardari has done, so what is the issue.

even if we disagree with the ruling that the senior most judge should be appointed, the president still has the power to appoint a judge.

so from all this, I gather Zardari can send a note to Ifti and ask " so dude. what do you think about this fellow', and ifti may say, ' i dont think its a good idea because the dude steals patangs during basant' and then zardari can say well thanks for your feedback, I will factor this in my decision, and then go ahead and appoint the person to the court.

where is the issue here? really..

I am no zardari fan, but really dont see what has he done that is so wrong. I mean if 'consultation' is an issue so fine he can withdrow, send ifti a chitthee as I noted, get a response..and regardless of what that response says, go ahead and appoint the same dude again.

There is no independent media or judiciary in Pakistan.

nope you’ve picked up on the issue, it’s executive preogative ..one can argue over whether zardari has actually attempted to consult CJ..so far the Presidency hasn’t shown any evidence they have..

Obviously the terminology in the 1973 constitution needs clarity but if it’s left to the SC to decide..CJ will obviously rule in his own favour.

I am a bit suspect of the legal opinion of people like ex CJ Saeeduzzaman Siddiqui and other others because they used seniority as grounds to oust Sajjad ALi Shah on Nawaz Sharifs instigation.

On the other hand Fakhruddin Ebrahim has come out against the CJ’s ruling..which is quite damning ..considering he is one of the finest legal minds in Pakistan.

Now most of the prominent lawyers are in view that the matter is different than as produced by N$ supporters. The view about Khawajah Sharif is this that CJ don't think him fit for SC. If it is so , He should be asked to go home, He should not remain there to support his leader. Only read the decision about NA 55, you can read here in thread about NA 55.

If there is an issue of a judges competence the Supreme Judicial council is the appropriate authority.

What happened yesterday
Only a notification of appointment of senior most judges was issued after consultation.(Summery has twice traveled between CJ and government, that is a sufficient consultation) . The SC issued a stay order. What wrong there.

Former President Supreme Court Bar Association of Pakistan Ali Ahmed Kurd has outrightly rejected any clash between the vital institutions saying that people, who sacrificed and spearheaded lawyers’ movement for two years, would not allow any clash.

Talking to private TV channel, he said the principle has been set in the famous Al-Jihad Trust case that senior most judge of a High Court would be elevated to the Supreme Court of Pakistan.

He said any clash between vital institutions would not be good for the country. He urged all stake holders to act patiently and try to resolve the matter amicably.

Dr Khalid Ranjha said that vacuum is being deliberately created to pave the way for a third party’s interference.

Speaking to a private TV channel, he said that most of the people vowed defending the democracy.

Today two notifications, one relating to the appointment of Mr Justice Khawaja Muhammad Sharif, chief justice of the Lahore High Court as a judge of the Supreme Court and the other with regard to the appointment of Mr Justice Mian Saqib Nisar, senior judge of the Lahore High Court as acting chief justice of that court have been issued by the Government of Pakistan, Law, Justice and Parliamentary Affairs Division under the signatures of Malik Hakam Khan, draftsman/additional secretary. The said notifications read as under: -

“No.F.2(1)/2010-A.II.- In exercise of the powers conferred by Article 177 of the Constitution of the Islamic Republic of Pakistan, the president is pleased to appoint Mr Justice Khawaja Muhammad Sharif, chief justice of Lahore High Court as judge of the Supreme Court of Pakistan with immediate effect.

No.F.1(2)/2009-A.II.- In exercise of the powers conferred by Article 196 of the Constitution of the Islamic Republic of Pakistan, the president is pleased to appoint Mr Justice Mian Saqib Nisar, judge, Lahore High Court as acting chief justice of the said High Court with effect from the date of the notification of the appointment of Mr Justice Khawaja Muhammad Sharif, chief justice of Lahore High Court as judge of the Supreme Court of Pakistan.”

  1. The additional registrar, who appeared on court’s call, informed the court that a news was telecast in the electronic media regarding the aforesaid notifications and it was also in the news that Mr Justice Mian Saqib Nisar would be administered oath by today (Sunday), which necessitated the hearing of this case as an urgent one and this bench was constituted. Since it was an important matter, the additional registrar was directed to issue notice to the learned attorney general including through telephone and we retired for a while until we were informed about the service of the notice upon the learned attorney general. After some time we were informed by the court associate that the additional registrar, after informing the learned attorney general through telephone about the hearing of the case had come to the court, so we re-assembled.

  2. The additional registrar, in his report stated that he informed the learned attorney general for Pakistan through telephone who told him (additional registrar) that he was in Karachi at the moment and that the last scheduled flight from Karachi to Islamabad had already departed at 7pm, he expressed his inability to appear before the court. Since the matter was of urgent nature, as stated earlier, steps would be required to be taken by the Governor of the Punjab to administer oath to Mr Justice Mian Saqib Nisar as acting chief justice of the Lahore High Court by today, hearing could not be postponed without passing an appropriate interim order.

  3. Article 177 of the Constitution of Islamic Republic of Pakistan provides that a judge of the Supreme Court shall be appointed by the president after consultation with the chief justice of Pakistan. The additional registrar stated that according to the record of this court no consultation had taken place by the president with the Hon’ble chief justice of Pakistan regarding the appointment of Mr Justice Khawaja Muhammad Sharif, chief justice of the Lahore High Court as judge of the Supreme Court. In the light of the statement of additional registrar and also the note submitted by him and placed on the file of Constitution Petitions No.2,3 and 4 of 2010 relating to the same/almost the same matter, already pending before this court in which notices had been issued and a larger bench constituted for 18-2-2010, the notification of the appointment of Mr Justice Khawaja Muhammad Sharif as a judge of the Supreme Court, prima facie, appears to have been issued in violation of the provisions of the constitution, particularly, Article 177, hence the same is suspended subject to notice to the Federation of Pakistan through secretary, Law, Justice and Parliamentary Affairs Division, the attorney general for Pakistan and the learned advocate general Punjab. Mr Justice Khawaja Muhammad Sharif shall continue to perform his duties as chief justice of the Lahore High Court until further orders of this court. No steps to administer oath to him will be taken.

  4. In view of the suspension of notification No.F.2(1)2010-A.II. dated 13.2.2010 regarding the appointment of Mr Justice Khawaja Muhammad Sharif as a judge of the Supreme Court, the office of chief justice of Lahore High Court will not fall vacant, therefore, the second notification No.F.1(2)/2009-A.II of even date regarding the appointment of Mr Justice Mian Saqib Nisar as acting chief justice of the Lahore High Court cannot be acted upon. Therefore, the same too is suspended. In consequence, Mr Justice Mian Saqib Nisar will also continue to perform his duties as a judge of the Lahore High Court until further orders. Resultantly, no steps including administering of oath to Mr Justice Mian Saqib Nisar as acting chief justice of Lahore High Court shall be taken by the concerned functionaries.

  5. The draftsman/additional secretary, Ministry of Law, Justice and Parliamentary Affairs, under whose signatures the aforesaid notifications have been issued, is directed to appear in court on 18.02.2010, the date already fixed in the titled cases. The registrar of the Lahore High Court shall also appear on the said date. app

I do want Pakistan to be the land of milk and honey, if its not there yet then it should be on its way, do you SERIOUSLY believe that government has put some process, some efforts, some planning towards the target? We should’ve moved few inches towards that direction in two years but what I am seeing is that we are continuing in the direction set by military govt before this government took over. Retards, un-elected people running serious affairs like ‘interior’ ministry.

  1. President is bound to consult Chief Justice for appointment of judges. He didn't consult CJ, so the action was illegal. Period.

  2. For those who are trying to manipulate the word "consultation". By law, the interpretation of the constitution is done by supreme court and that is binding. Period.

  3. The actions seem to be against one party, because that one party is currently in the government and hence the attention (DA!!) besides, it has been established that the head of this party has been involved in stellar corruption.

  4. The case that some of you are referring to did not say that seniority HAS to be the rule always.

Fortunately, despite the whims of some khappe-party-supporters here, the majority of pakistanis support the CJ and we will stand by his side till our last breath.

The same media was against PML-Q and now critical of PPP, the people in power are always held to higher standards, its not new in Pakistan. Same is the situation in U.S during George Bushra's time and now Obama mama's time. And especially this gov't that is full of corruption, shady characters and shady deals. If PML-N is in power next then they will receive the same scrutiny.

I just have one question for you PPP supporting wankers. Why didn't Zardari consult th CJ. It is a requirement of the constitution. Why didn't he do it?

As the President he must uphold and support the constitution in all aspects.

Consultation is not like consultation of doctor. These papers were sent by CJ to president and than sent back to CJ, CJ again sent to President ,who ordered the appointment of senior most judges.
Nothing serious there .
Only Takht e Lahore wants their ..... remain in Lahore High Court.

there is a reason why the CJ's recommendation isn't binding people..it's because a CJ or COAS shouldn't be able to appoint their own successor!

regardless of personal animosity, Iftikhar should have avoided such open insult to the presidency. While it makes zardaru look powerless, it also makes the presidency and Pakistan look silly. Weren't there better ways to prove he's a big shot?

Show me where it states that Zardari even sent the papers to the CJ. He didn't. He didn't consult the CJ in any manner in violation of the constitution.
