This guy who is the brother of a good friend of mine comes to the U.S with his 8-month pregnant wife (on a visiter’s visa) only to have their child born in the U.S.A and be a U.S Citizen. They don’t think there is anything wrong with it. Do you? How would you reason with them?

I see nothing wrong, i do see parents who are thinking about the welfare of their little one. As a new little citizen of the us of a, the little one will be granted many rights and ability to come and/or go.

As long as they are paying for all the related expenses (deliver/C-section etc) and not running away after incurring expenses then it is okay (atleast financially :D)

They are very well off so money is not an issue but for some reason it didn't feel right when I heard it.

I don't know if this practice is actually rampant, but this mind-set (to have your child be born in the USA) is very common. Not just in desi communities, but more in Mexican families (lack of distance makes it even more appealing). US is still one of the few developed countries, which grants its citizenship just by being born here. I don't think (in fact I am fairly certain) UK doesn't automatically grant citizenship to babies born there. Not sure about Canada or other parts of Europe. Is there anything wrong in it? I don't know. As long as parents are financially responsible and are not hanging the local community with a huge tab, I don't see whats wrong here. Medical facilities in the US are considered top notch anyway; and this could just be a good preventive mechanism for any kind of complicated pregnancy (I am not saying thats the case here, but just making a point).

this plan of theirs will not work with the strict immigration laws that have gone into effect post 911. Best of luck to them nonetheless.
a married pakistani couple who came to the US on a visa approx 12 yrs ago has 6....count em 6 children!! ALL 6 of em born here were recenly denied a green card. They appealed their immigration case and were once again denied. Now they are forced to pack their bags and move back to pakistan. How's that for strict?

^ You are mixing two different things here.
The first and simple (so-called) "plan" is to have their child being a US citizen. There is no law that prevents that. If the child is born here, he (or she) is automatically entitled to US citizenship.
If there is a plan that the child, when he becomes 18 yrs old, will sponsor his parents to become US citizen; then thats a very long term plan and chances of parents getting US citizenship is the same as any other category of folks applying for greencard based on family sponsorship.

The 14th Amendment of the U.S. Constitution guarantees citizenship at birth to almost all individuals born in the United States

yes, AE...those kiddies are citizens here and should have no need of worrying abt green card unless its for their parents or other relatives.....if they were born here, they are full-fledged citizens.....

Those parents cannot use kids citizenship to stay in USA. I am sure that its parents whose green card were rejected, kids dont need GC, they are citizens. already

The kids have to wait till they are 18................then they get it........not before that...............is how I understand this Law............so they got to wait 5 or 6 more years...............:(

SS, I dont think thats true....a baby born here is a citizen from day of birth. i have a nephew who was born here, parents over there and he is afforded full citizenship and has had all the priveleges of it since he was born 17 yrs ago.

Not if your Parents get deported............because they are your main gaurdians...you go with your parents............until you become adult and then sponsor your parents................that is how things happen......but check with the INS.

I have unfortunately seen cases of well off desi running without paying full bills
Anyways is it safe for an 8 month preg lady to fly all the way from pak to us?
I'm changed the law a while back
Too many stories of ladies ready to deliver coming over just for the citizenship thing.

Not if your Parents get deported............because they are your main gaurdians...you go with your parents............until you become adult and then sponsor your parents................that is how things happen......but check with the INS.

Green Card must've been denied to the parents, not kids. Many people have been told "if you are parents of US citizens you can stay in the country, apply for green card on the basis of security issues for US citizens in parent's country". I think there was a law-in-the-making regarding such situation for illegal aliens (post 9/11 when deportations had started) who had resided in the country and had US citizen kid(s), don't know if that proposal was converted into law or not (seems like it didn't make it).

But kids will still get the citizenship, though they will have to leave because of their parent's deportation.

^ exactly.....that is what i meant. Parents were illegal aliens which is why they ended up being deported. SOME people get lucky while others do not.
immigration laws are just not as flexilble as they may have been before 911.
