qaum starts wondering about civilized nations when they see such actions (btw I dont agree with musharaff's approach) .. but where is this concrn about being civilized when a tiny fraction of the population pays their taxes? or spits on sidewalks or pisses on walls, or throws trash in streets, or plaster ads and olitical posters on private ad public property. when we turn blind eye to idiots like SSP and LEJ, do all kinds of black marketing, ghunda gardee, taxis charing above meters, shopkeepers trying to hoodwink you, doodhwalas adding water, spice walas adding sand and stuff...students paying off to get good grades, doctors not treating patients in govt hospitals but sending the patients to their private clinics, teachers not teaching properly at colleges but kicking ass at their prvate tuition centers...I can go on and on

lawyers of the nation go out and do pathrao when CJ is removed, where is that passion when jargas give verdicts out for women to be gang raped? where was this passion when we had been living with thatmockery of law known as hadood ordinance? come on..

qaum as a whole needs to look in its own garebaan...someone needs to show the nation a mirror..

civilized??? hah...how dare we expect our institutions and leaders to act in a civilized manner when as a nation we are anything but civilized...

the news about wasi zafar using foul language is correct. I heard it myself. Here is how it went…geo said the audio is available on Voice of America’s website but i cant find it.

Pak CJ, family roughed up by security men

ISLAMABAD: Ousted Pakistan Chief Justice Iftikhar Mohammad Chaudhry and his family were on Tuesday roughed up by security men outside his residence ahead of his appearance before a judicial council that will go into charges of misuse of authority against him.  

Sacked by President Pervez Musharraf last week, Chaudhry declined to take the official car and was preparing to walk to the Supreme Court, where the Supreme Judicial Council was meeting to hear the case against him.

But the security officials did not allow him and a scuffle followed in which Chaudhry, his wife and daughters were manhandled by the security personnel who put him in his car, television channels reported.

He was taken to the Balochistan House, the changed venue of the hearing, where a number of his supporters were waiting. They clashed with the security men and in the melee the windscreen of his car was damaged.

Former Prime Minister Mir Zafarullah Khan Jamali met him at the venue and persuaded him to attend the hearing.

The funny thing is that Wasi Zafar was saying that Justice Rana Bhagwandas could not be called back from his private trip to Dehli because of time but SJC was formed by secretly flying in Sindh Chief Justice Sabeehuddin was flown from Karachi. It takes half the time from Delhi to Lahore flight than it takes from KHI. :D

Fraudia, civilized behaviour should start from the top. The elite should not accuse the masses of anything when their favourite government is roughing up of the CJ of Pakistan and they remain silent.

As a comparison, here is what happens in the US when it is seen that there was an influence of the white house in the justice dept. And these people were just prosecutors for the state, not judges, but even then their firings have got people in trouble. And this is how independent judiciary should be.

Maybe he is corrupt, but he still deserves a fair hearing. Right now you are declaring someone guilty of being corrupt even before the government has publically announced the charges against him.

Hello no brainer. He's not been sacked. an enquiry has been launched into his alleged corruption and he has been suspended pending the results of this enquiry. According to the Constitution Musharraf is correct to do this. If you do not understand the difference between sacked and suspended, I can get someone to explain this to you in Urdu/Hindi.

^ how is he correct to do this? the constitution has a set procedure for disciplining a SC judge. The reasoning is simple, internal accountabilitywithin the Army and judiciary has an established structure it is something Musharraf has harped on a lot about when he exempted the Army and judiciary from investigation by NAB.

I’m not going through all this again, when it’s been answered two pages ago. The Constitution of Pakistan is very clear, and Musharraf has followed it. Here are the relevant sections (been pasted here a thousand times already).

*180. Acting Chief Justice. At any time when- (a) the office of Chief Justice of Pakistan is vacant; or (b) the Chief Justice of Pakistan is absent or is **unable to perform the functions of his office due to any other cause, the President shall appoint **[163]](http://www.pakistani.org/pakistan/constitution/part7.ch2.notes.html#163) [the most senior of the other Judges of the Supreme Court] to **act **as Chief Justice of Pakistan. *

The Chief Justice currently has a corruption charge hanging over him so of course he cannot perform the functions of his office at the moment until he has the clear trust of everyone concerned in the matter. Keyword here is act. Act means to replace temporarily until he can perform the functions of his office. in other words, the President has the right to suspend the judges from this text.

On referring the matter to the SJC, this is clear cut and totally in line with the Consitution as shown now.

*(5) If, on information [231A]](http://www.pakistani.org/pakistan/constitution/part7.ch4.notes.html#231A) [from any source, the Council or] the President is of the opinion that a Judge of the Supreme Court or of a High Court, (a) may be incapable of properly performing the duties of his office by reason of physical or mental incapacity; or (b) may have been guilty of misconduct, **the President shall direct the Council to [231B]](http://www.pakistani.org/pakistan/constitution/part7.ch4.notes.html#231B) , or the Council may, on its own motion,] inquire into the matter. *

You might not be able to see the Constitution stating clearly that Musharraf has the right to suspend the judge and order an enquiry but only the SJ council can remove the judge from office. The SJ council is not part of the Army fyi.

Reverberations of the dictator’s latest illegal action echo around the country

Pakistani President General Pervez Musharraf’s suspension of Chief Justice Iftikhar Mohammad Chaudhry has opened a new debate on democracy, constitutionalism and the role of military in the country.

The TV images of a president in military uniform chastising the country’s top judge have had people in shock for the past four days.

Meanwhile, a storm of protests has erupted all over the country, with the legal community boycotting the courts and opposition parties gearing up for a political conference to debate the issue.

Members of the government insist the action is rooted in the constitution, but critics say the sequence of events shows that that may not be the case.

Military justice
On Friday, General Musharraf called the chief justice to Army House, his official residence in Rawalpindi, and asked him to explain his position on a list of charges brought against him from several quarters.

Finding his answers unsatisfactory, the official APP news agency reported, the president referred the allegations to the country’s Supreme Judicial Council (SJC), a five-member body of senior judges empowered to probe the conduct of their peers.

At the same time, he issued two orders; one restraining the chief justice from performing his functions and the other ordering the appointment of an acting chief justice.

Legal experts doubt the legality of both these orders.
They say under the constitution the president can send a reference to the Supreme Judicial Council against a judge, but has no powers to restrain him.
“It is the prerogative of the SJC,” says a former chief justice, Justice Saeeduzzaman Siddiqui. “Usually, the judge himself opts out for the duration of the probe, and the court stops including him in the duty roster until the SJC has made its report.”
But the controversy does not end here.

Harsh treatment
The chief justice “remained” at Army House for five hours, leading many to conclude that he was being detained.
Afterwards, his desire to go to the Supreme Court was overruled by the police escort that took him to his official residence in the Judges Colony in Islamabad.
He remained incommunicado for well over 48 hours, until a former politician, saying he “dodged” the security to enter his residence, met him briefly on Sunday.

The politician, Air Marshall (retired) Asghar Khan, told the press that the chief justice’s telephone lines had been disconnected, his mobile phone blocked and the delivery of his newspapers stopped. Other reports on Sunday said the national flag and the flag of the Supreme Court of Pakistan had been removed from his residence.

What did the chief justice do to warrant such harsh treatment when, according to the constitution, he is still the head of the judiciary in Pakistan?
Government officials say that several people have filed complaints with the president accusing the chief justice of misusing his office and receiving favours.

But critics say corruption is not an issue with the present government.
They point out that there are more serious charges - such as financial embezzlement and property fraud - against some judges, including two members of the Supreme Judicial Council which will hear the chief justice’s case.
They also point to the federal cabinet, many of whose members had corruption cases pending against them in the National Accountability Bureau until they decided to join the government.

The chief justice was singled out because of his past performance, they say, which created misgivings in official circles about his likely role in the coming legal battles ahead of national elections, due later this year.

Government embarrassed
Since June 2005, when he took office for an eight-year term, the chief justice worked overtime to cut the backlog of cases at the Supreme Court.

He also took forceful action in cases relating to human rights, women and the environment, often coming down hard on senior police and civil officials to enforce the relevant laws.

But two cases stand out as evidence that the chief justice was not reluctant to take the legal battle to the very corridors of power in Islamabad. In June 2006, he reversed the sale of state-owned Pakistan Steel Mills, citing legal violations in the process of sale by the concerned institutions including the Cabinet Committee on Privatisation, headed by Prime Minister Shaukat Aziz.

More recently, he embarrassed the government by pressuring the intelligence agencies to disclose the whereabouts of scores of missing persons who they denied having detained.

Observers say with 2007 being an election year, the government is under pressure to retain its position in parliament and facilitate the re-election of General Musharraf for another term.

To avoid any risk, the government has already indicated it may let the present parliament elect General Musharraf and hold the elections later.
This is inevitably going to lead to legal disputes between the government and the opposition.

General Musharraf also requires legal sanction to continue to double as the army chief following his re-election as president.
But the chief justice’s views on the issue were not what the government would have liked.

Iftikhar Chaudhry told trainee military officers in February that, in his opinion, General Musharraf could not continue as army chief beyond his present term as president.
Observers say there can be no better reason for his suspension last Friday than these remarks.
