Kudos to Pakistan’s New Supreme Court Chief Justice..he has pushed through some interesting changes to Pakistan’s marriage laws…

Cruel husbands must pay dower in Khula cases: SC

PESHAWAR: The Supreme Court of Pakistan ruled on Thursday that while a woman divorcing her husband under ‘Khula’ provision has to forgo dower and maintenance in a no-fault case, a woman seeking separation on account of cruelty to her is entitled to both.

To add to the above the SC has enforced the no second marriage without consent from the first ..act in several cases..setting a precedent..and they are banging heads together over the whole meals during marriages

thats great news!..
about getting consent before 2nd marriage…there was no such law before ? i mean a state enforced one …becuz islam does have a provision of getting married the 2nd time after first wife’s consent…right?

The law existed but wasn't applied broadly ..it was introduced by Ayub Khan..i don't think there is anything about first wifes consent in literal interpretations of Islam..

The bit about khula rights and claiming both dowry and haq mehr in case of abuse is i think a very good move..it makes the abuser pay a price for his abuse.

tht wud be quite a topic to discuss actually. having lived all my life in the west i was shocked when i saw tht womenfolk gotta go to great lengths to "prove" abuse has taken place even when it was pretty obvious as to whatt had happened.
one more thing needs to be added in the laws is tht imams and other such clerics need to keep their beards out of domestic disputes as their reasoning and logic seems uncomprehendible in innumerous occasions.

The Problem with us desis (Read INDIA & Pakistan Before you jump on me) is so bad that there is no freaking law, that inspite of it being a LAW it will ever be implented or executed with equality to Rich/Poor or Male/Female.

Because Captain Sahib, according to Quranic explaination often done here on this very forum the husband has the RIGHT to hit the wife if he thinks she is not being a good wife. Do a little search.

Its not just desis, same applies to other nations i.e. Arabs, to some extent in West too, on many occasions rich/celebrity will get away with something we will be punished for.

Captain1, we will be talking about abuse if everyone agrees that a person hitting his or her spouse cannot be justified and is an abuse. But we don’t agree.
