Our superior judges did not take kindly to the Jang / News / Geo News group exposing the fact that judicial officials were shown taking bribes. So they made them publicly apologize over and over again, for printing such stories.


Jang group ordered to publish and telecast apology

A Lahore High Court full bench on Friday directed Geo TV chairman Mir Shakil-ur-Rehman to repeatedly telecast an apologise on the TV besides publishing it on front pages of the dailies Jang and The News till the next hearing on March 12. The bench consisting of Justice Sayed Zahid Hussain, Justice Asif Saeed Khan Khosa, Justice MA Shahid Siddiqui, Justice Syed Shabbar Raza Rizvi and Justice Sheikh Azmat Saeed issued the directive during the contempt of court proceedings against the channel for telecasting a programme, which according to the court, was an attempt to lower the dignity of courts. Mr Rehman told the court that the information regarding courts shown in the programme was incorrect. The court observed that the information should have been verified before being telecast. The bench told him to be careful in the future. The court ordered the channel to start telecasting the apology from Friday. It observed that apology should be published at a prominent place on front pages of dailies Jang and The News. The court exempted Mr Rehman from personal appearance but refused to exempt his son Mir Ibrahim from the same.

Cant you see that corrupts from judiciary has come out with all force to protect a chief justice who was corrupt? Unfortunately there are many Pakistanis and most lawyers who support corruption too, hoping that if corruption get eradicated from judiciary where they would go if they are caught doing corruption?

Today, CJ lawyers, especially Atizaz Ahsan, who himself is corrupt and belongs to a party full of corrupts, that is PPPP (under the leadership of mega corrupts like BaiNazeer and Zardari), *are not asking court to do enquiry and find if CJ has done corruption or not. They are just hoping that enquiry gets stopped, and their whole arguments in court are that there should be no enquiry on CJ corruption charges. *

Atizaz Ahsan is also making ridiculous assumptions to stop enquiry, saying that reference has malafied intentions. If I was government lawyer, I would have taken his point and start asking him to justify his statements and tell the court that if he started receiving wahi from Allah or what? Because, if he is questioning intentions, he has to know what is in the heart and mind of others without othes reveling that, and if he can know that, either he is getting wahi or has become human with super natural power that can read heart and mind of others.

Just think, if anyone alleges that you stolen his car and have it hidden in your garage, and thus wants an enquiry and investigation, what would you do? Would you say that I am scared of enquiry and investigation? Or that allegation is with malafied intentions? Or that no one have any right to make allegation on you? Or that no one have any right to demand enquiry on you? Or that no one have any right to come to your house and check your garage? OR If you are innocent and not guilty of stealing the car, obviously you would not say all that. If you are innocent, it would be rather you who would say that lets have an enquiry, lets check my house and garage to confirm the allegation. You would say that you are innocent and you are not scared if anyone come and check your house and garage, right?

That is the difference between an innocent person and a person guilty. *A guilty person would run away from enquiry or investigation (as present CJ of Pakistan is doing) whereas if allegation is made on an innocent person (especially by someone responsible), he would himself demand enquiry and investigation. Rather innocent person would ask for enquiry to be done as fairly as possible in such a way that he himself could not interfere with the enquiry *(that means he would prefer to get out of the way, like if he was Chief Justice, he would make himself inactive so that no one can later allege that enquiry result came in favour because Chief Justice was active and interfered with the enquiry).

Judiciary swears ‘loyalty’ to executive

Since the 1950s Pakistani history has been divided into periods of authoritarian military rule, alternating with brief bursts of civilian government. Almost every regime has altered the constitution in terms of the relationship between the judiciary and the executive, the provisions of emergency rule and the extension of presidential authority. Each also forced the judiciary to ‘re-swear’ its loyalty to the ruling junta, rather than the constitution.** This has destroyed the institution, demoralised the judges and made them prone to improper influence**. The civilian governments of Benazir Bhutto (1988–90 and 1993–96) and Nawaz Sharif (1990–93 and 1997–99) were unable to break the links between the military, religious leaders and military-backed politicians since their own power also depended on army support.

** On seizing power the current head of state, General Pervez Musharraf, purged the judiciary by forcing judges to swear an Oath of Judges’ Order to the Provisional Constitutional Order of 1999, barring courts from challenging the ‘Chief Executive, or any person exercising powers or jurisdiction under his authority’.** In January 2000, Chief Justice Saiduzzaman Siddiqui and five other Supreme Court judges refused to obey and were dismissed from their posts. In 2003 President Musharraf negotiated the Legal Framework Order, formally known as Constitutional 17th Amendment Act 2003, which allowed him to retain the power to dismiss a prime minister, dissolve the national assembly, and appoint the heads of the armed forces and provincial governors. It also permitted Musharraf to hold his military post through 2004 and serve his presidential term until 2007.

The government exerts tight control over judicial appointments, transfers and dismissals, particularly at the level of the superior judiciary.2 The fact that judges lack security of tenure can make them particularly susceptible to political influence. The Chief Justice recommends prospective judges to the Ministry of Justice, parliament and ultimately the president. Their names are also screened by the influential Inter Services Intelligence agency. Lists of candidates frequently change in this process, delaying the appointment of judges beyond the 30 days given to fill a vacancy after a judge’s retirement, resignation or death.

Yaar, they could be the most corrupt, but a corrupt democratic institution is far better then a corrupt no democratic institution…
A democratic insititution, can be governed and controled through legislation that allows the power to be shared by various groups within the system.
Checks and balances!
A corrupt non democratic institution such as the Army, doesnt answer to anyone and is free to do as they like unopposed.

:k: Good post. The problem is this judiciary led by CJ Iftikhar does not tolerate anyone exposing their corrupt practices. This can be seen by the fact that when Geo broadcast a tv programme about bribery in the courts, they were summoned before the High court and ordered to apologize publicly over and over again. Imagine if any else (other than these judges) did that, there would be an outcry!

Brother, you are right that judiciary is full of corrupts. However unfortunate, judiciary can only do a thing as long as they are allowed to do or what executives tolerate them to do.

Many in Pakistan seems confuse why judiciary cannot do anything to corrupt executive when they break the constitution and especially to army chief when army chief breaks the constitution. The reason is simple.

Judiciary is a body that can make decisions, but cannot implement those decisions. Judiciary anywhere in the world and anytime in history has no power to implement their decisions. Decisions can only get implemented by those that have force under their command. It is executives that can implement those decisions using different forces under them. Even executives cannot do anything but they depend on others too.

Executives have different organs to implement those decisions. In a country, for internal matters, executive uses police to enforce the decision of judiciary. If head of police revolts against executives order and do not want to enforce what executives wants, executives can ask lower in the police to help that police head arrested but if police is loyal to the head, executive can take help from army (or paramilitary forces) to get police head arrested and if police interfere, they teach the police lesson too.

Sometime executives decide to not listen to judiciary, rather they might even decide to go against judiciary, and in that case, if army head decides that judiciary is right and executives are wrong, they can force executives to listen to judiciary, as executives also have no power of their own.

Unfortunately if army head stops listening to executives, executives could appeal to lower ranking army personals to arrest army head, but if army is loyal to army head and do not want to listen to executives, than no executive or anyone in the country can do anything, as there is no stronger person in any country other than head of army.

That can only change if politicians that come to power (Prime Minister and ministers) are respected by all (that means they are popular, honest, respectable and not corrupt, as no one respect dishonest and corrupt). If politician in power is honest and thus respected than it is expected that most in army must be respecting them too, and that means army would listen to that politician. Even if head of army wants to revolt, he would think twice as chances are that army would not follow him against an honest and respected head of the country.

Unfortunately Pakistani politicians are mostly corrupt and that is why they are always scared from army and that is the reason an army head can kick them when they want without any fear that army would revolt against him in favour of executives (as most of the time, army head when do coup, they do it against a executive who becomes unpopular for whatever reason, especially corruption).

Judiciary still comes out less corrupt than the legislature (aka musharraf's bedroom), or the executive. Judiciary therefore is the least corrupt institution of Pakistan's governing structure.
