a couple of answers come to mind:

Firstly, our religion tells us not to even engage in gheebat, and I suppose talking bad about a person after his/her death constitutes gheebat.
Also, a saying comes to mind… I’m not sure whether it’s a hadith: the worst kind of gheebat is when one is cautioned for having made gheebat and the person replies, “I am not making gheebat. I am only speaking the truth.”

Secondly, after a person’s death, that person isn’t there to defend himself/herself - so the line betweeen slur and veritable information may become blurred.
