My parents got married over the phone and so did I. Thing is its just the name “nikah over the phone”. Nikah as such doesn’t take place over the phone and if it does, its not premissible. My husband was in USA and me in Pakistan. The way it worked for us in USA was

  1. my husband drew up papers for a power of attorney (my dad is a lawyer so that helped but you can get any Pakistani lawyer to help you, Pakistani as they are more familiar with this).

2)Then my father sent the papers over to USA to my husband to be, who had appointed my father in law as his “wakeel” to accept vows on his behalf as mentioned in the power of attorney. Any male muslim can be appointed as the wakeel, not just the father of the groom. Then my husband signed it in front of a notary public (can be the bank officer where your bank account is). He also got teh signatures of 2 male muslaim witnesses on it.

  1. The papers were sent to the Pakistani Consulate in your area(check their wesbite for details about the fee for power of attorney and what documents you might need to attach).

  1. Then the papers were sent to Pakistan, we had a niakh ceremony in which the qazi asked my father in alws if he would accept me on behlaf of his son and it was done. My husband did call during that time and they did ask him to say qabool hay over the phone but that really was redundant. My husband did show the nikah nama when applying for teh greencrad and visa before that and we attached a copy of Mohammadan Law as ist called in pakistan that goverens thes etypes of nikahs and it was accepted.

It should be easier in saudia infact to get it done as there are incidences of Shahba having the same thing done in times of war etc.

Please do not get married over teh phone only as it won’t be cacpted legally either. You ahve to have power of attorney from teh groom’s side.
You don’t have to have anything redone afterwards. The nikah is this way is valid.

Actually, thinking about this ... if it is an internet phone connection... or at least you have the camera facing bride and groom in their respective countries - then it's the same crap as being near each other...

Immediately after that, I got a call from him and he reiterated that he has given talaq to me,” **Fiza told mediapersons in Chandigarh. According to a study ‘Marriage and divorce amongst Muslim women in India’, conducted by Sabiha Hussain of the Centre for Dalit and Minorities at Jamia Millia Islamia, at least 15 such divorces were pronounced via SMS, email and phone in 2008.

hey actually don't be soooooooo shocked.

I think it just makes a divorce process easier. You do not have to face the other party, whom you don't want to see anyways.

However, it is a good option when BOTH are equally adamant on separation/divorce.

because 1400 years back there were NO phones... so how can a rule be formed 1400 years back when people did not even have knowledge about phones?
