There were 55 condidates whom papers were admitted by the returning officer ( A Judge) from all parties including PML N yesterday. Is there anymore act required. I have personally seen a rally of PML N on Mall Road Rawalpindi today. There was no threat to them.

I can tell you the truth. Why nobody noticed these news. This news was based on a Police report of 15th July and everybody was knowing the reason behind this 'News'
This time the news was published to support Punjab government for his plan to postopone the by-elections.

**ISLAMABAD: Many senior leaders of the Pakistan Muslim League-N have advised their leader Nawaz Sharif to stay away from the National Assembly till he is again eligible to become the prime minister.** 

The former prime minister appeared to have decided to take part in the by-election from NA-123, Lahore, before proceeding abroad in Ramazan.
However, the Lahore by-election has been been postponed by the Lahore High Court which agreed with the Punjab government that the law and order situation was not conducive to the conduct of polls. However, the postponement may not be for an indefinite period.
‘I have advised him not to contest the by-election. He must not expose himself to the media and public unnecessarily, when his closest rival Asif Ali Zardari is safely away from them,’ observe a senior PML-N leader.
He claims that along with several others, he has persuaded Mr Sharif to stay away from the by-election, if it is held in the near future.
The Representation of People’s Act restricts Nawaz Sharif from becoming the prime minister for a third term. He has twice occupied the slot in the 1990s.Before a recent Supreme Court judgment he could not even contest the general elections. The apex court judgment exonerated him in a plane hijacking case of 1999 making him eligible to become a Member of the National Assembly.
PML-N spokesman Ahsan Iqbal confirms the party is divided over the issue of Nawaz Sharif’s participation in the by-election. ‘One group to which I belong urges him to contest the elections. But several other senior leaders advise him against it,’ he concedes.
Although Mr Iqbal wishes Mr Sharif to jump in the electoral fray, he seems to accept the argument of the other group on a few counts. According to him, Mr Sharif cannot and must not join a National Assembly that behaves like a ‘debating club’.
‘Just imagine, the house is discussing Kerry-Lugar bill and the foreign minister has left for the United States. We don’t expect that our leader says something and the other side simply ignores it,’ he maintains.
Hamza Shahbaz, son of Punjab Chief Minister Shahbaz Sharif, has a rather diplomatic answer. He says his uncle has constituted a committee of a few senior party leaders to guide him on this particular issue.
‘Mian Sahab will listen to both sides to reach a conclusion. But we are not in a hurry, as the elections have already been postponed because of security threats.’
The Sharif brothers have repeatedly claimed that they did not want to rock the boat and wanted the People’s Party government to complete its five-year constitutional term.
But those who are aware of their past track record have little reason to believe them and suggest the Sharifs may be waiting for an appropriate and decisive moment to strike. At the moment they appear to be sitting back and enjoying the sight of President Asif Ali Zardari lurching from one crisis to another.
Earlier, reports had suggested that the Sharif would not contest the by-election as part of a deal with Saudi Arabia. The PML-N strongly denied the reports. But local and foreign power-brokers are still said to shape the political decisions by influencing those who seemingly make them.

Educational institutions open in three provinces

**LAHORE: The Lahore High Court has adjourned the hearing of the petition against the by-election postponement verdict till Wednesday.**

Justice Umer Bandiyal inquired whether it was the bureaucracy which was creating difficulties between the Election Commission of Pakistan and the Punjab government regarding the by-elections.
The counsel for the government, Advocate Amir Rahman, stated that the Election Commission should have given the Punjab government a chance to clarify its stance on the by-elections’ postponement. He also said that sufficient evidence had already been provided to the Election Commission in favour of the postponement.
Advocate Amir Rahman said that Section 52 of the Peoples’ Representation Act gives the election commissioner authority to cease the process of elections at any time to preserve the law and order situation.
The court ordered the provincial government to submit a report outlining its precise role and accountability in the election process and to what extent should the accountability be maintained. — DawnNews

LAHORE : A division bench of Lahore High Court (LHC) while dismissing three identical intra court appeals, upheld the decision of a single bench of LHC which postponed the by-elections in Punjab. The bench however dismissed the single bench order to the extent that Punjab government has right to be heard under constitutional convention.

Provincial government has no right in law to be heard before announcement of election schedule. Its rule is confined to rendering assistance to the Chief Election Commissioner (CEC). Rendering of assistance includes liberty and privilege to apprise the CEC about the situation on ground and to make suggestions as to when and under what arrangements an election may be held.

Such liberty and privilege cannot authorise provincial government to block announcement of election schedule by the commission until a hearing is granted to the government. The bench observed that the election commission before issuing election schedule should consider the material produced before it pertaining to the arrangements for maintaining the law and order situation. The bench, however, held that the election commission is independent.

The petitioners included Chief of Awami Muslim League (AML) Sh. Rashid contesting election from NA 55 and Azhar Saddique and Manzoor Ali Gillani from NA 123. The petitioners contended that it is the duty of the government to maintain the law and order situation and to assist the election commission for holding elections.

They said people of Pakistan could not be stopped from their right to vote on any ground. They said the law and situation in the province is not so worst that the elections could not be held in some constituencies. They therefore prayed to the court to set aside the decision of the single bench and direct the election commissioner to hold by-elections in the province against the vacant seats.

**ISLAMABAD: The Supreme Court on Monday issued notices to the Election Commission of Pakistan and the Punjab government on a petition of Awami Muslim League president Sheikh Rashid Ahmed challenging a high court decision of postponing by-election for a National Assembly seat (NA-55, Rawalpindi-VI). **

A three-judge bench comprising Chief Justice Iftikhar Mohammad Chaudhry, Justice Anwar Zaheer Jamali and Justice Khilji Arif Hussain granted leave to appeal to Sheikh Rashid and directed Acting Attorney General Shah Khawar to appear before it on Dec 30.

Senior counsel Wasim Sajjad, representing Sheikh Rashid who was also present in the courtroom, contended that the issue was of utmost importance because an important seat was lying vacant and bye-elections in the constituency could not be held due to concerns shown by the Punjab government.

Under Article 224(4) of the Constitution, by-elections should be held within 60 days of the occurrence of the vacancy but in the instant case the schedule issued for the election of NA-55 has been postponed with the intervention of the high court

It was the prerogative of the ECP, according to the Constitution, to issue election schedule where seats were lying vacant, the counsel said.

The ECP, he said, was an independent constitutional body and it was not subordinate to any administrative unit of the country. Rather all the administrative units within command of the ECP are to carry out its orders/directions.

The commission had issued a notification for holding the by-election on Nov 27 but the Punjab government went to high court took and said that the ECP could not issue the notification without hearing its viewpoint.

It is beyond his comprehension, the counsel said, why the Punjab government was intervening in the matter when general elections were held even after the death of Benazir Bhutto in the country and also in Gilgit-Baltistan and Afghanistan.

On November 26, a division bench of the Lahore High Court had dismissed three intra-court appeals against postponement of by-elections in the Punjab by upholding a decision of a single-judge bench.

RAWALPINDI: The Election Commission of Pakistan (ECP) has announced to hold by-elections for the National Assembly’s constituency NA-55 on February 24.

According to the ECP, appeals against approval or rejection of the nomination papers can be submitted by January 25.

It said that decisions on appeals would be announced by January 29 while nomination papers can be withdrawn by February 1.

Degas, you have to be out of your mind if you think the PPP stands a chance in an election in anywhere in the country, let alone the PML stronghold Pindi constituency where it has never ever won (nor will they ever will), despite fielding its top candidates :rotfl: PPP has failed miserably and the people want Zardari and his henchmen out, and denying that is absurd.

Like I said before, PPP cant handle criticism, and they start saying silly betuqi things when they buckle under pressure, which was most recently demonstrated by that mindless moron disinformation minister Kaira. He wants the accountability of Generals in addition to politicians, but keeps forgetting he IS PART OF THE GOVERNMENT.
