ISLAMABAD: Army chief General Raheel Sharif is said to have told Prime Minister Nawaz Sharif that he was totally unaware of Musharraf’s January 2 emergency dash to a military hospital.

A ministerial source confided to The News that on the day Musharraf rushed to the AFIC, General Raheel Sharif met the prime minister for an already-scheduled meeting but the two also discussed the former dictator facing treason charges for his November 3, 2007 actions.

The source said that Prime Minister Sharif inquired from General Sharif if he had any prior information of Musharraf’s travel plans to the AFIC.On this, the army chief saidthat he had no such information but came to know about it only after Musharraf landed in the AFIC.

Following an inquiry made by the prime minister about the army’s view on Musharraf’s high treason case, the source said General Raheel informed the PM that not the serving officers but some retired officers had contacted him and expressed their concern over the trial.

However, according to the minister, General Raheel Sharif informed the prime minister that he had told these retired army officers that it was a legal matter and should be left for the courts to decide.

When The News tried to contact the ISPR chief for his official comments on this claim by a government minister, the ISPR did not respond.Though General Musharraf, in his frustration, had sought the help from the army chief, General Sharif behaved maturely by distancing himself and the institution from the alleged crimes and actions of the former dictator.

Only a few days back, he visited the rehabilitation centre of the military hospital in Rawalpindi but did not visit Musharraf, who is trying frustratingly to get the institution of military dragged into the high treason case to save his skin.

Amongst the civilian leadership in the government, generally there is a complete trust in the incumbent army chief but there are some who do raise questions about the pro-Musharraf campaign by certain elements in security agencies.

Some leading ministers, including the interior minister, firmly believe that there is no institutional support available for Musharraf but the recent statement of senior Supreme Court lawyer and the government’s special prosecutor in the high treason case Akram Sheikh has raised many eyebrows.

Akram Sheikh said a few days back that sensitive institutions were threatening his family but he would not give up fighting the treason case against Musharraf till his death. He added that his family was being threatened and he was being asked to dissociate himself from the case.

He said that he was not afraid of death and would contest the Musharraf treason case till his death. Sheikh said he has great respect for national security institutions but asked them not to interfere in his personal life and that he would stick to the rules and Constitution.

Akram Sheikh has also contacted this correspondent to communicate that some officials of a leading intelligence agency were threatening him.

Wajahat S Khan adds: Responding to The News about the meetings, a senior military official attached with the chief of the army staff said that “all, and I mean all, recent meetings between the COAS and PM have been in the context of internal and regional security.”

You are accepting that trial is not concluded ... hence not guilty ... and Musharraf would be not guilty unless he is proven guilty. So ... how can you say that Musharraf is guilty?

I am not responsible if one cannot accept simple fact and cannot see simple logic. Situation is that, if one cannot punish all criminals when one can punish, then you could not punish one, else that would be victimization, discrimination, and persecution. Constitution of Pakistan (that demands equality for all citizens), neither any civil law or religious law allows that.

Soldier (Generals) not participating in government or politics is an absurd expectation. Throughout history, anywhere in the world, Soldiers (Generals) always took part in government as well as politics, rather, they always ruled (either kings were Generals or Generals taking over Kingdom). To bar soldiers from government or politics is same as barring religion from people. Anyhow, some people do have wishful thinking that soldiers could be barred from government or politics, but that could never happen, regardless of any laws, constitution or ways to keep them out (as Generals and Government are always linked to each other ... sometime overtly and sometime covertly).

As for Pakistan is concerned, even though soldiers were always interfering with government, Z A Bhutto introduced political desk in ISI (an army organisation) and thus dragged soldiers into politics for his own benefit.

What government do is not irrelevant for army or any citizen. Actually, army with gun power and intelligence agencies under them, have higher duty to check government, especially when thugs get into power.

As for grade 22 (Chief of army Staff comes in grade 22), then in Pakistan there is no government post higher than grade 22 (one can say that some officers are getting Apex scale, but still, highest grade is grade 22). Political posts are considered higher in sense that they govern grade 22 officers, still they cannot be considered as in grade higher than grade 22, as grade 22 is highest government post in Pakistan, so one can say that 'politicians in power' are in posts with higher responsibilities, that is all.

For instance, Chief Justice of Pakistan is also grade 22 officer (may have Apex pay scale), still President, Prime Minister or no one can sack CJ of Pakistan (or any SC judge who are in grade 22) other than going through procedure of SJC investigation and recommendation ... on the other hand, CJ or bench of SC judges can sack Prime Minister (as happened with Yusuf Raza Gillani).

Just think: How would you like if you get caught cheating in college exam along with 1 other kid, so college administration expel you from college and let other kid stay in college without any punishment.

Obviously, in that case you would go to court complaining against college administration and their discrimination, and in such case, it is possible that court would force college administration to re-admit you in the college or expel other kid caught in cheating too, and it is also possible that for acting discriminately, college administration might get suspended.

That is the reason, if college administration have any sense and wants to save one student (maybe the student is Iftikhar Chaudhary’s son Arsalan Chudhary), they would give warning to all and do not expel any.

The difference here is that you can punish all the criminals in this case. Its understandable for a police officer to only catch and fine one driver for speeding, even though 50 other cars were also speeding alongside him, but that is because those cars could not be caught by one police officer. In the case of Musharraf, all his aiders and abettors are within reach. Ch. Shujaat has even offered himself for a trial for the same charges as Musharraf. But the govt is unwilling to do so, for obvious reasons. Selective or incomplete justice is as bad as injustice.

Not all crimes are absolute nor equal in value of guilt, and the legal systems always operates in gray (neither white nor black). For example, two people could be charged with same crime and one could get death penalty and other life in prison. Why do you think that is?

You can't compare speeding ticket and military coup. Btw, I'm all for punishing ALL starting form 1958 when AK staged 1st military coup, but that does not mean Mushy should get away.

I was talking about the method of imparting justice...and in no way does that mean Musharraf should not pay for his actions, but the way he is being prosecuted wreaks of bias which is marring the whole trial.

I only partially agree with what you wrote. From my knowledge and understanding:

It should not happen that two prisoners charged with same crime are judged ... and same judge gave two different judgements at same time, as, if that would happen then judge is biased and is not worthy to be judge. Government should see that this do not happen, and if it happens then government should know that person on the post of judge is not worthy of being judge, and need replacement.

Anyhow, what you wrote could happen when we have two different judges or same judge giving judgement at two different times. Reasons:

1: Judgements of judges have elements of personal perceptions towards crimes. That means, two judges may have entirely two different perception of a particular crime and thus can give two different judgments for same crime. Though it could be unfair for a person judged (some finding favourable judge and other finding unfavourable judge), it can be considered as flaw in human judgements, even though both judges could be sincere, honest and unbiased.

Sometime judges also have perception towards person or community getting judged, and thus it is duty of state to see that judges appointed are impartial towards person getting judged, as such judge could become unjust towards particular person or community. Ideally, such person should not be a Judge. (relevant to Musharraf case)

It is also possible that judges have their own grudges or relationship with person getting judged, and in this case also it is duty of state to see that judge that has personal grudges or relationship do not judge a person, as such judgment would be full of biases. Thus, government should have law where accused can ask that judge should be changed, and such plea should be heard. (relevant to Musharraf case)

2: It is possible that same judge gives two different judgements for same crime, but at different time. This happens when judge giving judgment is going through different mood at different times. Even though it is not desirable, but still, it is acceptable as long as judgements are not too far from each other, and there are no biases in judgements.

ISLAMABAD - In another twist in former President General (r) Pervez Musharraf’s treason trial saga, the Special Court Thursday rejected his medical report and issued another notice for his personal appearance next Thursday (January 16).
It is the third notice by the special court to former Chief of Army Staff for appearance. If Musharraf again failed to appear then the court ‘shall pass appropriate orders’, said the order passed by the 3-jugde special court. The court shall give decision on applicability of Code of Criminal Procedure (CrPc) to the present proceedings today (Friday).
During the proceeding, the defence counsels read out certain parts of the medical report of Musharraf, but did not seek exemption from his appearance. The prosecution argued that Musharraf was well therefore he should be made to appear so that high treason charges could be read out to him.
The court said that Musharraf’s non-appearance even when he was not reported ill establishes disregard to court summons and “it is clear that the accused has failed to obey and comply with the orders of this court”. The court order stated: “The medical report does not suggest that the accused in his present state of health is unable to attend the court, nor any material was placed on record to justify his inability to appear.”
Earlier during the proceeding, lead defence counsel Sharifud Din Pirzada stated that the main ailment from which the accused is suffering is heart disorder and angiography has been advised. He contended that for undergoing such medical procedure it is quite possible that open heart surgery could be required and the accused would be within his rights to seek best possible treatment even if it means going abroad.
But lead Public Prosecutor Akram Sheikh contended that the former dictator was not confined to bed and he was not in the Intensive Care Unit (ICU). He added that in the last five days, since the alleged heart attack, no angiography of Musharraf has been done and it could not be done without the consent of the person. “The report is inconclusive and there is no categorical opinion by the AFIC Registrar that the accused suffered a heart attack or that he is ailing to an extent that he is unable to appear before the court.”
The AFIC Registrar on January 7 submitted ex-COAS’ medical report, which described the 70-year-old former military strongman was suffering from calcium deposits in his coronary artery, mental stress, frozen shoulder, excess cholesterol in the bloodstream, prostrate enlargement, and spinal and bone pain.
The court observed that in the medical report it is stated that the accused reported discomfort in his chest and left arm. “This could have been taken to be a heart attack or an angina pain or any other kind of heart ailment, (but) the same turned out to be a false alarm as the medical report does not disclose that after examination by the doctors the discomfort in chest or left arm felt by the accused was due to any heart ailment.”
Akram Sheikh prayed the court to issue notice to the accused for appearance before the court so that high treason charges could be read out to him, adding after indictment any person authorised by the court could represent him. He said excess of calcium and the toothache are not the sufficient ground to prevent him from appearance before the court.
The prosecutor said that even those over 60 years of age who are present in the court have these problems. He argued that according to report Musharraf’s blood pressure is 120/80 and the heartbeat is 53, which could be of a young man who comes out of the gymnasium. “There is nothing that prevents him from appearing for one hour,” Akram said.
Akram Sheikh stated that according to a media report on January 2, Rangers were deployed on the route to Musharraf farm to AFIC in the morning, which showed it was pre-planned diversion. He said that Musharraf is fine and receiving flower bouquets and meeting with his legal team. He urged the court to decide the matter in accordance with the settled principle. He said the cardiac ailment could be treated in Pakistan as AFIC and the Agha Khan Hospital have the best medical facilities and people from Middle East come here from treatment.
Musharraf’s condition was normal on the first, second and third hearings (December 24, 2013 and 1st & 2nd January 2014). Sharifud Din Pirzada, lead defence counsel, on January 2 had informed the court that his client would appear with delay therefore the court had adjourned the proceeding for half an hour. When the hearing resumed Islamabad Deputy Inspector General (DIG) Security Jan Muhammad informed the court, “He (former COAS) was on his way to this court but due to cardiac arrest, his convoy had been redirected to Armed Force Institute of Cardiology (AFIC).”
The defence counsel advanced the reason for non-appearance of Musharraf of 2-1-2014 was that he suffered from a heart attack on his way to the court and had no option but to head towards AFIC, but he did not file application for his exemption due to his ailment. The court on the last three hearing (January 6, 7 & 8) condoned the absence of Musharraf merely on the ground that he was hospitalised. This was done despite the fact that neither any application for exemption from appearance was filed nor even it was verbally requested on behalf of the accused.

He is flying on 1/31/2014. Perhaps he will not visit Pakistan till end of PML(N) government in 2018. He should donate his palace and other halali properties to Edhi Trust as this song suggests.:smiley:
