Mumbai confession was coerced

The leading suspect in the Mumbai (Bombay) attacks trial has retracted his confession.
The lawyer for the sole surviving suspected gunman, Mohammed Ajmal Amir Qasab, said it was extracted through coercion and force.
The prosecution had read out parts of his confession as the trial began and accused him of killing 166 people.
Prosecutor Ujwal Nikam said this was a conspiracy hatched in Pakistan to wage war on India.
Friday’s opening of the trial followed a number of procedural delays.
The latest was on Wednesday when Mr Qasab’s lawyer was sacked for allegedly also signing up to defend a victim.
More than 170 people, including nine gunmen, were killed in the attacks last November.

**'Minor'**
Mr Qasab, who police say is 21, is charged with murder and waging war on India. He faces the death penalty if convicted.

Two Indians, Fahim Ansari and Sabauddin Ahmed, are also on trial, accused of being members of the Lashkar-e-Taiba militant group and of scouting for the attacks.
Mr Nikam opened the prosecution argument, saying the Mr Qasab was responsible for the murder of 166 people.
“Even though Qasab was actually not present at the time of the firing incidents in hotels Taj and Trident, and Nariman House, he can be held liable for the murders as one of the co-conspirators,” Mr Nikam said.
He said the gunmen had training from “intelligence professionals” but did not at that point mention Pakistan by name.
Mr Nikam spoke of a “major general” who had attended the training of the suspects and informed them of the use of the sea route to attack Mumbai.
The attackers were told to kill American, British and Israeli nationals as they had caused harm to Muslims, Mr Nikam said.
Mr Qasab did not smile or speak.
His new lawyer, Abbas Kazmi, claimed Mr Qasab was under 18 years of age and therefore should be tried in a juvenile court. The application was rejected.
Mr Kazmi then formally filed for retraction of the confession that was made in front of a magistrate in February.
It will be up to the judge to weigh the evidence at the trial and decide whether the confession should be taken into account.
Under pressure
India has accused Pakistan-based fighters from Lashkar-e-Taiba of carrying out the attacks. Pakistan has admitted they were partly planned on its soil.

Mr Qasab was arrested on the first day of the attacks and has been in custody ever since.
A huge security operation has been launched for the trial involving hundreds of armed police and soldiers.
Proceedings were set to start formally on Wednesday but Mr Qasab’s lawyer, Anjali Waghmare, was dismissed for “professional misconduct”.
She was alleged to have also signed up to represent victim Sri Vardhan Kar, but has denied agreeing to represent him.
On Thursday the court appointed Mr Kazmi, a top criminal lawyer from Mumbai, to replace her.
This case has generated huge interest in India, whose citizens were outraged by what they saw as the inability of their leaders to protect them in November.
India’s government is under pressure to deliver results in the case, especially with the first phase of voting in the country’s general elections getting under way on Thursday.

BBC NEWS | South Asia | Mumbai confession ‘was coerced’

Can such confession be legally admissible in a court of law, for a crime of such high degree? Do you guys think the evidence will be considered tainted now in the light of this development?

Re: Mumbai confession was coerced

^ What about video footage of Kasab shooting in CST ? That should be sufficient to send him where he belongs - to hell !!

Re: Mumbai confession was coerced

Some might argue he's already in hell. :)

I guess we'll find out whether this admission of coerced confession will have any impact on the trial precedings.

Stay tuned...

Re: Mumbai confession was coerced

Its a trend that every criminal retracts his earlier statements but the facts revealed must be corroborated with the evidences the onus of which lies with the investigators. In my opinion kasab is a victim of his poor background, this was exploited by the real criminals cum terrorists who will always remain in safe heaven, thanks to 'ever in denial mode' our Pakistan authorities who dread taking any action on Lashkar, the real culprit.

Re: Mumbai confession was coerced

That's why i think Indians need kick in their backside, we should stop investigating this useless trial and concentrate on our own problems.
Mark my words that your home grown terrorists are as much responsible as Lashkar (they can also go to hell for all i care).
How much have you done to control terrorism in your own country??? How have this terrorists managed to sit in the parliament rather than jail???

Stop giving these lectures and fix your own problems first.

Re: Mumbai confession was coerced

True...some Pakistanis might argue that. And some Indians might argue that he was trying to escape from hell :p

That does not change the fact that there is sufficient evidence to convict him.

Re: Mumbai confession was coerced

Perhaps you are not familiar with the “judicial” process … the case is not based on his confession only … there are witnessess to the crime. This is a normal tactic employed by lawyers in their defence …

Meawhile … he is still singing like a canary … getting the “pandu” havaldar treatment …

Pakistani terrorists planned to attack Malabar Hill: Kasab- Hindustan Times

In another stunning disclosure, captured Pakistani terrorist Ajmal Amir Kasab has confessed that he and his associate Abu Ismail were planning to attack the posh Malabar Hill area of south Mumbai on Nov 26 last year.

Re: Mumbai confession was coerced

Are you saying he was in Indian jail already before going out on 'adventure'?

Re: Mumbai confession was coerced

^^^
no, i think he meant India's certain friendly neighbour in its west. :)

Re: Mumbai confession was coerced

I don't buy that the terrorists are muslims at all. Its a grand lie orchestrated by Indian authorities to defame muslims. I have seen of pictures of the dead terrorists and they look very Hindu to me- short, dark and have broad noses- We don't have such people in our country. MQM goons will not do that against the Indians. Muslims names have been on the dead terrorists when in reality they might be Vinod, Rakesh, Ramesh or Ram Dass etc.

Re: Mumbai confession was coerced

^^

Also if you look closely the guy resembles N Modi. Maybe he was Modi’s son and Modi implicated him to get off the hook. It was all a conspiracy by Modi to defame Pakistan and to get his illegitimate son killed. Killing two birds with one stone…:halo:

Re: Mumbai confession was coerced

Tell you this Indian propaganda machine is hell bent uopn defaming muslims and Pakistan … look at all these hindus caught “inside” Pakistan …

Look at this suicide bomber Vindo Kumar was caught yesterday …

Would-be suicide bomber held in Islamabad - GEO.tv

Earlier in lahore police station attack Suresh Kumar Sing was caught … he was dressed as an afghan … but then he was give a bath and truth was out :).

Arrested terrorist is Afghan national: Rehman - GEO.tv

Even in the sri lankan tean attack Ramesh Chander Shukla was the mastermind … but he manage to escape … police is looking for him

Muhammad Aqeel allegedly masterminded SL team attack - GEO.tv

Meanwhile rakesh and Ram Dass are in “hiding” in Baluchistan. So you see how Indian media is defaming … tell you :D!!!

Re: Mumbai confession was coerced

:hmmm: Isnt Musharraf short & dark ? I thought he was very much a Pakistani…

Re: Mumbai confession was coerced

Re: Mumbai confession was coerced

He is Pakistani but he is not son of the soil- if you know what I mean. He is Urdu-speaking migrant. He was born in Delhi.

Re: Mumbai confession was coerced

Even Hindu and Sikh Punjabis accept that Pakistani Punjabi Pashtuns, Punjabis and Kashmiris are many shades lighter and taller than them. As you know, Hindu and Sikh Punjabis are like the most fair-skiined and tallest among all Indians. Barring Punjabis and Kashmiri Pandits among Indians, there are hardly people who are fair-skinned and/or look middle-easterner or Italian. Hritik Roshan is a Punjabi.

Re: Mumbai confession was coerced

There are some exceptions among Pakistanis. For example in S. Punjab, there are sizable Hindu converts to Islam who were untouchables, dhobis, Chamars etc.- Islam provided them opportunity to become equal with Central Asian and Arab migrants mix like us

Re: Mumbai confession was coerced

They do? i didnt know religion makes differences between people of the same ethnicity.
and you really dont know anything about India and its people, so lets leave presumptions aside. South Asian people are very varied, so to typecast S. Asian races with a colour for each is down right stupid.

FYI, Hritik has mixed lineage. eg: his grandy was a Bengali.

Re: Mumbai confession was coerced

you know **most **Pakistanis are actually converts?
Hinduism, Buddhism, Zorasterism and Sikhism were the main religions of the region before Islam.

one thing i couldnt gasp tho, being Muslim=being fair?

and then, your last line makes things much clearer to me...

Re: Mumbai confession was coerced

So atleast that proves that you were talking through your hat when you said -
