The National Coordination Council (NCC) of lawyers has announced to observe May-12 as “Black Day” to protest against the killings of lawyers and citizens in Karachi in 2007, on the arrival of Chief Justice Iftikhar Muhammad Chaudhry.
A meeting of the NCC held on Friday at the Supreme Court Lahore Registry also announced that the Black Day would be observed by a complete boycott of courts.
The meeting was chaired by President Supreme Court Bar Association Ali Ahmad Kurd and Chairman of the Council Aitzaz Ahsan and attended by its members from Punjab, Sindh, the NWFP and Balochistan.
The Council in the meeting passed different resolutions unanimously demanding the trial of General (retd) Pervez Musharraf under Article-6 for subverting constitution, the ouster of PCO-judges from the judiciary and the removal of Justice M. Bilal Khan for his alleged relations with underworld gangster, said Secretary SCBA Shaukat Umar Pirzada at a media briefing held after the meeting.
The Council thanked and congratulated the civil society, students, labourers, peasants, journalists, the PML-N, the PTI, the JI and other political and religious parties for supporting and joining the lawyers’ movement till its logical end, he said.
Passing resolution against the PCO-judges, the Council observed that the judges who took oath under the unconstitutional PCO of Pervez Musharraf on Nov-3, 2007, had violated the constitution and the order of injunction dated November 03, 2007 which was passed by the seven-member bench of the Supreme Court.
It further observed that the appointments of persons under the PCO as judges of the superior courts on the consultation of Abdul Hameed Dogar were unconstitutional and invalid.
The resolution passed by the NCC also said that Abdul Hameed Dogar was neither a valid Chief Justice of Pakistan nor was he so recognized by the lawyers and people of Pakistan. He could not thus be a constitutional consultee for the appointments of judges and all the appointments of judges from Nov-3, 2007 to March 21, 2009 were invalid.
Adopting resolution against Justice Bilal, the Council called upon the Chief Justice Pakistan, Iftikhar Chaudhry, to withdraw the judicial powers of Justice Bilal forthwith and ask the Supreme Judicial Council to act expeditiously in accordance with law so that the superior judiciary could be purged of black sheep.
Through another resolution, the Council strongly condemned the military actions and killings of Baloch leaders and fully supported the aspirations of the people of Balochistan for the provincial autonomy under the constitution.
The NCC demanded that all those responsible for the murder of Baloch leaders be immediately apprehended and tried for their crime.
Adopting resolution against Pervez Musharraf the Council held that Musharraf be tried for high treason under article 6 of the constitution while being given a full and fair opportunity to defend himself.
Ali Ahmad Kurd speaking on the occasion announced that the NCC would continue to function for the supremacy of constitution, the rule of law and the independence of judiciary in Pakistan and to save its legal system from any assault on it.
The NCC would meet at least once in two months and the secretary would make arrangements for holding of such meetings on regular basis, he said. He revealed that the meeting also discussed in depth the imposition of Nizam-e-Adl in Malakand Division and the members of the Council from NWFP and Balochistan supported its imposition. However, Kurd said the Council did not give its final opinion over the said issue, deferring the matter till the next meeting of the Council.
Chairman NCC Aitzaz Ahsan concluding the briefing expressed his deep concern over the recent unrest in Karachi and Balochistan and asked the government to settle down the situation amicably.
To a question about the ousting of the PCO-judges from judiciary, he replied that the PCO-judges would be ousted from Judiciary like Chief Justice was restored.
