Mass Graves in Indian-Occupied Kashmir

Well those who deny that there are no mass graves found in Indian Occupied Kashmir, i have news for them.

The European Parliament,

  • having regard to the recommendations of the ad hoc delegation of the European Parliament, following its visits to Kashmir from 8 to 11 December 2003 and from 20 to 24 June 2004,

  • having regard to its Annual Report on Human Rights in the World 2005 and the EU’s policy on the matter of 18 May 2006,

  • having regard to its report on the EU’s economic and trade relations with India of 28 September 2006,

  • having regard to its report on Kashmir: present situation and future prospects of 24 May 2007,

  • having regard to Rule 115(5) of its Rules of Procedure,

A. whereas hundreds of unidentified graves have been discovered since 2006 in Jammu and Kashmir and whereas at least 940 persons have reportedly been found in 18 villages in Uri district alone,

B. whereas the Srinagar-based Association of the Parents of Disappeared Persons (APDP) issued a report on 29 March 2008 indicating the existence of multiple graves in localities which, because of their proximity of the Line of Control with Pakistan, are not accessible without the specific permission of the security forces,

C. whereas the grave sites are believed to contain the remains of victims of unlawful killings, enforced disappearances, torture and other abuses which have occurred in the context of armed conflict persisting in Jammu and Kashmir since 1989,

D. whereas estimates on numbers of persons having gone missing since 1989 vary greatly between associations of families of victims speaking of more than 8000 and the Indian central and state authorities claiming less than 4000,

E. whereas a state police report of 2006 confirmed the deaths in custody of 331 persons and 111 enforced disappearances since 1989,

F. whereas human rights violations committed by the armed forces of India continue in an atmosphere of impunity despite the government of India’s commitment in September 2005 not to tolerate human rights violations in Jammu and Kashmir any longer,

G. whereas Parvez Imroz, an award-winning human rights lawyer, president of the Jammu and Kashmir Coalition of Civil Society and founder of the Association of Parents of Disappeared Persons, survived an armed attack on June 30 in Srinagar by alleged security forces’ members and whereas other members of the International Tribunal on Human Rights and Justice in Kashmir, which is being facilitated by the Association of the Parents of Disappeared Persons (APDP), have reportedly been harassed,

  1. Strongly condemns the unlawful killings, enforced disappearances, torture, rape and other human rights abuses which have occurred in Jammu and Kashmir since the beginning of the armed conflict in 1989;

  2. Expresses its concern for the safety of Pervez Imroz and other human rights activists who are investigating the unmarked graves and other allegations of human rights abuses in Jammu and Kashmir and calls on the Indian authorities to ensure their protection and allow them to operate without fear of harassment and violence;

  3. Urges the authorities to conduct a prompt and impartial investigation into the attack on Imroz Pervez, to make the results public and to bring the responsible to justice;

  4. Calls on the Government of India to urgently ensure independent and impartial investigations into all suspected sites of mass graves in Jammu and Kashmir and as an immediate first step to secure the grave sites in order to preserve the evidence;

  5. Calls on the Commission to offer financial and technical support to the Indian Government in the context of the Stability Instrument for such an inquiry;

  6. Re-iterates its call on the Indian government and the state authorities to investigate all allegations of enforced disappearances; urges to assign a civilian prosecutor’s office with the jurisdiction for all cases in which military, security or law enforcement agents are suspected of being involved, and to create a single public database of all persons who have gone missing and of all bodies which have been recovered;

  7. Calls on the state authorities to ensure that all detentions meet minimum requirements of international legal standards, proper treatment, registration and prosecution, prompt access to family members, lawyers and independent courts, as well as accountability for any violation of such procedures;

  8. Insists that victims of unlawful killings, enforced disappearances, torture and rape or their families be granted full reparation;

  9. Calls on the Indian Government to ratify and implement the UN Convention for the Protection of All Persons from Enforced Disappearance without reservations, including declarations pursuant to Articles 31 and 32 to recognize the competence of the Committee on enforced Disappearances, and to ratify the Rome Statute of the International Criminal Court;

  10. Calls on the Indian Government to grant access to Jammu and Kashmir for the UN Special Rapporteurs under the terms of reference of the UN Special Procedures, notably the Special Rapporteur on Torture, on Extrajudicial, Summary or Arbitrary Executions and the UN Working Group on Enforced or Voluntary Disappearances;

  11. Re-iterates the call on the Lok Sabha to amend the Human Rights Protection Act in order to allow the National Human Rights Commission to investigate independently allegations of abuse by members of the armed forces;

  12. Instructs its President to forward this resolution to the Council, the Commission, the Government and Parliament of India, the Government and Parliament of the State of Jammu and Kashmir and the UN Secretary-General.

Am not a saint nor perfect I would even say I am far from being a good human being.
Yet it makes me sad that daily people post hundreds times on GS.
they give their opinion about:

what to wear
what color dress is better
what ru cooking today
what drama is on
is it still on with kaif n sulman
thread with people saying they are bored
do all that
post whatever you want
but when you do not even spare 1 min to condenm
killings of thousands of Muslims in Indian occupied Kashmir then
it makes me sad.
Even non Muslims are paying attention even they are condemning the
grave human rights violations committed by Indian army.

Where we post 10 times a day just for fun then why not
condemn something so grave ass Massgraves.

For the sake of innocent Kashmiri men n women who were
killed just because they want freedom they are lying in massgraves?
Without proper islamic graves.
If not condemn lets the least we can do is pray for them.

  2. Calls on the Commission to offer financial and technical assistance to the Indian Government in the context of the Stability Instrument for such thorough investigations and possible further conflict resolution measures in Kashmir;

  3. Calls on the Member States to address the issue in the forthcoming dialogue on human rights, which is to take place in the second half of 2008;

  4. Expresses its concern for the safety of Parvez Imroz and other human rights activists who are investigating the unmarked graves and other allegations of human rights abuses in Jammu and Kashmir, and calls on the Indian authorities to ensure their protection and allow them to operate without fear of harassment and violence; urges the authorities to conduct a prompt and impartial investigation into the attack on Parvez Imroz, to make the results public and to bring those responsible to justice;

  5. Reiterates its call on the Indian Government and the state authorities to investigate all allegations of enforced disappearances; urges jurisdiction for all cases in which military, security or law-enforcement agents are suspected of being involved to be assigned to a civilian prosecutor’s office, and a single public database of all persons who have gone missing and all bodies that have been recovered to be created; calls on Member States to facilitate and support all possible cooperation between the Indian and Pakistani Governments in relation to this investigation;

  6. Calls on the state authorities to ensure that all detention procedures meet the minimum requirements of international legal standards, proper treatment, registration and prosecution, prompt access to family members, to lawyers and to independent courts, as well as accountability for any violation of such procedures;

  7. Strongly condemns the unlawful killings, enforced disappearances, torture, rape and other human rights abuses which have occurred in Jammu and Kashmir since the beginning of the armed conflict in 1989; insists that the families of the victims be granted full reparation;

  8. Calls on all governments to ratify the Rome Statute of the International Criminal Court, to ratify and implement without reservation the UN Convention for the Protection of All Persons from Enforced Disappearance, and, pursuant to Articles 31 and 32 of that Convention, to declare that they recognise the competence of the Committee on Enforced Disappearances;

Good so you have read it now ..... India has complied with most of these !!!! As India has been pointing time and again .... most of these dead are terrroists who have infiltrated from Pakistan .... since they are not taken back by Pakistan (for obvious reasons) .... they are burried in unmarked graves. As regards to the disappereance of people in Kashmir ... this is a serious matter and there are agencies involved in investigating these cases !!!!

So ... slowly the world is waking up to the attrocities of indians.

Kashmir is just the tip of the ice berg!

In Pakistan the EU calls on the Government of Pakistan to guarantee fully the fundamental rights of all Pakistani citizens, as laid down in the constitution of Pakistan and in accordance with international standards. The EU stresses the need to ensure protection of the rights of persons belonging to all vulnerable groups, including women, children and minorities, and to effectively prevent episodes of violence. The EU is concerned at the recent attacks against members of the Christian community in Punjab and urges the Pakistani authorities to swiftly bring to justice those responsible for the attacks. The EU encourages Pakistan to fulfil commitments under the UNHRC including ratification of the International Covenant on Civil and Political Rights (ICCPR) and the establishment of a National Human Rights Commission. The EU look forwards to early implementation of these instruments which will safeguard human rights in the longer term.

We are aware of the problems Pakistan is facing and never hesitate to admit those.

However, you being the largest democracy in the world - as you claim to be - should be ashamed of these indian attrocities instead of comparing always with a country where democracy was never a strong link, and hence justifying them.

India to give due consideration to EU report on Kashmir mass graves

However, other Kashmiri activists doubted the authenticity of the reports.
Sardar Shaukat Ali Kashmiri, Secretary General of the International Kashmir Alliance, said in Muslim societies anyone who dies is buried in graveyards.
Those who are rich Muslims put gravestones and signs on the graves, but the poor leave it unmarked, he explained.
“This report and video that they have shown of unknown graves does not prove in any way that they are unknown as they have gravestones on them. It is all part of a propaganda supported by the Pakistani establishment,” Shaukat Ali told EuAsiaNews.
“The situation in Kashmir is improving day by day,” he claimed.
Abdul Hamid Khan, chairman of the Balawaristan National Front, wondered how Chatterji and others go to the region and make a film and show it here if there was no freedom in Jammu and Kashmir.
“These reports are all lies,” he alleged.
Khan said if the Indian army wanted they could have easily hidden the mass graves.

That is your interpretation ..... the EU report nowhere says that India has committed "gross injustices" ... all it says that the issue of mass graves need to be addressed. Which i have explained is bascially the militants who come from across the border an get killed in Kashmir !!!!!! India is not lenient on acts by its own security forces and they have acted against people within the security agencies if they are found to be involved in illegal acts.

In any case you are nobody to decide who is worthy of Kashmir ....
