just for the record- if i went back to the uk, and husband came afterwards, say 6months to a year after me, with his visa expired-he ws on a work perm- how would he re-enter. he has already been in the uk for 4 years.

nadz, I already explained this to you in that other thread. forget his previous visa and how long he was in the UK for, "they" don't care because he's left and his visa has expired. if you cannot apply for his spouse visa (which I doubt you can now, unless you start working and earning over that threshold), it will be a visit visa.

Not for settlement, if which the first part is a spouse visa, no. He can come as a family visitor.

so the only way for settlement is by me earning 18k…
i have 2 children, what happens then, as in single parent and all that. they dont take children into account. sorry just asking.

I'm wondering if you even bothered to read my post in that other thread of yours.
Basically, you should have done the spouse visa and settlement before going back to Pakistan. I just don't understand why you didn't apply for the spouse visa as soon as you got married.
The only option now is if you come back permanently to the UK and get settled again yourself.. including getting a job and the other requirements so that you are in the position to sponsor him for a spouse visa. But that would eventually expire anyway and he would have to apply for indefinite leave to remain which would require him to also be settled here... i.e. he will only be able to go back to Pak for limited times.
If you have children, you actually need to be earning more than £18,600.

nadz doesn't need a spouse visa because she is a british citizen. it is incredibly difficult to get a work visa for the UK... given that nadz hubby had issues finding a decent job when he was actually here, i'd say it would be close to impossible.

Nadz, wait for a bit...and then consult an immigration lawyer. Im sure sooner or later they will find some loophole. They always do!
Its kind of unfair IMO. As long as the couple can support themselves and show evidence that they can it should be cool.
This will be a little troubly for all those heros working at Mcdonalds and dixy chicken!

^Dude. There wasn't a loophole before either. When I replied to her previous thread, I told her then that she herself needs to be settled with money to bring her husband over. Now they are both in Pakistan and have been there for some time. And now the rules have changed meaning, a few thousands in savings and living with her parents is not enough, she needs to earn at least the salary given above herself.
Not saying it is right but lots of people go back to Pak after the Pak spouse has secured British citizenship. Why it never occurred to these guys to so the same is beyond me.
The only other way to do it involves moving to EEA.
Or get someone to lend her that 16k or whatever it was for a few years.
