As in any other court case it can be either in front of a judge, arbitrator or a jury. If the idea is to get a divorce then just the fact that you are in a court should be sufficient. if it is to get reconciliation then it should be with a marriage counsellor or some other trusted unbiased third party.

As for evidence, calls to the police, bruising, vaganial swabs or evidence of violence in that region can all be used, as well as the spouses previous state of mind eg has he been violent before etc.

well, that still doesn't mean he has raped her...she gets the divorce but who's to say he won't do it again in another marriage cuz he hasn't been held accountable

reconcilliation i don't think there have been rules that can be held as precedence in american or canadian judicial system to go forth for a hearing

mhmm, calls the police after the act is done. she files a case and its reviewed at most just a court order to stay away till the papers are in process for injury. As for the vaginal swabs along with the rest of what you've stated, you think married women would come forth with this esp. in our culture. I doubt it.

Coconut as for the coming foward part- its a choice the woman has to make. and in the case of other cases, spouse selection in general is a buyer beware kind of trade. you do the check the other persons intentions before you get married.

Marital rape is rape so why not a jury. but yes initially the case is more likely to be before a judge alone.

Coco the buyer beware term refers to your comment about people continuing to do it with other people. what i was suggesting that if you find a guy whos already been with a woman and it ended in divorce, perhaps it would be to your advantage to find out for what reason.

which is why you as a person must be willing to overlook such supposed cultural shortcommings in women when you meet them... its a cultural change and we have to start that. Also the women have to be shown that they do have a choice and they can get out of such marriages. These things are not ordained!

PC - there is the idea of equality but there is no actual equality, otherwise we would all be made equal. Yes there should be no discrimination due to gender but that does not mean that men and women are equal. There are somethings that are better done by women and some by men.

I meant equality in terms of opportunitites, treatment, and rights.
