Looking for U.S. fiance/spousal immigrantion info. .... pls help if have knowledge

us1415 - O.K. here's some info. I am not too clear on some of it.
I-130 is petition for greencard.... 2 year process.

Once the petition is filed, a receipt is received that the application is received along with the case number.

Immediately, the K3 application (application for immigrant visa) is filed along with the I-130 receipt which states the immigration application case number. In your case, you will need to include the K1 refusal letter. This will help cut down the time.

Write a letter with the K3 application stating that they were wrong in believing that both of you were engaged. The premise of their rejection is and was wrong. The rejection was stated on the basis of lack of a meeting between the parties to be proved by pictures. Included are the marriage licence, pictures, reciepts of shopping/hotel stays, etc. to prove that both parties were engaged to each other and are now married.

Once the approval for K3 is received (~ in 60-90 days), the applicant in Pakistan contacts the U.S. embassy for an interview.

The embassy will tell the caller what paperwork is needed.

The financial support affidavit that you mentioned earlier is one of the forms that you wife will need to take with her. In my friends' case, the lawyer is putting together a packet that will be sent via courier. I don't know what all will be in that packet.... but that's to be taken to the embassy. If you are interested, I can "try" to find out what's in the packet when it is received so you can setup similar forms for your wife. These will be forms/information that the embassy will ask the applicant to bring to the embassy.

The embassy will notify the caller of an interview date within a week.... could be 2 weeks.

Once the embassy approves, the applicant is free to fly out immediately.

Once here, the I-130 continues to stay in the pipeline until the time comes for granting the greencard.

I think there's something like ....... "Change of Status...?" that needs to be filed afterwards. I am not clear on this one.

I am sure I might have made some mistake in understanding something here..... if you have questions, please ask. I'll see what I can do.

us1415 - Mind you... these are state timelines from the lawyer. As you see, above from Rukhsarbibi's comments, the reality could be very different.

But in your case, your "wife" is coming over. In her and my friend's case the "husband" is coming over. Their focus is much higher on males then on females. If this is true then your wife could be here with a month, inshaAllah.

This is still true but for Americans living in Canada. The "Landing Permit" is still being granted (for immidiate immigration) to those going to Canada after marriage with their spouses.

i was going to submit I-129F for K3 visa (which is fiance visa for spouses) but then the time line on that is more than 6 months to just being approved. So I decieded to see what will happen with my I-130 as I was suspecting to be approved in 2 to 3 months which is good since it got approved in about a month and a half so I cant even apply for I-129F since my I-130 isnt pending anymore. Now since my I-130 is a immigrant visa it will take some time after getting to the National Visa Center who takes on the petition after it gets approved from USCIS. I know that NVC got my approved petition from USCIS on Oct 8th 2004 and now I m waiting for them to send me some paperwork for a I-864 (affidavit of support) which since i m in US will have to be submitted before the case is sent to Pakistan Embassy in Islamabad.....I m very curious to find out how long it takes in a situation like this......

Seems like all the questions have been answered, but if anyone has other questions about the k1 visa, I might be able to help. I just filed less than two weeks ago and already my paperwork has been processed and approved.

That's good news, Sahar02. When all the blanks are filled then this step, atleast, works like a charm. Since you are going through the K1 process, can you keep us up to date here? Sahar02, that would be great if you could.

us1514 - I don't get it. You said your I-130 is "approved" and within 6 weeks and now you don't need a K3 visa for your wife? If the I-130 is approved then that's very interesting. Haven't heard of a petition being approved in such a short time. You are right, if the I-130 is approved then there's no need for the K3 and her interview with the embassy... why the need for financial support info then? or is it still required for her to come here? Wouldn't your wife need a immigration visa to come over.... which initeself is a K3? I am confused.

I will scan/email you the documents when I know they have come. If they are of legal size....... I'll talk to you via email if I have question on getting the documents over to you.

Congrats!!yeah that is great!!K-1 is the most of the easiest visas that you can apply for with USCIS....mine was denied cause i couldnt get a pic of me and my fiance's (now my wife) together!!!

Yeah its a I-130 thats approved for a spouse...now a days USCIS has instructed its service centers to give priorty to all the IR (Immediate relative) of a US Citizen's cases....I send my case to the Nebraska Service Center and it forwarded it to the California Service Center....It was approved in about a month and a half.....now I m waiting for the NVC (national visa center) to send me a DS-3032 (agent and address choice) this form is for my wife to decide where she wants all the correspondence from NVC to go to...I already have had her download the form and sign it and send to me ASAP which would be in a few days...and a bill for I-864.....a processing fee of $ 65 that has to be paid by me to the NVC....after I will forward them the DS-3032 and the money order for the I-864 they willl send me a I-864 package to fill out..which I have already kind of filled out but I want to see if there is a new version of it out there...after I send them the I-864 they will send the paper work for IV application to be filled out by my wife and a bill of visa processsinng thats about $335...after I get my wife's signature on the forms I will fill them out and send it back to them with the processing fee....they will then send my case to the islamabad embassy and from there my wife will get an interview date......this is how the process is looking....thats why I was saying in my previous reply that the K-1 or K3 visas are the easiest cause they dont need all this paper Work!!!Now I m not sure if my birth in america would help in any way in this process....
I will keep you guys updated as this moves along....

us1415 -- I filed at the Vermont service center. I also had tons of supporting documents (all requested photos, letters of intent to marry, mangni photos, copy of marriage licence, etc etc...).

great!!vermont is the fastest of all the service centers!!you are very lucky!!!congrats again!!Now the process is better for then it is for me cause you dont have to deal with NVC (National Visa Center) as much as I have to....cause as soon as you guys get married you will have to file I-130 and I-485 (change on status) so its not looking too bad for you!!!

Below 18? No question about it that they will give you an extremely hard time. It's like making a kid do something...

Have you heard of similar situations and associated legal problems? If thats the case then maybe they are over their heads on this one...?

it is hard but shouldnt be a problem.....as long as the kid can show domicile in US and get an affidavit of support....!!!
