Lawmakers holding fake degrees could face criminal cases: CJ | Pakistan | DAWN.COM

ISLAMABAD: The Supreme Court of Pakistan’s Chief Justice Iftikhar Muhammad Chaudhry said on Monday that lawmakers holding fake-degrees could face criminal cases and gave 189 lawmakers, who had not submitted their educational certificates, time until April 5 to submit their documents for verification, DawnNews reported.

A three-member bench of the apex court, headed by Chief Justice Iftikhar Muhammad Chaudhry, resumed the hearing of the case pertaining to lawmakers with fake degrees.

During the hearing, the chief justice said that the degrees of 54 parliamentarians were declared as fake whereas 189 lawmakers had failed to submit their matric and intermediate certificates since the past two and a half years.

He added that according to the Constitution of Pakistan members of parliament could face criminal prosecution for intentionally submitting false statements and that the submission of fake degrees by lawmakers was in violation of Article 62 of the constitution.

Chaudhry further said that degrees should be issued from approved institutes and that the matter of degrees should be like an open book.

Secretary of the Election Commission Ishtiaq Ahmed told the court that the Higher Education Commission (HEC) had informed the commission in writing about 69 cases of fake degrees held by lawmakers and that the cases were forwarded to the relevant courts for criminal proceedings.

Ishtiaq further said that FIRs were lodged against 21 lawmakers who held fake degrees and that the names of lawmakers holding fake degrees were uploaded on the election commission website, along with the list of parliamentarians/Members of Provincial Assemblies disqualified under Article 63 (1) (c) of the Constitution and lawmakers who had not declared their details regarding dual citizenship.

The bench adjourned the next hearing over the case until April 8 and advised the election commission to send a notice to the 189 lawmakers, as a last chance, giving them time until April 5 to submit their educational certificates for verification, failing which they would declared as disqualified.

Moreover the court instructed the ECP not to accept the nomination papers of the 189 lawmakers for the upcoming elections until the matter of their respective degrees was not resolved.

Courts spring into action against deceiving lawmakers | Pakistan | DAWN.COM

ISLAMABAD: Different lower courts in many cities took action on Tuesday against those legislators who had submitted false declarations regarding their nationality and educational qualifications, DawnNews reported.

Former federal minister Humayun Aziz Kurd was sentenced to one year jail and fined Rs 5000 for submitting fake degree to the election commission. Kurd was arrested from the courtroom following the sentencing, and police officials said he has been sent to the district jail city in Sibi, Balochistan.

Dera Ismail Khan’s Additional district and sessions judge Justice Hayat Khan sentenced a former Member of Provincial Assembly (MPA), Khalifa Abdul Qayyum, to three-year imprisonment and imposed a fine of Rs 5000 over fake degree after which the former lawmaker was immediately sent to lock up in Central jail.

Qayyum was elected from PF-64 Dera city 1 in the 2008 elections as an independent candidate.

Earlier Khalif Abdul Qayyum’s had claimed that the degree issued to him by the Ittahadul Maddaris Al Aarbia in Mardan was equivalent to MA Islamiat after objection related to the credentials of the seminary were raised by a committee supervising the verification of legislators` academic degrees.

Additional districts and sessions judge Tariq sentenced former Member of National Assembly (MNA) Javaid Iqbal Tarkai over possession and redeclaration of dual-nationality.

Javaid Tarkai allegedly held citizenship of Canada which he had neither declared nor relinquished and was elected from PF-32 Swabi II as an independent candidate defeating Awami National Party (ANP)’s candidate Ameer Rehman in the 2008 elections.

Courts also issued non-bailable warrants against Balochistan’s former MNAs Nasir Ali Shah and Maulvi Haji Roziudding over the fake degree issue.

Nasir Ali Shah had recently joined the Balochistan National Party – Mengal (BNP-M) after being elected in the 2008 elections on a Pakistan Peoples Party (PPP) ticket.

Similarly Maulvi Haji Roziudding had joined the Pakistan Muslim League – Nawaz (PML-N) after contesting the 2008 election with the PPP.

Moreover the hearing over the case pertaining to fake degree possessed by former MPA of Khyber Pakhtunkhwa province Aqil Shah belonging to the Awami National Party (ANP), who was elected from PF-4, resumed at a court in Peshawar.

Re: Law makers with fake degrees could face criminal charges

The entire focus on degrees and dual nationalities is absurd while money launderers and commission agents get a free pass. Steal a billion, go the parliament. Degree not attested/fake? go to jail for 3 years! I have seen mass murderers spend less time in jail than that. Screwed up priorities.

But we certainly don’t want to see illiterate besharam idiots like Raja Riaz in our parliament!

Re: Law makers with fake degrees could face criminal charges

Although I am not in favour of military rule, this is one of the biggest problems I have with desi democracy; that complete idiots and jaahils like Raja Riaz, Jamshed Dasti, Aapa Firdous etc. get party tickets (& become 'law-makers') just because they are electables! (a sad reflection on our illiterate & corrupt society)

Re: Law makers with fake degrees could face criminal charges

^^^ Be realistic. Democracy cost money. Not money of state but money from donation or of people who contest election (most of the time, if money is of candidates then it is state money looted by candidate in their past opportunities).

In third world democracy people do not like to give donation to political parties (neither they could afford). Thus, except in case of few parties (MQM and JI), most parties depend on people spending their own money to contest election.

Parties where candidates spend their own money to contest election, parties cannot stop candidates from doing corruption to regain their spent money and much more, neither party have choice to look at moral values or educational capabilities of candidates. Only thing such parties look in candidate is their electability.

Worse is that, most parties in this category (who depend or intend to depend on electable) are led by people who own the party by hook (Imran Khan type), crook (Nawaz Shareef type) or inheritance (Zardari, Asfandyar Wali, Fazlur-Rahman type).

Purpose of such parties is also not serving nation but serving person whose private business (private limited company) is the party. So, for them, electable are business customers who can get elected and give them huge profit of ruling and looting the country.

So, as long as Pakistanis would love to support parties on their personal feelings, profit, or connections (Bradarism, Provincialism, hero-worshiping, self-interest, or whatever), without questioning or seeing that party relies on rich electable, and Party leaders are themselves mega rich rather from their own class, Pakistanis should not question morality, honesty, capability, education, reliability, commitment, and serving desire of candidates, rather they should be happy with whatever they get (democracy is best revenge and would keep taking revenge from Pakistan due to these ‘self-centred and self-serving’ Pakistanis).

Re: Law makers with fake degrees could face criminal charges

PTI is different imo because they have had intra-party elections. IK may have founded the party but he cannot serve more than two terms (i.e. no family llimited company) and all the top leadership has declared their personal assets and taxes. They may not be ideal but they are certainly going in the right direction. It is unfair to judge them or to put them in the same boat and treat them the same as they have not been in power yet. Hero-worshipping happens in other countries as well (Black/Hispanic/Female voters & Bill Clinton/Obama etc.). PTI also relies heavily on peoples' donations (because IK has financial credibility. his social projects are there for everyone to see). I don't think the party or his social projects could survive otherwise

And I do not have a problem with electables as long as they are decent educated people like SMQ, Hina Rabbani Khar etc. ... I am sure there are many others in all the parties. My problem is with jaahils and idiots like Raja Riaz etc.

Re: Law makers with fake degrees could face criminal charges

^^^ I would not like to go in details on PTI, as my purpose is not to target a party that never came into power, neither I believe has chance to come into power, unless anyone really demand that one start discussing PTI.

[Note: What I know, only 17 PTI officials declared their personal assets (even that without any scrutiny on declaration, as yet), and not everyone in the party has declared their personal assets. On the other hand, most in the party leadership are from other corrupt parties, are electable who spend huge sum to get elected so that they can loot further, and have reputation of corruption from their past history]

Leaving PTI alone, I would like to show reputation of most popular Pakistani party leaders and ‘faces of Pakistani democracy’ all over the world, leaders Pakistani seems to love (even on this forum). For instance:

Look at what world educated and knowledgeable people, people who know not only democracy, but know all three thugs (BB, Z and NS) very well, as these three thugs whenever out of power used to go to them and beg them for hearing and help to come to power again.

Normally when a person dies, people try to remember that person without mentioning bad about them (that is norm all over the world). But people like BeNazir, Nawaz, and Zardari are in different league, as even when they die or would die in future, people would remember them as devil reincarnate … except those who are corrupt and benefitted from them and their corruption.

This video is recording of time when BB got killed. It tells not only about BeNazir and Nawaz Shareef, but Zardari too, classifying them as con, thief and corrupt … a black spot on the name of democracy.

So, listen and know how world remembers BeNazir and how world would keep remembering Nawaz and Zardari even after their death (there is glimpse of what world thinks of these three in the video) … a very important video for any forum on Pakistan Affairs, that every Pakistani should see to know the reality of their leaders throughout the world.

Video is slap on the face of those who lie on TV talk show, that BeNazir was leader of world stature … as she was only a con person, thief and corrupt of world class stature… person who used democracy to fool the largest Muslim country
