LUCKNOW — The Supreme Court’s second-in-seniority judge, Rana Bhagwandas is seeking spiritual solace here, far from the tumult at home where the sacking of justice Chaudhry has led to huge protests against President Pervez Musharraf.

Justice Das has been in Uttar Pradesh capital for the last 20 days. He returns to Pakistan on March 24. He is a regular at the daily ‘satsang’ (spiritual discourse) by guru Ma Lilu Sajnani here. He was also seen at key functions to celebrate the Sindhi festival of ‘Cheti Chand’, which marks the commencement of the Sindhi calendar

The judge, who will soon find himself at the centre of a growing political storm back home in Islamabad, has been maintaining a low profile here, refusing to meet the media or even accept the hospitality of the top brass in the state administration or the judiciary.

“I have come here solely on my routine spiritual mission and would like to confine myself to this,” he is said to have told a senior judicial official who wanted to invite him. “He even declined to accept the official protocol offered by the state government and prefers to live here like an ordinary humble devotee,” disclosed Mukesh Jashnani, a well-known trader who has been interacting with the Pakistani VIP since he arrived here.

“I have not seen such a simple person in my life,” Jashnani said.

^He is a very modest man indeed. Just saw him on Geo TV where his only comment was everything will be done as per law and constitution and refused to comment any more by saying nothing will be done verbally, all the comments will be done in writing.

**LIFE-SKETCH: **Justice Rana Bhagwandas was born in Naseerabad, Larkana district, in December 1942. He did an LLM from Karachi University in 1981. The subject of his thesis was the law of contempt. He also has an MA in Islamic studies.

Justice Bhagwandas joined the judicial service in July 1967.

He was elevated to the Sindh High Court in 1994 and joined the Supreme Court in Feb 2000.

Besides graduation in law, he has also done masters in Islamic Studies.

Justice Bhagwandas is a father of three — two sons and a daughter.

Pakistan as state had nothing to do with religion of individuals (that is teaching of Islam too). As being citizen of Pakistan, all are equal and should be equal, and have same rights and duties in Pakistan (does not matter what other countries treat their citizens, as that is their matters).

As far as beliefs or religion is concerned, most of Kafirs are Kafir because they were born amongst parents who were Kafir and most Muslims are Muslim because they were born amongst parents who were Muslim, thus religion most following is because of the beliefs of their parents and people of their community. Very few normally change their religion what they were born in. This is way of Allah so let Allah decides about individuals after death.

Nevertheless, humans are born human because their parents were humans and thus humanity is same for all. Those who are good human, be they Muslim or Kafir, are much better then those Muslims who abuse and accuse others and religion of others, and even go to a level below Shaitan, when they take life of innocent others on differences of beliefs (and quoting Quran out of context to support their actions). Well, these retarded jahannamu so-called Muslims become suiside bombers and take innocent life of others they do not even know. Their suicide becomes one way ticket to the bottom of Jahannum.

According to the words of Allah in Quran! Words that is undisputable (or should be undisputable amongst Muslims, even though some retards claim that it is undisputable for them, but in reality, they do not believe even on Quran)

Surah Al Anam (6), ayah 107:

YUSUFALI: If it had been Allah’s plan, they would not have taken false gods: but We made thee not one to watch over their doings, nor art thou set over them to dispose of their affairs.


PICKTHAL: Had Allah willed, they had not been idolatrous. We have not set thee as a keeper over them, nor art thou responsible for them.


SHAKIR: And if Allah had pleased, they would not have set up others (with Him) and We have not appointed you a keeper over them, and you are not placed in charge of them. ****

It is clearly mentioned in above ayah that, if Allah wanted to, there would have been no Kafirs** (unbelievers or idolatrous). Further Allah says that Allah has not made anyone to keep watch over what they do (that is, Allah has not made Muslim or anyone to be watchers, keepers, criticizers, or abusers of what non-Muslims do), **nor Allah has made Muslims responsible of their beliefs. **[Though some so-called Muslims who are themselves unbelievers, believe that it is their responsibility to abuse, accuse and criticize non-Muslims and become responsible of them and their beliefs too].

The most important ayah in Quran regarding treatment of Kafirs and their beliefs is the ayah following above ayah, where Allah clearly stops Muslims to revile(abuse, scorn, condemn, despise or insult) Non-Muslims or their religion (or those they worship).

Surah Al Anam (6), ayah 107:

YUSUFALI:** Revile not ye those whom they call upon besides Allah, lest they out of spite revile Allah in their ignorance. Thus have We made alluring to each people its own doings. In the end will they return to their Lord, and We shall then tell them the truth of all that they did.


PICKTHAL:**** Revile not those unto whom they pray beside Allah lest they wrongfully revile Allah through ignorance. Thus unto every nation have We made their deed seem fair. Then unto their Lord is their return, and He will tell them what they used to do.


SHAKIR:**** And do not abuse those whom they call upon besides Allah, lest exceeding the limits they should abuse Allah out of ignorance. Thus have We made fair seeming to every people their deeds; then to their Lord shall be their return, so He will inform them of what they did. **

As the result of reviling by Muslims of non-Muslims would be that they (Non-Muslims) would revile Islam and Allah in return too. Ayah clearly shows that these so-called Muslims who revile religion of others disobey Allah and thus would be punished after death, as they cause others (non-Muslims) to revile Islam and Allah. Recent example is Al-qaida, Taliban and other so-called terrorist (who call themselves Jihadis) and from their actions and verbal abuse, cause non-Muslims to revile Islam, Prophet Muhammed (SAW) and Allah and consider that Islam is evil religion of terror.

**Further, Allah has clearly said (in above ayah) that in the end all will return to Alalh and it would be Allah that would tell them what they did (what anyone, believers and un-believers followed in this life and why?). This duty is clearly taken by Allah as his right and thus it is not right of these retards who claims to be theirs.

Justice BD is also a very good poet and lover of Cricket... he also wrote few Naats of Prophet(peace be upon him)...as many other hindus also wrote very beautiful Naats in past ......the personality of Muhammad(peace be upon him) is so great and just that all religious individuals pay tribute to him ...Wa Rafana laka Zikrak(and for you we made your zikar buland) as in quran.....

while on New Delhi irport..a large no. of Indian journalists were gathered at2.30 pm locally when BD wascoming to Karachi on PIA flight...they tried hard to inquire his comments..this brave man never uttered a single word ..he said to his relative that .." tell them ..i will not say a single word about my country's internal matter in other land.....tell them that i will not say a single word that can bring a least sense of degration of my country Pakistan or its people..." with this he left the journalists and went to check in....

this shows his just behaviour , greatness and patriotism......

in plane when some journalist ask him about the matter ...his reply was ." Judges give justice ..not interviews......"

we hope that he will look into the matter of CJ justly and freely ...

Justice Rana Bhagwandas appointed Acting Chief Justice of Pakistan

ISLAMABAD, Mar 22 (APP): Senior most judge of the Supreme Court of Pakistan after Justice Iftikhar Muhammad Chaudhry, Justice Rana Bhagwandas has been appointed Acting Chief Justice of Pakistan here on Thursday by the President.

According to the official notification issued by the Ministry of Law, Justice and Human Rights here on Thursday, “In exercise of the powers conferred by Article 180 of the Constitution of the Islamic Republic of Pakistan, the President is pleased to appoint Mr.Justice Rana Bhagwandas, the most senior judge of the Supreme Court, to act as Chief Justice of Pakistan with effect from the date he resumes his office.”

Justice Rana Baghwandas, the senior-most judge of the Supreme Court after Justice Iftikhar Muhammad Chaudhry will take oath on Saturday. The oath taking ceremony will be held at ceremonial hall of the Supreme Court Registry, Karachi.

According to Supreme Court of Pakistan, Justice Javed Iqbal ,Judge, Supreme Court of Pakistan, will administer oath in the oath-taking ceremony scheduled to be held in the Ceremonial Hall of the Supreme Court Registry, Karachi.

The oath-taking ceremony will be attended by Judges of the Supreme Court available at the Karachi Registry, Law officers, Advocates and Advocates on Records besides senior officers of the Supreme Court.

Justice Rana Baghwandas will perform his duties as Acting Chief Justice according to the notification issued by the Law & Justice and Human Rights after his appointment by the President under Article 180 of the Constitution.

Bio-data of Justice Rana Bhagwandas is as follows:
Justice Rana Bhagwandas was born in Naseerabad, Larkana district of Sindh on December 12, 1942 and completed his education from various institutions of the province.

Justice Rana Bhagwandas also did Master in Islamic Studies after completing his L.L.B and L.L.M.

He joined Bar in 1965 and continued his practice about two years. After having short term of practice as an advocate, he joined judicial service in July 1967.

He was elevated as judge of the Sindh High Court on June 6, 1994 and then elevated as judge of the Supreme Court of Pakistan on February 4, 2000.

Law allows a non-Muslim head of judiciary: Fazl

LAHORE, March 22: Prominent Muttahida Majlis-i-Amal (MMA) leaders said on Thursday they did not agree with suggestions that Justice Rana Bhagwandas should not be sworn in as the acting chief justice of Pakistan because he was a non-Muslim.

MMA secretary-general Maulana Fazlur Rahman told Dawn that the alliance believed in the supremacy of the 1973 Constitution which only barred a non-Muslim from becoming the state president and prime minister but did not bar a non-Muslim heading the superior judiciary.

The Maulana said Justice Rana Bhagwandas had performed duties as the acting chief justice more than once in the past without anyone objection to it. “We wish the state was governed by the tenets of the Islamic Shariah. Our problem is that we do not have the Shariah and the only course left for us is the 1973 Constitution,” Maulana Fazl said.

“If we do not apply the constitution to resolve our problems, we could land in another crisis,” he said and added that the constitution had a solution to the situation.

To MMA’s senior vice-president, Senator Prof Sajid Mir, the question of a non-Muslim heading the superior judiciary was irrelevant and unwarranted.

Talking to Dawn, Prof Mir, the amir of the Markazi Jamiat Ahal-i-Hadith, said the people who had opposed Justice Rana Bhagwandas’s appointment as the acting chief justice of Pakistan either had no political status or they were serving certain vested interests.

“There is no such provision as to bar a non-Muslim to be appointed as the chief of Pakistan or, for that matter, the armed forces,” Prof Mir said.

He said religious parties wanted an amendment to the 1973 Constitution to ensure that a Muslim alone could be the chief justice or the chief of armed forces. But until the change was made, there was no bar on a non-Muslim to head the country’s superior judiciary.

Prof Sajid Mir said the delay in the ARD-sponsored multi-party conference in London had “certainly not gone in favour of the opposition”. But he did add the PML-N had postponed the MPC consultation with the MMA on the current situation.

He advised Pakistan People’s Party chairperson Benazir Bhutto to review her stance regarding the MMA because “unity in the opposition’s ranks was the need of the hour and anyone looking beyond the democratic struggle to gain power, would suffer”

ACJP advises patience on Presidential reference

KARACHI ( 2007-03-24 14:42:57 ) : Acting Chief Justice of Pakistan, Justice Rana Baghwandas on Saturday said that the matter about the Presidential reference against Justice Iftikhar Muhammad Chaudhary is subjudice before the Supreme Judicial Council (SJC) and any comments on the same should be avoided.

He also said that let the SJC decide about the Presidential reference against Justice Iftikhar and wait for the verdict of the Council.

The Acting CJ stated this while talking to media after taking oath as Acting CJ of Pakistan at a ceremony held at SCP Karachi Registry.

**Earlier, the second senior most judge of the apex Court of Pakistan, Justice Javed Iqbal, administered the oath from Justice Rana Baghwandas.

To a question, he stated that the SJC would also hear the arguments of Justice Iftikhar Chaudhary to decide about the objections raised by him about composition of the Council.

Acting CJ said the SJC would also decided about holding open proceedings into the Presidential reference against Justice Chaudhary.

He said that he was not entitled to give any verdict, single handedly, about the Presidential reference against Justice Iftikhar as the matter would be taken up by the SJC as a whole.

He said that “this is subjudice before the SJC, so the issue would be taken care of when hearing takes place at SJC and arguments are advanced”.

**Replying to a query, acting CJ said that the SJC would also decide about other pending reference before the council against other judges.

He also said that all possible measures would be taken in accordance with the constitution and law to maintain the supremacy of law in the country.

Earlier, on arrival at oath taking, the second senior most judge of the SCP after Justice Rana Baghwandas, Justice Javed Iqbal, said that the SJC is competent authority to decide about the Presidential reference against Justice Iftikhar Chaudhary.
