Islam and Marital Rape

Is there any concept of marital rape in Islam.

From the emphasis of following particular hadees repeated time and again, it appears that this concept is either alien to Islam or Muslims don’t want to bother on this aspect.

Marital rape is a relatively new concept. I don't think it existed in the 7th century. What's sad is people choosing to live according to the 7th century laws.

But Islamic law is not stagnant. I mean you can see fatwas being popped up on even small issues like samosa eating, ladies driving, etc. Now, I have to see if there is ahadess where angels curse husband, if he does not accommodate wife's wishes.

Religion was created by men so who do you think it will benefit the most? Why would they change something that has worked for them for centuries?

Maybe the first feminine organism was also created by men as most of female organisms tend to be submissive to male organisms. :D

Can you elaborate these technical terms and how does this relate to topic under discussion. Any hadees where angels curse husband not fulfilling wife's wishes?

what qualifies as marital rape. please define. once you state that, only then it can be figured out whether it is prohibited/allowed, what is the reference etc.


Regarding the hadith, i read a blog by a female student of Islam that made a lot of sense to me but idk how much truth it holds. It was regarding the hadith of angels cursing wife for refusing her husband etc. The traditiinal translation of the hadith makes reference to the wife refusing the "bed" or something, and so in modern times it is automatically assumed to mean sexual. She explained that in the time of the Prophet however, living arrangements were more like dorms where the couple had a separate 'room' for their own privacy where other couples also lived. So when the husband approaches his wife, it's presumed for privacy/to make amends in marital issues. Changes the context and meaning of the whole hadith.

If anyone can shed some light on it, i'd love to know more.

to keep it simple, lets say 'its sex without consent of the wife'. Now point out, if Islam prohibits that or we should go by that popular hadees.

I don't think that living arrangements were different than today. separate room for a couple. In case of multiple wives, the house divided in hujras as was the case with Prophet's own wives.

If wife denies when husband genuinely need sex what husband should do? Do you think it is logical that husband should go to some other women when his wife is not allowing him?

Is there a concept of rape in Islam? I've read about extra/pre-marital sex being haram but never about rape. That is not to say that Islam doesn't address that, only I haven't read/heard about it and it's not emphasized much.

My opinion: Islam is probably okay with raping slaves and wives. You own them and provide for them so they're yours to take.

why should he go to other women? Why do we look at extremes all the time?

Why do not a husband try to find out reason for denial and sort it out with wife. There might be some genuine reason for that.

I don't think lack of sex for a night would kill the guy and the only way is to resort to forced sex or find out another woman.

I've heard refusal of sex is a valid grounds for a divorce - regardless of gender.

When I googled, I found this fatwa from Egypt. Though the issued discussed in fatwa do tend to portray something about consent and tenderness during the act, but if we look at whether fatwa addressed original matter, it appears that it was knowingly deviated from the first paragraph. It says ’ Marital rape occurs when a man asks for sex during wife’s menstrual period or in abnormal sex position or during fasting’.

Another Fatwa from Malaysia says what is exactly the hadees in OP is all about i.e. ‘Marital rape is not a crime, and a woman must always submit to a husband’s demand for sexual intercourse, according to a recent fatwa issued by a leading Islamic scholar in Malaysia.’

Is this based on some hadees or verse from Quran?

I kinda remember that a statement from a lady 'I don't like my husband' is good reason for divorce.

If you're spouse doesn't want to have sex with you at all what other options due you have. Muslims hold off on having sex until they get married. The promise of sexual intimacy is a big selling point for marriage. Wouldn't be too nice if you had to take care of yourself(all the time) even after you get married.

Exactly, nor will wife die if she have sex while thinking she is not in mode. Also if there are some genuine reasons like medical one then i dont think a good husband will persist.
