Manage Alerts | What Is This? NEW DELHI, India (Reuters) – A Muslim couple in India have been told by local Islamic leaders they must separate after the husband “divorced” his wife in his sleep, the Press Trust of India reported.

Sohela Ansari told friends that her husband Aftab had uttered the word “talaq,” or divorce, three times in his sleep, according to the report published in newspapers on Monday.

When local Islamic leaders got to hear, they said Aftab’s words constituted a divorce under an Islamic procedure known as “triple talaq.” The couple, married for 11 years with three children, were told they had to split.

The religious leaders ruled that if the couple wanted to remarry they would have to wait at least 100 days. Sohela would also have to spend a night with another man and be divorced by him in turn.

The couple, who live in the eastern state of West Bengal, have refused to obey the order and the issue has been referred to a local family counseling center.

“This is a totally unnecessary controversy and the local ‘community leaders’ or whosoever has said it are totally ignorant of Islamic law,” said Zafarul-Islam Khan, an Islamic scholar and editor of The Milli Gazette, a popular Muslim newspaper.

“The law clearly says any action under compulsion or in a state of intoxication has no effect. The case of someone uttering something while asleep falls under this category and will have no impact whatsoever,” Khan told Reuters.

The conclusion one can draw is that Indian Muslim scholars are distinctly odd. You rarely hear of such cases, even in Pakistan which shares the same variations of Islam as India.

most of these strange indian muslim jurisprudence issues trace back to the deoband and their scholars/rulings.

i thought the deoband was a well-respected institution?

where does this "saying talaaq 3 times" come from anyway? There's NOTHING in the Quran that says that to divorce a woman you have to say talaaq 3 times. IMO these are more fabrications made by our esteemed Mullahs.

Anyone who’s studied even the basic Islamic principles knows that the “triple Talaq” is a form of Bid’a…

I think the Hanbali school of thought is pretty stringent on this form being a bid’a, while the Hanafi and Shafai condemn it greatly.

The most preferred way from what I’ve read is the “Ihsaan” whereby the husband makes one pronouncement of divorce to the wife, in an interval between Tuhr (menstruation), in which no sexual intercourse with the wife has taken place. After which she is left until her Iddah (waiting period) is over.

According to the Ahadith (will have to look these up), the other way is to pronounce three divorces in three separate intervals of Tuhr, in which no sexual intercourse with the wife has taken place.

So all in all, people who know a little about the Quran and Sunnah will know that there are safeguards which preclude the possibility of the pronouncement when one is not in his senses, and those where there’s a possibility that the woman may have conceived.

Why is it that every other day the so-called Muslim scholars in India come up with more and more ridiculous rulings?

First of all, there's no such thing as triple talaqs in one instance. Secondly, if the guy was unconscious (sp?) or muttered in sleep, it wouldn't even count as a single instance of talaq.

Deobandis in Pakistan don’t seem to end up giving such odd fatwas as we keep hearing coming up in India.

i remember watching quite a few pakistani dramas ...u know the man going "main tumhe talaq daita hoon..." 3 times and the woman going "nahiii! nahii! nahi!!"
i mean it does send off a signal to people that this is how divorce is carried out.
i dont think they show this anymore though.

Captain1, the whole post was intended to show how there are provisions for even the minutest of details, and how divorce is more of a "process" than a "decision"... so an instantaneous blether, and that too while being semi-conscious does not really amount to anything.

to the uninformed mind- yes it is. the drama shows pakistani people, which are muslims, and them carrying out the triple talaq sends out the signal that this is how its done.
