India believes all of Kashmir (including the part that’s occupied by Pakistan) is a part of India, so its not going to recognize anything to the contrary.

Lets ignore that for a minute and assume that the UN resolution should be implemented. The biggest roadblock there is Pakistani occupation of Kashmir. A precondition for the plebiscite is to return it to the 1947 situation i.e. Pakistan needs to get out.

Well India is wrong then isnt it. You know aswell as I do.
If you know your history, then you know that india only accepted the ascesion of the ruler of Kashmir to india, pending a formal referendum. It is why it accepted atleast initially that the Kashmiri people were the ultimate arbitrators of their own fate. Then it reneged on its promises and made excuses and now refuses to allow them the right of self determination. Ironic.

Pakistanis arent occupying Kashmir. Nothing in Pakistan’s constitution assumes that Kashmir is part of Pakistan. Unlike India, pakistan does not claim that “Kashmir is an integral part.” Pakistan has always believed Kashmir to be a disputed territory, and shall remain as such pending a resolution through a plebiscite. Pakistan does not view Kashmir as it 5th province. Its not against Pakistan that the Kashmiris have been trying to gain their freedom, its India. So india has been deceitful, and duplicitus through out. Its only claim to Kashmir is through its Army and the gun barrel.

Regardless, does the presence of Pakistans soldiers justify India’s current position of no plebiscite under any circumstances ?

Lets say Pakistan does get every single soldier out, and lets assume the Indian dont use the oppurtunity to invade. Do you think the Indian govt will honor its commitment in holding a referendum on the final status of the state? Be honest with yourself.
