it is not a sin to marry a hindu. i think the marriage is declared invalid.
If the marriage is invalid and a Muslim has intercourse with Hindu spouse, isn't that a sin (to have sex with someone you are not married to)?
If I understand you correctly, this is like if A = B and B = C, then A = C.
