I don't know about their constitutional status , but technically and practically ' Yes ' and remember it is their third generation perhaps .

The Kashmiris have a special status in Pakistan, that's why they have their own assembly, prime minster and president. The Kashmiris living in Pakistan can vote for those assemblies as well as Kashmir elections, secondly Kashmiris can buy property in the country but we cannot buy property there. Their status is due to the undecided nature of the conflict that's it otherwise they are as much Pakistanis as any one else.

No he is among Punjabi Muhajireens who crossed a line of fire and blood but the wise Mian Shareef reached Lahore befre this and availed the chances like late x-Hawaldar Ch Zahoor Ellahi . You can count father of IK and his in-laws in list too .

Well nawaz sharif is basically a Kashmiri but there has always been a close relationship between punjab and Kashmir. From narowal (my ancestral town) you can see the mountains of Jammu on a clear day, anyways Punjab has always been taking up people from different nations/ethnicities (arabs, turks/afghans, persians) who all form todays Punjab. The same holds for sindh as well.
But I meant in my previous post that Kashmiris (muhajireen or otherwise) have a special status within Pakistani constitution.

اسلام آباد ( مریم حسین) چیف جسٹس آف پاکستان جسٹس افتخار محمد چوہدری اپنے بیٹے ارسلان کی وجہ سے ایک بار پھر مشکل صورتحال سے دوچار ہونے والے ہیں۔ چیف جسٹس کے بیٹے پر ملک کے پراپرٹی کنگ سمجھے جانے والی ایک کاروباری شخصیت سے چالیس کروڑ روپے لینے کا الزام سامنے آ رہا ہے، جس کے سارے ثبوت بھی موجود ہیں جو ’پراپرٹی کنگ‘ آج کل اسلام اباد کے صحافیوں کو گھر بلا بلا کر دکھا رہے ہیں۔
پراپرٹی کنگ تقریباً ہر چھوٹے بڑے ٹی وی اینکر پرسن کو گھر بلا کر ارسلان کے خلاف اپنے الزامات کے دستاویزی ثبوت اور اس کی ویڈیوز دکھا چکا ہے کہ کیسے چیف جسٹس کا بیٹا ساؤتھ آف فرانس میں چھٹیاں گزارنے گیا تھا اور اس کی ادائیگی کس نے کی اور کس اکاؤئنٹ سے ان کے سفر کے اخراجات ادا کیے گئے تھے۔ لندن میں میریٹ ہوٹل میں رہائش کے اخراجات بھی اس کارڈ سے ادا کیے گئے ہیں جو اس پراپرٹی کنگ کے بیٹے کے نام پر ہے۔ ذرائع کا کہنا ہے کہ اسلام آباد میں اس وقت سب کو علم ہے کہ چیف جسٹس کے بیٹے کے خلاف سکینڈل تیار ہے اور
کسی لحمے بھی سامنے آ سکتا ہے۔
تاہم کچھ قابل اعتماد زرائع کے مطابق کسی زمانے میں جسٹس افتخار چوہدری اور اب وزیراعظم یوسف رضا گیلانی کے وکیل بیرسٹر اعتزاز احسن کوشش کر رہے ہیں کہ کسی طرح اس معاملے کو دبا دیا جائے۔ وہ اس سلسلے میں فریقین سے مسلسل ملاقاتیں کر رہے ہیں اور ان کی چیف جسٹس سے ملاقات کی خبر بھی اسلام آباد میں پھیلی ہوئی ہے۔
جسٹس افتخار چوہدری کے بیٹے کا نام پہلی بار اس وقت سامنے آیا تھا جب جنرل پرویز مشرف انہیں چیف جسٹس کے عہدے سے فارغ کرتے ہوئے ایک ریفرنس دائر کیا تھا جس میں بتایا گیا تھا کہ کیسے ڈاکٹر ارسلان کو بلوچستان کے صوبائی محکمہ صحت سے وفاقی حکومت کے محکمہ پولیس میں اے ایس پی لگوایا گیا تھا۔
مختلف ذرائع سے اکھٹی کی جانے والی اطلاعات کے مطابق پچھلے پراپرٹی کنگ نے ارسلان کے مزاج کو سمجھتے ہوئے اس وقت سے اس پر کام شروع کیا ہوا تھا جب سے اس کے ایک پراپرٹی علاقے میں کار ریس ہوئی جس میں پانچ لوگ مارے گئے تھے اور چیف جسٹس نے اس پر سو موٹو لے کر مذکورہ پراپرٹی کنگ کے بیٹے پر ایف آئی آر درج کرا دی تھی۔ پراپرٹی کنگ کا بیٹا بیرون ملک فرار ہوا تو عدالتی حکم پر اسے واپس ملک لایا گیا اور اس کے خلاف قتل کی دفعات کے تحت مقدمہ درج کیا گیا۔ اس کے ساتھ ہی ہلاک ہونیوالے افراد کے ورثاء کو دوکروڑ روپے قصاص کے طور پر دلائے گئے۔ لیکن پھر کچھ عرصہ بعد کیس کو دوبارہ کھول دیا گیا۔
اس صورتحال میں پراپرٹی کنگ ارسلان کے قریب ہوا جس میں اسے وزیراعظم گیلانی کے قریبی سمجھے جانے والے ایک بزنس مین احمد خلیل کی معاونت بھی حاصل تھی۔ جلد ہی ارسلان پراپرٹی کے کاروبار میں مصروف پائے گئے اور انہیں مختلف طریقوں سے چالیس کروڑ روپے کی ناجائز ادائیگیاں کی گئیں۔ اسی طرح ارسلان نے اسی پراپرٹی کنگ کے پیسوں پر بیرون ملک سیر و
تفریح بھی کی جس کے دستاویزی ثبوتوں کے ساتھ ساتھ آڈیو اور وڈیو ثبوت بھی محفوظ کیے گئے۔ یہ سب ثبوت اب صحافیوں کو دکھائے جا رہے ہیں۔
اب تک جن اینکرز کو یہ ثبوت دکھائے گئے ہیں ان میں حامد میر، کامران خان، نجم سیٹھی وغیرہ شامل ہیں اور ان سب کا تعلق جنگ گروپ سے ہے۔ پاکستان کے مشہور کالم نگار ہارون الرشید نے اپنے کالم میں پہلی دفعہ اس سکینڈل کے بارے میں یہ اشارہ دیا تھا کہ چیف جسٹس کے بیٹے کے خلاف الزام تراشی کی ایک نئی مہم شروع ہونے والی ہے۔ ان کا اشارہ اس سکینڈل کی طرف تھا جس کے بارے میں اب اسلام آباد کا ہر صحافی جانتا ہے تاہم ابھی تک اس کی تفصیلات سامنے نہیں لائی گئی ہیں۔ انصار عباسی نے بھی سوموار کو اپنے کالم میں اس طرف اشارہ کیا ہے تاہم انہوں نے بھی اس بارے میں مکمل بات نہیں کی اور اشاروں کنایوں میں بات کی کہ ان کا اشارہ کس طرف ہے اور کون حکومتی سازش کا شکار ہونے والا ہے۔ بتایا جاتا ہے کہ انصار

دی نیوز کے گروپ ایڈیٹر شاہین صہبائی نے پنتیس منٹ کے اپنے ایک ویڈیو انٹرویو میں پوری تفصیل سے اس سکینڈل پر روشنی ڈالی ہے۔ یہ علیحدہ بات ہے کہ انہوں نے اسے حکومت کی سازش سے تعبیر کیا ہے اور بچ بچا کر بات کرنے کی کوشش کی ہے جس کا مطلب یہ تھا کہ سارا سکینڈل بھی سامنے آجائے اور ان پر کوئی بات بھی نہ آئے۔شاہین صہبائی نے اسے ’فیملی گیٹ‘
سکینڈل کا نام دیا ہے۔
ذرائع کا کہنا ہے کہ ایک مشہور برٹش خاتون صحافی جو پاکستان کے بارے میں سکینڈل چھاپتی رہتی ہیں کے ساتھ بھی اس پراپرٹی کنگ کی بات چیت ہوئی ہے اور اسے وہ تمام ثبوت حوالے کیے گئے تھے تاکہ وہ لندن میں سنڈے ٹائمز میں وہ سکینڈل چھاپ سکے۔ تاہم یہ سکینڈل اب تک نہیں چھپ سکا کیونکہ بتایا جارہا ہے کہ اس خاتون رپورٹر کے ساتھ یہ بات باقاعدہ تحریری طور پر طے ہوا ہے کہ وہ اس وقت شائع کرے گئی جب اسے کہا جائے گا۔ ایک وقت یہ بھی پلان کیا گیا تھا کہ اس سکینڈل کو اس وقت چھاپا جائے جب چیف جسٹس لندن میں اپنا ایوارڈ لینے کے لیے پچھلے ہفتے گئے تھے۔ تاہم بعد میں اعتزاز احسن کی مداخلت سے بات وقتی طور پر رک گئی تھی

Yesterday I was watching a talk show and came to know that Governer of State Bank of Pakistan and many other top bureaucrats (secretaries) are dual national too.
Does constitution says something about them?

^ I think constitution applies on all of them, Infact notices have been sent to 13 important people of various parties yesterda. Either the constitution should be changed otherwise people should start following it.

I believe all the notices actually went to politicians (elected people) and not these public service people.
I'd be less worried about some tom dick and harry who is dual citizen, elected in some assembly and more worried about Governor State Bank of Pakistan with dual nationality.
Personally I think even for politicians, there should be no restriction on contesting an election if you are a dual national but living in their constituency for more than 3 years (in last 4 or 5). Yes we should bar them from being Minister or PM/CM etc.

ISLAMABAD: ***In response to another application, the Supreme Court also issued notices to 13 parliamentarians allegedly holding dual citizenship during today’s hearing. The notices were issued to elected members from the Pakistan Peoples Party (PPP), Pakistan Muslim League-Nawaz (PML-N), and the Muttahida Qaumi Movement (MQM).*
Finance Minister Dr Hafeez Shaikh and PML-N MNA Khawaja Asif are prominent among the names with US and Canadian citizenship, while Deputy Senate Chairman Sabir Baloch is also included in the list although his nationality remains unmentioned.
The applicant, Advocate Waheed Anjum, who is representing the Rawalpindi Bar Council, provided the lawmakers’ foreign passports numbers to the apex court during today’s proceedings.
According to his list, the names of parliamentarians with dual citizenship are: PML-N MPA Muhammad Akhlaq, MQM MPA Farhat Muhammad, PPP MPA Tariq Mehmood Alloana, PML-N MPA Dr Muhammad Ashraf Chouhan, PPP MPA Dr Ahmad Ali Shah, MQM MPA Nadia Gabol , PPP’s Amna Buttar, PPP MNA Zahid Iqbal, PML-N MNA Khawaja Muhammad Asif, PPP Senator Abdul Hafeez Shaikh, PPP Senator Sabir Ali Baloch, PML-N MPA Chaudhry Waseem Qadir and PML-N MPA Chaudhry Nadeem Khadim.
The counsel for MNA Zahid Iqbal told the court that his client had informed him that he has no foreign passport. PML-N MNA Khawaja Muhammad Asif told The Express Tribune that he will file a defamation suit against the lawyer who mentioned his name in the list without verification. “I am proud to be a green passport holder,” he said.
The finance minister, while speaking on the floor of the house, said, “I always had one nationality, will have one nationality and will die with that nationality which is Pakistani. I never sought any other nationality and will never seek (it).”

Every time I think we have seen enough, a new low is set by them. PML(N)'s minister is not only Dual-Citizen but he declared himself non-muslim in order to get elected on minority seat. There is absolutely no way that PML(N)'s leadership does not know about the religion of a person when handing out the tickets.

LAHORE -** It may come as a surprise for many but it is a fact that newly-appointed Punjab Finance Minister Rana Asif Mehmood, elected as MPA on a seat reserved for minorities, is not only a Muslim, but also a dual nationality (Canadian) holder**, an offensive which makes a case fit for his disqualification.Interestingly, the PML-N legislator from Sialkot is all set to present the provincial budget for the year 2012-13 in Punjab Assembly within next few days, unmindful of the fact that the Supreme Court has already suspended membership of two PPP MNAs - Farahnaz Ispahani and Rehman Malik - for having dual nationality.
According to legal documents available with TheNation, Rana Asif had declared himself a Muslim (and also his three daughters) in the declaration submitted before Nadra at the time of obtaining his Overseas Pakistani National Identity Card in the year 2009. But at the time of filing nomination papers, he falsely sworn in claiming himself to be a Christian, only to become member of the Punjab Assembly on a seat reserved for non-Muslims.
It may be mentioned that making a false affidavit is itself an offence within the meaning of Pakistan Penal Code and Section 30 of Accountability Ordinance, 2000 (sub-section (2) (F)] which is punishable for five-year imprisonment and fine of Rs 1,000. On the other hand, Rana’s election has already been challenged in the Lahore High Court (LHC).The petitioner, Faisal Ilyas Sadiq, through his counsel Saiful Malook Advocate, has sought his disqualification on the grounds that he got himself elected as member Punjab Assembly by falsely declaring himself a non-Muslim and that he was having dual nationality.
LHC Chief Justice Umer Ata Bandial is hearing the case. On the last date of hearing (May 8), Rana Asif’s counsel, admitted before the court that his client had dual nationality, but contested the case of his being a non-Muslim taking the plea that he (Rana) had been wrongly shown as a Muslim in Nadra’s record due to typographical mistake, which had been corrected. He further stated that the Supreme Court was also hearing the dual nationality case.The court after hearing the arguments had adjourned the matter till June 13 and directed the respondent’s counsel to submit SC’s verdict on dual nationality case, if announced. The apex court has now announced its verdict in the said case and suspended the membership of two PPP MNAs. The petitioner had contended that Rana Asif was a Muslim but elected as Punjab Assembly member in general elections 2008 against one of the seats reserved for non-Muslims.Meanwhile, PML-Q legislator Samina Khawar Hayat has submitted a privilege motion in the Punjab Assembly Secretariat seeking legal action against Rana Asif for submitting false declarations with Nadra and the ECP about his religion. She has pleaded that the PML-N lawmaker was not only a Muslim but also having dual nationality (Canadian). “He has got himself elected as MPA on a seat reserved for non-Muslims through fraudulent means by falsely declaring himself a Christian,” reads the privilege motion, which further said Rana was a “heretic and liable to be killed”.When contacted to know his version of the story, the Punjab finance minister maintained that it was Nadra’s mistake to show him a Muslim in the relevant column. He claimed that the record about his being a Muslim stood corrected now. But on dual nationality, Rana Asif failed to give any plausible explanation. When asked that he had, through his lawyer, given a confessionary statement before Justice Ata Bandial on May 8 that he was having dual nationality, Rana said his lawyer may have given such a statement, but he was ignorant about it. PML-N spokesperson Senator Pervaiz Rashid said he was unaware of the facts regarding Rana Asif’s case and hence was not in a position to comment over it.When asked if the PML-N would still allow Rana Asif to present the budget in the Punjab Assembly after the Supreme Court’s verdict on the dual nationality issue, Pervaiz Rashid repeated his earlier words that “I am not aware of the facts regarding Rana’s case”. He said Rana Asif was the right person to be contacted in this regard. He, however, said that the PML-N would abide by the court judgment on the matter.

A US president can only be a person who is a born citizen. Is it also abnormal that a person who is naturalized citizen or born outside of USA gets to vote but can't run for presidency?
Who says I agree with American Law??
Their law allows someone who is born in US but brought up as a terrorist in Yemen to be president of US, but disallows someone who is born in Yemen and brought up as an American in US..American law is abnormal as well...

Dual citizenship should be between countries that have same values...You can be canadian and American...or british & American...etc....but how can you be Saudi Wahabi and American at the same time??? How can you support banning of Bible in Saudi and at the sametime come to America and buy Bible from an American store??

India also gives special status to J&K..but there is one difference..constitution of Pakistan bans any Kashmiri political party that does not owe its allegience to Pakistan i.e. manifesto of kashmiri political parties should say that kashmir is a part of pakistan..there is no scope of seperatism....whereas India allows separatist political parties to function like any other political party...example All Parties Hurriyat Conference believes in independent Kashmir..
