Dual nationality holders banned from contesting polls

ISLAMABAD: The Secretary of Election Commission has said that the commission’s decision to bar dual nationality holders from contesting elections, also applies to the incumbent MPs.

Talking to The News, the secretary ECP, Ishtiak Ahmed Khan, explained that any incumbent member of parliament (National Assembly, Senate or provincial assemblies) could be de-seated for having dual nationality.

He, however, said that the Election Commission can’t move against such sitting MPs on its own but would require either a reference from presiding officer (Chairman Senate, Speaker of National or provincial assemblies) or a court order to de-seat such MPs.

The secretary said that the election of dual nationals to any house of parliament in the past had been a violation of the Constitution, as the relevant constitutional provision was never implemented.

“Any member in the present parliament having a dual nationality could be removed too but only if the Election Commission is referred such a case either by the speaker of the National Assembly or provincial assemblies or by chairman Senate or by the superior judiciary,” the secretary ECP said.

Under Article 63(1)(c) of the Constitution: “A person shall be disqualified from being elected or chosen as, and from being, a member of the Majlis-e-Shoora (Parliament), if he ceases to be a citizen of Pakistan or acquires the citizenship of a foreign state.”

The dilemma for the present parliament is that besides the ineligibility of its members having dual nationality, its standing became dubious for two reasons. Firstly, out of 80 million voters included in the electoral rolls on the basis of which the 2008 elections were held, 30 million votes were bogus. Secondly, at least 200 parliamentarians were feared to have been elected in the 2008 elections on the basis of fake degrees.

Although, the bogus 30 million votes have been cancelled and new electoral rolls are presently being finalised, the proceeding against the fake degree holders could not be matured because of strong opposition of the government and MPs. However, still at least 25-30 MPs have so far been de-seated for holding fake degrees.

Earlier, the ECP said that dual nationality holders will be ineligible for taking part in elections and asked for ensuring no candidate with dual nationality can take part in the upcoming election for a Senate seat that fell vacant after Azam Swati’s resignation.

The electoral body has asserted its position for the first time on this particular matter though the relevant law already existed in the Constitution but in the past, the ECP never dared to ensure its implementation.

However, it has now made it mandatory for a candidate to submit with his or her nomination papers a declaration about his or her nationality. In case of a dual nationality holder, such papers would not be entertained any more.

“Even if a candidate misleads the returning officer, truth will ultimately surface and this act will be a corrupt practice, liable for legal proceedings and ultimate disqualification of a misleading candidate,” a senior ECP official contended. A series of consultative sessions were held recently at the Election Commission to implement the clause in letter and spirit.

The Article 63-1(c) of the Constitution read with Section 99 (1A) (c) of the Representation of the People Act, 1976, clearly says that the law disqualifies such people from being elected, or chosen as, and from being a member of parliament, if he ceases to be a citizen of Pakistan or acquires the citizenship of a foreign state.

Former Senator Azam Swati, who was elected on a JUI-Fazl ticket, surrendered his American nationality to qualify for the election. He wrote a letter to the chief election commissioner to ensure implementation of the relevant clause.

“I still believe there are around 35 legislators who have dual nationality and still continue to be members of legislatures in the Centre and in provinces,” he maintained while talking to The News here.

Early this year, on the private members’ day, PML legislator Raza Hayat Hiraj had moved a bill in the National Assembly, seeking the disqualification of dual-nationality holders for the services of Pakistan, parliament as well as provincial assemblies.

Under the constitutional amendment bill, no citizen is to be allowed to take part in elections until and unless he or she surrenders the foreign nationality, if he has any.

ECP Secretary Ishtiak Ahmad Khan, according to the ECP Secretariat, said the ECP issued a directive for ensuring its strict implementation for returning officers to obtain a declaration on oath from all the persons filing nomination papers for an election to a seat in parliament or a provincial assembly.

He pointed out Article 63(1) (c) of the Constitution says, “A person shall be disqualified from being elected or chosen as, and from being, a member of the Majlis-e-Shoora (Parliament), if he ceases to be a citizen of Pakistan or acquires the citizenship of a foreign state.”

The ECP secretary made it clear that this provision of the Constitution was being implemented for the first time in the Senate by-election in Khyber Pakhtunkhwa for which nomination papers were to be submitted on December 20, 21, 2011 and the polling would take place on January 04, 2012 at the Provincial Assembly Building, Peshawar.

This should include the people whose first degree relatives have dual citizenship.

Also anyone with assets abroad and with first degree relatives with assets abroad should not be allowed contest elections.

But asset abroad is where i beg to differ, what if i have investments out of Pakistan, and from the returns of that investment i am doing business in Pakistan, yes we can proportionate it but cutting it all together, i don't think so!

There should be reserved seats for overseas Pakistanis and RIGHT TO VOTE in Pakistani elections. If we are saying k they can be loyal to only one country, then tomorrow kis mun sai we will ask them to send remits to Pakistan....

Overseas Pakistanis sure. Second generation nope. Second generation Pakistanis do not send remittances home.

Dual citizenship should be banned for any official holding a government position and any politician participating in elections.

Ok so here's what will happen...
Dual citiens will participate in elections and winner's eligibility will be challenged in courts after the elections and way after portfolios distribution,some of the winners will be some kind of choota moota wazeer by then no one will dare touch them.. there will be appeals and stay orders before the by-election drama.

^ i think its improving, during last 2 years several of fake degree holders got removed from their seats, some of them managed to get back, but not all. its going slow but its good

Then that person does not have to participate in elections. The problem is politicians are major source of capital flight that too from government money, we have to find a way to stop it.

I personally feel that politicians should not have any direct interest in businesses, yes few investments here or there to run their daily household expenses... but that would be against the capitalism... and obviously it is not practical either

If we say that we live in global village and MNC's are going to control the govts in near future, then Pakistan had to have such businesses all around the world or the country they consider of strategic importance.

Now there can be certain rules to control the capital flight, one of them can be, that all politicians having business interest out of Pakistan should pay certain % of their income/profits to the educational projects in their constituencies or of national level... there can be hundred other ideas to do control it... and it is role of civil establishment to control it and not of politicians... now that is another thing that our civil establishment have stored/dumped more money/wealth out of Pakistan then our politicians...

If you are politician and your investment (or investment of your close one) is outside Pakistan than that is most damaging to the country, much worse than having dual nationality. 

Reason:
1: Self interest: If your money is abroad than you lose nothing if country go to dogs and rupee value goes to Sh*t. Rather, you become richer in terms of rupee. On the other hand, if country prospers and rupee value rises than you lose as you become poorer in terms of rupee. So, your interest would be in making country go to dogs and rupee value to Sh*t.

2: Mistrust: Pakistanis whose investments are not in Pakistan show their mistrust on the future economy of Pakistan (or future of country). Since a politician plays role in making country stable and economically prosperous, such person should not mistrust country and country’s economy. So, such person should not invest abroad. Actually, from keeping investment in Pakistan shows his/her trust on Pakistan and Pakistani economy. Also tells voters that his/her prosperity is linked with prosperity of Pakistan.

Obviously, if a person trusts Pakistan economy than being Pakistani there is no reason for that person to invest abroad. If politicians invest abroad than how can such politician ask others to invest in Pakistan?

Dual National: Most people take dual nationality because they think it would increase their opportunities in life. That does not mean loyalty of dual national changes for Pakistan. In my opinion, there are many people of Pakistani origin with dual nationality, who when work for Pakistan they show more loyalty towards Pakistan than people with only Pakistani nationality.

I am not talking about money, i am talking about businesses... there is difference

Mongolia is opening its treasures to the world, Tajikistan is still waiting for the investors and business men to come along use their Gold Mines and generate electricity from using its water resources, which ever company will be doing these, would be having certain level of influence over the govt.

On the same note, Ghana is open for Oil-tenders for oil exploration and other kind of infra-structure projects, whoever would be developing those projects would be making huge profits and least to say about Libya & Iraq oil rich states, where all kind of infrastructure development work is going to take place in short while.

Where all the profits is going to go, why don't you bound the companies if headed by politicians to not to have an off-shore company and pay tax and bring all the profits back to Pakistan??? while shutting all doors to it??? it would be lame to say that this will hurt Pakistan, i would say it is better to send our labors in those countries and then get treated like a shyt.

1: Politicians should be banned from running business while in office, as that causes conflict of interest (State interest and interest of business). Ideally politicians should be banned from having business so that politicians in power make policy for country and not compromise policies to give advantage or safeguard interest for their own business.

2: Politicians could invest (as obviously if someone has money they cannot keep them under the pillow), but that investment has to be in Pakistan.

3: There is no excuse for politicians to do business or investment abroad. It is their duty to create good investment opportunity within country. If they invest abroad then they cannot ask or expect others to invest in Pakistan. Actually, by investing abroad they are showing mistrust on investing in Pakistan.

4: Politicians should not have assets abroad because as having assets abroad would create conflict of interest ... as Pakistani economy deteriorates and rupee devalue, those assets would make that politicians richer in rupee ... so for self interest that politicians might let country go to dogs and rupee to keep crashing.

5: If Pakistani politician who has not worked abroad has investment abroad than it is obvious that money is illegally transferred from Pakistan, most likely corruption money, and that should be investigated.
