followed by 2 weeks silence
and then he texts back saying hes asked around and divorce hasnt happened

Written Talaaq is permissible and so is SMSing or e-Mailing…
The idea behind it is that some actions are better than they look…
We can fall easily into assumptions…
meeni, I don’t know what prompted this from your husband, but that Talaq has not happened…
The Talaq even through sms or email shouldn’t be ‘I dvrc u x 3’…![]()
It must be a whole sentence written three times fully legible, so at least you know he wasn’t drinking with his girlfriend…
Secondly, did you talk to him privately and ask him what prompted him to do this?
Third, tell him you want a legal document, during the process of which he might think things over a bit…
And if things don’t work out, then I agree with Sara 516, you may be a lot better off without him…I have seen instances of ladies with 2, 3 and 4 kids find a very nice man to enjoy their life with

^ some scholars say the divorce is still valid but the man has acted sinfully thereby... but generally, that the woman is in a state of purity, free from her menses, is a condition unless the woman herself instigates the divorce... it is also a condition that the husband should not have had sexual relations with his wife since her last period ended as she may have fallen pregnant as a result and he may not be aware of this and perhaps it might cause him to change his mind...
